87	87	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
88	88	SECTION 1. AMENDATORY 70 O.S. 2021, Section 509.11, i s
89	89	amended to read as follows:
90	90	Section 509.11. A. No school district, employee of a school
91	91	district, or employee organization shall deny by any means,
92	92	including a collective bar gaining agreement, a statewide
93	93	professional educators ’ association equal access to employees of the

146	146	educators’ associations. For purposes of this section, access shall
147	147	include, but is not limited to:
148	148	1. Setting up informational tables at in -service or other
149	149	similar teacher meetings;
150	150	2. Speaking at in-service or other similar teacher meetings;
151	151	3. Distributing information in school mail boxes or through the
152	152	school e-mail system;
153	153	4. Utilizing school district meeting rooms during nonworking
154	154	hours;
155	155	5. Representing employees in employment matters, when requested
156	156	by the employee;
157	157	6. Posting information on school district bulletin boards or
158	158	other common space displays ; and
159	159	7. Utilizing school district printing services Promotional
160	160	events.
161	161	B. Any association which uti lizes school district facilities or
162	162	services shall reimburse the district for any costs incurred by the
163	163	district due to association activities .
164	164	C. Equal access shall not be cond itional on provisions or
165	165	services requested by school districts including, but not limited
166	166	to, furnished meals, snacks, gifts, donations, or other types of
167	167	sponsored activities.

219	219	D. Communication by an employee, volunteer, or member of a
220	220	statewide professional educators’ association on behalf of the
221	221	association or a local affiliate group that pertains to a collective
222	222	bargaining agreement or negotiated employment contract pursuant to
223	223	Section 509.2 of this title shall, for the purposes of this section,
224	224	be classified as a promotional event hosted by the statewide
225	225	association, and all other statewide professional educators ’
226	226	associations and their employees shall be granted equal access to
227	227	communicate with school employees to the same extent. For the
228	228	purposes of this section, communication includes, but is not limited
229	229	to, presentations, s peaking events, meetings, emails, informational
230	230	displays, and virtual forum posts.
231	231	E. Distribution of promotional materials to all employees in
232	232	school mailboxes by employees or associated members of a statewide
233	233	professional educators ’ association shall be permitted. Promotional
234	234	materials may include, but are not limited to, promotional
235	235	brochures, competitor comparison brochures, informational pamphlets,
236	236	membership applications, gift items, and association member gifts.
237	237	F. School districts shall not requi re a fee or other payment
238	238	from statewide professional educators ’ associations for access,
239	239	promotional material review, promotional material distribution, or
240	240	other related activit ies.

292	292	G. 1. A statewide professional educators ’ association that is
293	293	not allowed access as provided for in this section shall notify the
294	294	board of education of the school district where access was denied.
295	295	2. Upon notification, if the school district board of education
296	296	does not ensure equal access is provided to the statewide
297	297	professional educators’ association within fifteen (15) days, the
298	298	association shall notify the State Board of Education.
299	299	SECTION 2. This act shall become effective July 1, 2025.
300	300	SECTION 3. It being immediately necessary for the preservation
301	301	of the public peace, health, or safety, an emergency is hereby
302	302	declared to exist, by reason whereof this act shall take effect and
303	303	be in full force from and after its passage and approval.
