	42	+	percentage of sentence; modifying statutory
	43	+	references to certain criminal offenses; modifying
	44	+	name of certain unlawful act; adding certain criminal
	45	+	offense; amending 21 O.S. 2021, Section 540A, which
	46	+	relates to eluding peace officers; modifying certain
	47	+	penalty provisions; updating statutory language; and
	48	+	providing an effective date.

52	54		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	55		SECTION 1. AMENDATORY 21 O.S. 2021, Section 13.1, as
54	56		amended by Section 1, Chapter 151, O.S.L. 2024 (21 O.S. Supp. 2024,
55	57		Section 13.1), is amended to read as follows:
56	58		Section 13.1. Persons convicted of:
57	59		1. First degree murder as defined provided for in Section 701.7
58	60		of this title;
59	61		2. Second degree murder as defined by provided for in Section
60	62		701.8 of this title;
61	63		3. Manslaughter in the first degree as defined by provided for
62	64		in Section 711 of this title;

142	142		15. Forcible sodomy as defined provided for in Section 888 of

151	151		19. Abuse of a vulnerable adult as defined in Section 10 -103 of
152	152		Title 43A of the Oklahoma Statutes;

154	154		Section 2-415 of Title 63 of the Oklahoma Statutes;
155	155		21. Aggravated assault and battery as provided for in Section
156	156		646 of this title upon any person defending another person from
157	157		assault and battery; or
158	158		22. Human trafficking as provided for defined in Section 748 of
159	159		this title; or
160	160		23. Causing an accident , while eluding or attemp ting to elude
161	161		an officer, that results in great bodily injury to any other person
162	162		as provided for in Section 540A of this title ,

190	189		shall be required to serve not less than eighty -five percent (85%)
191	190		of any sentence of imprisonment imposed by the judicial system prior
192	191		to becoming eligible for consideration for parole. Persons
193	192		convicted of these offenses shall not be eligible for earned credits
194	193		or any other type of credits which have the effect of reducing the
195	194		length of the sentence to less than eighty -five percent (85%) of the
196	195		sentence imposed.
197	196		SECTION 2. AMENDATORY 21 O.S. 2021, Section 540A, is
198	197		amended to read as follows:
199	198		Section 540A. A. Any operator of a motor vehicle who has
200	199		received a visual and audible signal, a red light , and a siren from
201	200		a peace officer driving a motor vehicle showing the same to be an
202	201		official police, sheriff, highway patrol , or state game ranger
203	202		vehicle directing the operator to bring the vehicle to a stop and
204	203		who willfully increases the speed or extinguish es the lights of the
205	204		vehicle in an attempt to elude such peace officer, or willfully
206	205		attempts in any other manner to elude the pea ce officer, or who does
207	206		elude such peace officer, is guilty of a misdemeanor. The peace
208	207		officer, while attempting to stop a violator of this section, may
209	208		communicate a request for the assistance of other peace officers
210	209		from any office, department , or agency. Any peace officer within
211	210		this state having knowledge of such request is authorized to render
212	211		such assistance in stopping the violator and may effect an arrest
213	212		under this section upon probable cause. Violation of this

241	239		subsection shall, upon conviction, constitute a misdemeanor and
242	240		shall be punishable by not more than one (1) year of imprisonment in
243	241		the county jail or, by a fine of not less than One Hundred Dollars
244	242		($100.00) nor more than Two Thousand Dollars ($2,000.00) , or by both
245	243		such fine and impris onment. A second or subsequent violation of
246	244		this subsection shall be punishable by not more than one (1) year of
247	245		imprisonment in the county jail or, by a fine of not less than Five
248	246		Hundred Dollars ($500.00) nor more than Five Thousand Dollars
249	247		($5,000.00), or by both such fine and imprisonment.
250	248		B. Any person who violates the provisions of subsection A of
251	249		this section in such manner as to endanger any other person shall ,
252	250		upon conviction, be deemed guilty of a felony punishable by
253	251		imprisonment in the State Penitentiary custody of the Department of
254	252		Corrections for a term of not less than one (1) year nor more than
255	253		five (5) years, or by a fine of not less than One Thousand Dollars
256	254		($1,000.00) nor more than Five Thousand Dollars ($5,000.00), or by
257	255		both such fine and imprisonment.
258	256		C. 1. Any person who causes an accident, while eluding or
259	257		attempting to elude an officer, resulting in great bodily injury to
260	258		any other person while driving or operating a motor vehicle within
261	259		this state and who is in violation of the provisions of subsection A
262	260		of this section may be charged with a violation of the provisions of
263	261		this subsection. Any person w ho is convicted of a violation of the
264	262		provisions of this subsection shall be deemed guilty of a felony

293	290		custody of the Department of Corrections for not less than one (1)
294	291		year and not five (5) years nor more than five (5) seven (7) years,
295	292		and a fine of not more than Five Thousand Dollars ($5,000.00).
296	293		2. As used in this subsection, “great bodily injury” means
297	294		bodily injury which creates a substantial risk of death or which
298	295		causes serious, permanent disfigurement or protracted loss or
299	296		impairment of the function of any bodily member or organ.
300	297		SECTION 3. This act shall become effective November 1, 2025.
