7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.545, is
7979 amended to read as follows:
8080 Section 1210.545. A. Except as otherwise provided, as part of
8181 the accountability system developed as provided for in Section
8282 1210.541 of this title, the State Board of Education shall prepare
8383 annual reports of the results of the Oklahoma School Testing Program
8484 which describe student achievement in the state, and each school
8585 site, pursuant to the Elementary and Secondary Education Act of 1965
8686 (ESEA) as reauthoriz ed by P.L. No. 114-95, also known as the Every
8787 Student Succeeds Act (ESSA), and any related federal regulations.

139139 B. The annual report as required pursuant to subsection A of
140140 this section shall identify school sites as having one of the
141141 following grades for each indicator, separately, and by a single
142142 overview grade of all indicators, defined according to rules of the
143143 State Board of Education:
144144 1. “A” means schools making excellent progress;
145145 2. “B” means schools making above average progress;
146146 3. “C” means schools making satisfactory progress;
147147 4. “D” means schools making less than satisfactory progress;
148148 and
149149 5. “F” means schools failing to make adequate progress.
150150 C. Each school that has students who are tested and included in
151151 the school grading system as provided for in this section shall
152152 receive a school grade, except as follows:
153153 1. A school shall not receive a school grade if the number of
154154 students tested and included in the sc hool grading system is less
155155 than the minimum sample size necessary for statist ical reliability
156156 and prevention of the unlawful release of personally identifiable
157157 student data. The State Board of Education is directed to establish
158158 the lowest minimum sample size necessary to meet the requirements of
159159 this paragraph; and
160160 2. The academic performance of students who are enrolled full -
161161 time in an online program that is offered by a school district or
162162 charter school that is not the district of residence or is not

215215 reported separately by the school district or charter school and
216216 shall not be included when determining the grade of the school site
217217 or charter school.
218218 D. The State Board of Education may adopt a lternate systems of
219219 accountability for statewide virtual charter schools, alternative
220220 education programs as defined in Section 1210.568 of this title, and
221221 schools serving only grades prekindergarten or kindergarten through
222222 two.
223223 E. The grade of a school sh all be based on a multimeasures
224224 approach to accountability in accordance with the Elementary and
225225 Secondary Education Act of 1965 (ESEA) as reauthorized by P.L. No.
226226 114-95, also known as the Every Student Succeeds Act (ESSA) and any
227227 federal regulations that include, but are not limited to, the
228228 following indicators:
229229 1. Statewide assessments, including the establishment of
230230 student performance bands;
231231 2. Graduation rates for high schools;
232232 3. Statewide academic measures for elementary and middle
233233 schools;
234234 4. English language proficiency for English learners; and
235235 5. At least one additio nal statewide measure of school quality
236236 or student success, including, but not limited to, school climate,

288288 school safety, student engagement, educator engagement, and/or
289289 advanced coursework and postsecondary readiness.
290290 F. Of the indicators included in subsection E of this section,
291291 not less than seventy percent (70%) of the overview grade must be
292292 given to indicators 1, 2, 3 , and 4 and, in the aggregate, with not
293293 more than thirty percent (30%) of the grade given to indicator 5.
294294 G. Further, the grade of an e lementary or middle school site
295295 shall include, but not be limited to, a measure of status for
296296 English language arts (ELA), math , and science, growth in ELA and
297297 math, English Language Proficiency Assessment language proficiency
298298 assessment (ELPA) progress, and chronic absenteeism.
299299 H. The grade of a high school site shall include, but not be
300300 limited to, a measure of status for English language arts (ELA),
301301 math, and science status, English Language Proficiency Assessment
302302 language proficiency assessment (ELPA) progress, graduation rate,
303303 chronic absenteeism, and postsecondary opportunities. For purposes
304304 of this section, postsecondary opportunities shall include Advanced
305305 Placement advanced placement, International Baccalaureate, dual and
306306 concurrent enrollment, internships, mentorships and apprenticeships,
307307 and industry certifications. The Board shall adopt a time line
308308 timeline for moving from completion of such opportunities to
309309 crediting achievement of such opportunities.
310310 I. The annual report shall identify the p erformance of each
311311 school as having improved, remained the same, or declined. This

363363 school improvement rating shall be based on a comparison of the
364364 student and school performance data of the current year to the
365365 previous year data.
366366 J. 1. The State Department of Education shall annually develop
367367 a school site report card to be delivered to parents throughout each
368368 school district. The report card shall be in accordance with the
369369 requirements of the Elementary and Secondary Education Act of 1965
370370 (ESEA), as reauthorized and amended by P.L. No. 114 -95, also known
371371 as the Every Student Succeeds Act (ESSA) and includes the grade for
372372 the school, information regarding school improvement, an explanation
373373 of school performance, and indicators of return on investment. The
374374 report card for each school site shall be published annually by the
375375 Department on its website, and every school district shall provide
376376 the school site report card to the parent or guardian of each
377377 student enrolled in the school site. In order to provide
378378 information regarding school performance for school report cards
379379 issued during the 2016 -2017 and 2017-2018 school year, the
380380 Department shall include an explanation of the change s to the
381381 statewide system of student assessments as required in Section
382382 1210.508 of this title and how the transition in assessments may
383383 impact school performance. The Department shall issue school report
384384 cards using the 2016 -2017 school year assessment d ata that is

437437 2. The school site report card published on the Depart ment’s
438438 website and provided to the parent or guardian of each student
439439 enrolled in the school site pursuant to paragraph 1 of this
440440 subsection shall include a minimum of five (5) i ndicators of
441441 enrichment and support opportunities such as the following:
442442 a. programs offered for gifted and talented students,
443443 b. foreign language course offerings,
444444 c. whether the school site has an active parent teacher
445445 association or parent teacher organ ization,
446446 d. science, technology, engineering, and math (STEM)
447447 course offerings,
448448 e. intergenerational programming offerings,
449449 f. apprenticeship, internship, and mentorship offerings,
450450 g. before-school and after-school programming
451451 availability,
452452 h. extracurricular activities available , and
453453 i. mental health support.
454454 3. The school site report card published on the Department’s
455455 website and provided to the parent or guardian of each student
456456 enrolled in the school site pursuant to paragraph 1 of this
457457 subsection shall include a minimum of three indicators of staffing
458458 experience and retention s uch as the following:
459459 a. the percentage of teachers with more than three (3)
460460 years of teaching experience,

512512 b. the percentage of teachers who have been employed by
513513 the school site for more than three (3) years,
514514 c. the percentage of teachers with National Board
515515 certification or post -graduate degrees,
516516 d. the percentage of teachers with an emergency or
517517 provisional certificate, as provided for in Section 6 -
518518 187 of this title,
519519 e. the percentage of teachers who are adjunct teachers,
520520 as provided for in Section 6 -122.3 of this title, and
521521 f. the length of time the school site principal has been
522522 in his or her position.
523523 K. The Legislature may factor in the performance of schools in
524524 calculating any performance-based funding policy that is provided to
525525 public school districts.
526526 L. The State Board of Education shall promulgate rules to
527527 implement the provisions of this section.
528528 SECTION 2. This act shall become effective July 1, 2025 .
529529 SECTION 3. It being immediately necessary for the preservat ion
530530 of the public peace, health, or safety, an emergency is hereby
531531 declared to exist, by reason whereof this act shall take effect and
532532 be in full force from and after its passage and approval.
