6385 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6486 SECTION 1. NEW LAW A new section of law to be codified
6587 in the Oklahoma Statutes as Section 22 -126.1 of Title 11, unless
6688 there is created a duplication in numbering, reads as follows:
6789 A. This act shall be known and may be cited as the “Prohibition
6890 on Sanctuary Policies for Illegal Immigration Act”.
6991 B. As used in this section:

97143 1. “Federal immigration agency ” means the United States
98144 Department of Justice and the United States Department of Homeland
99145 Security, a division within such an agency, including United States
100146 Immigration and Customs Enforcement and United States Customs and
101147 Border Protection, any succe ssor agency, and any other federal
102148 agency charged with the enforcement of immigration law ;
103149 2. “Immigration detainer ” means a facially sufficient written
104150 or electronic request is sued by a federal immigration agency using
105151 that agency’s official form to request that another law enforcement
106152 agency detain a person based on probable cause to believe that the
107153 person to be detained is a removable alien under federal immigration
108154 law, including detainers issued pursuant to 8 U.S.C. , Sections 1226
109155 and 1357 along with a warrant described in subparagraph c of this
110156 section. For purposes of this section, an immigration detainer is
111157 deemed facially sufficient if:
112158 a. the federal immigration agency ’s official form is
113159 complete and indicates on its face that the federal
114160 immigration official has probable cause to believe
115161 that the person to be detained is a removable alien
116162 under federal immigration law, or the federal
117163 immigration agency’s official form is incomplete and
118164 fails to indicate on its face that the federal
119165 immigration official has probable cause to believe

148218 under federal immigration law, but is supported by an
149219 affidavit, order, or other officia l documentation that
150220 indicates that the federal immigration agency has
151221 probable cause to believe that the person to be
152222 detained is a removable alien under federal
153223 immigration law, and
154224 b. the federal immigration agency supplies with its
155225 detention request a Form I-200 Warrant for Arrest of
156226 Alien or a Form I-205 Warrant of Removal/Depo rtation
157227 or a successor warrant or other warrant authorized by
158228 federal law;
159229 3. “Inmate” means a person in the custody of a law enforcement
160230 agency;
161231 4. “Law enforcement agency ” means an agency in this state
162232 charged with enforcement of state, county, municipal, or federal
163233 laws or with managing custody of detained persons in this state and
164234 includes municipal police departments, sheriffs ’ offices, state
165235 police departments, state unive rsity and college police departments,
166236 county correctional agencies, and the De partment of Corrections ;
167237 5. “Local governmental entity ” means any county, municipality,
168238 or other political subdivision of this state ;
169239 6. “Sanctuary policy” means a law, policy, practice, procedure,
170240 or custom adopted or allowed by a state entity or local governmental
171241 entity which prohibits or impedes a law enforcement agency from

199293 complying with 8 U.S.C. , Section 1373 or which prohibits or impedes
200294 a law enforcement agency from com municating or cooperating with a
201295 federal immigration agency so as to limit suc h law enforcement
202296 agency in, or prohibit the agency from:
203297 a. complying with an immigration detainer,
204298 b. complying with a request from a federal immigration
205299 agency to notify the a gency before the release of an
206300 inmate or detainee in the custody of the law
207301 enforcement agency,
208302 c. providing a federal immigration agency access to an
209303 inmate for interview,
210304 d. participating in any program or agreement authorized
211305 under Section 287 of the Im migration and Nationality
212306 Act, 8 U.S.C., Section 1357, or
213307 e. providing a federal immigration agency with an
214308 inmate’s incarceration status or release date ; and
215309 7. “State entity” means the state or any office, board, bureau,
216310 commission, department, branch, division, or institution thereof,
217311 including institutions within the state University System.
218312 C. A state entity, law enforcement agency, or local
219313 governmental entity shall not adopt or have in effect a sanctuary
220314 policy.
221315 D. 1. A law enforcement agency sha ll use best efforts to
222316 support the enforcement of federal immigration law. This subsection

250368 applies to an official, representative, agent, or employee of the
251369 entity or agency only when he or she is acting within the scope of
252370 his or her official duties or w ithin the scope of his or her
253371 employment.
254372 2. Except as otherwise expressly prohibited by federal law, a
255373 state entity, local governmental entity, or law enforcement agency,
256374 or an employee, an agent, or a representative of the entity or
257375 agency, may not proh ibit or in any way restrict a law enforcement
258376 agency from taking any of the fo llowing actions with respect to
259377 information regarding a person ’s immigration status:
260378 a. sending the information to or requesting, receiving,
261379 or reviewing the information from a f ederal
262380 immigration agency for purposes of this chapter,
263381 b. recording and maintaining the information for purposes
264382 of this act,
265383 c. exchanging the information with a federal immigration
266384 agency or another state entity, local governmental
267385 entity, or 136 law en forcement agency for purposes of
268386 this act,
269387 d. using the information to comply with an immigration
270388 detainer, or
271389 e. using the information to confirm the identity of a
272390 person who is detained by a law enforcement agency.

300442 3. a. For purposes of this subsection, the term “applicable
301443 criminal case” means a criminal case in which:
302444 (1) the judgment requires the defendant to be
303445 confined in a secure correctional facility, and
304446 (2) the judge:
305447 (a) indicates in the record that the defendant
306448 is subject to an immigration det ainer, or
307449 (b) otherwise indicates in the record that the
308450 defendant is subject to a transfer into
309451 federal custody.
310452 b. In an applicable criminal case, when the judge
311453 sentences a defendant who is the subject of an
312454 immigration detainer to confinement, the judg e shall
313455 issue an order requiring the secure correctional
314456 facility in which the defendant is to be confined to
315457 reduce the defendant ’s sentence by a period of not
316458 more than twelve (12) days on the facility ’s
317459 determination that the reduction in sentence will
318460 facilitate the seamless transfer of the defendant into
319461 federal custody.
320462 c. If the information specified in subdivision a of
321463 division 2 of subparagraph a of this paragraph or
322464 subdivision b of division 2 of subparagraph a of this
323465 paragraph is not available at the time the sentence is

351517 pronounced in the case, but is received by a law
352518 enforcement agency afterwards, the law enforcement
353519 agency shall notify the judge , who shall issue the
354520 order provided for in subparagraph b of this paragraph
355521 as soon as the informat ion becomes available.
356522 4. A state entity, local governmental entity, or law
357523 enforcement agency that withholds information regarding the
358524 immigration information of a victim of or witness to a criminal
359525 offense pursuant to paragraph 8 of this subsection shal l document
360526 the victim’s or witness’s cooperation in the entity ’s or agency’s
361527 investigative records related to the offense and shall retain the
362528 records for at least ten (10) years for the purpose of audit,
363529 verification, or inspection by the Auditor General.
364530 5. When a county correctional facility or the Department of
365531 Corrections receives verification from a federal immigration agency
366532 that a person subject to an immigration detainer is in the law
367533 enforcement agency’s custody, the agency may securely transport the
368534 person to a federal facility in this state or to another point of
369535 transfer to federal custody outside the jurisdiction of the law
370536 enforcement agency. The law enforcement agency may transfer a
371537 person who is subject to an immigration detainer and is co nfined in
372538 a secure correctional facility to the custody of a federal
373539 immigration agency not earlier than twelve (12) days before his or
374540 her release date. A law enforcement agency shall obtain judicial

402592 authorization before securely transporting an alien to a point of
403593 transfer outside of this state.
404594 6. This section does not require a state entity, local
405595 governmental entity, or law enforcement agency to provide a federal
406596 immigration agency with information related to a victim of or a
407597 witness to a criminal of fense if the victim or witness timely and in
408598 good faith responds to the entity ’s or agency’s request for
409599 information and cooperation in the investigation or prosecution of
410600 the offense.
411601 7. This section does not authorize a law enforcement agency to
412602 detain an alien unlawfully present in the United States pursuant to
413603 an immigration detainer solely because the alien witnessed or
414604 reported a crime or was a victim of a criminal offense.
415605 8. This section does not apply to any alien unlawfully present
416606 in the United States if he or she is or has been a necessary witness
417607 or victim of a crime o f domestic violence, rape, sexual
418608 exploitation, sexual assault, murder, manslaughter, assault,
419609 battery, human trafficking, kidnapping, false imprisonment,
420610 involuntary servitude, fraud in foreign labor contracting,
421611 blackmail, extortion, or witness tampering.
422612 E. Each county correctional facility shall enter into an
423613 agreement or agreements with a federal immigration agency for
424614 temporarily housing persons who are the subject of immig ration
425615 detainers and for the payment of the costs of housing and detaining

453667 such persons. A compliant agreement may include any contract
454668 between a correctional facility and a federal immigration agency for
455669 housing or detaining persons subject to immigratio n detainers, such
456670 as basic ordering agreements in effect on or after July 1, 2019,
457671 agreements authorized by Section 287 of the Immigration and
458672 Nationality Act, 8 U.S.C. , Section 1357, or successor agreements and
459673 other similar agreements authorized by feder al law.
460674 F. 1. Any executive or administrative state, county, or
461675 municipal officer who violates his or her duties under this chapter
462676 may be subject to action by the Governor in the exercise of his or
463677 her authority under the Oklahoma Constitution and state law. The
464678 Governor may initiate judicial proceedings in the name of the state
465679 against such officers to enforce compliance with any duty under this
466680 chapter or restrain any unauthorized act contrary to this chapter.
467681 2. In addition, the Attorney General may file suit against a
468682 local governmental entity or local law enforcement agency in a court
469683 of competent jurisdiction for declaratory or injunctive relief for a
470684 violation of this chapter.
471685 3. If a local governmental entity or local law enforcement
472686 agency violates this chapter, the court must enjoin the unlawful
473687 sanctuary policy. The court has continuing jurisdiction over the
474688 parties and subject matter and may enforce its orders with the
475689 initiation of contempt proceedings as provided by law.

503741 4. An order approving a consent decree or granting an
504742 injunction must include written findings of fact that describe with
505743 specificity the existence and nature of the sanctuary policy that
506744 violates this chapter.
507745 5. If the Governor finds that a local governmental entity or
508746 local law enforcement agency has violated this chapter, the Governor
509747 may suspend any state funding set to be distributed to that local
510748 governmental entity or local law enforcement agency until a court
511749 enjoins the unlawful sanctuary policy.
512750 SECTION 2. This act shall become effective November 1, 2025.
