5254 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5355 SECTION 1. AMENDATORY 21 O.S. 2021, Section 13.1, as
5456 amended by Section 1, Chapter 151, O.S.L. 2024 (21 O.S. Supp. 2024,
5557 Section 13.1), is amended to read as follows:
5658 Section 13.1. Persons convicted of:
5759 1. First degree murder as defined provided for in Section 701.7
5860 of this title;
5961 2. Second degree murder as defined by provided for in Section

190189 shall be required to serve not less than eighty -five percent (85%)
191190 of any sentence of imprisonment imposed by the judicial system prior
192191 to becoming eligible for consideration for parole. Persons
193192 convicted of these offenses shall not be eligible for earned credits
194193 or any other type of credits which have the effect of reducing the
195194 length of the sentence to less than eighty -five percent (85%) of the
196195 sentence imposed.
197196 SECTION 2. AMENDATORY 21 O.S. 2021, Section 540A, is
198197 amended to read as follows:
199198 Section 540A. A. Any operator of a motor vehicle who has
200199 received a visual and audible signal, a red light , and a siren from
201200 a peace officer driving a motor vehicle showing the same to be an
202201 official police, sheriff, highway patrol , or state game ranger
203202 vehicle directing the operator to bring the vehicle to a stop and
204203 who willfully increases the speed or extinguish es the lights of the
205204 vehicle in an attempt to elude such peace officer, or willfully
206205 attempts in any other manner to elude the pea ce officer, or who does
207206 elude such peace officer, is guilty of a misdemeanor. The peace
208207 officer, while attempting to stop a violator of this section, may
209208 communicate a request for the assistance of other peace officers
210209 from any office, department , or agency. Any peace officer within
211210 this state having knowledge of such request is authorized to render
212211 such assistance in stopping the violator and may effect an arrest
213212 under this section upon probable cause. Violation of this

241239 subsection shall, upon conviction, constitute a misdemeanor and
242240 shall be punishable by not more than one (1) year of imprisonment in
243241 the county jail or, by a fine of not less than One Hundred Dollars
244242 ($100.00) nor more than Two Thousand Dollars ($2,000.00) , or by both
245243 such fine and impris onment. A second or subsequent violation of
246244 this subsection shall be punishable by not more than one (1) year of
247245 imprisonment in the county jail or, by a fine of not less than Five
248246 Hundred Dollars ($500.00) nor more than Five Thousand Dollars
249247 ($5,000.00), or by both such fine and imprisonment.
250248 B. Any person who violates the provisions of subsection A of
251249 this section in such manner as to endanger any other person shall ,
252250 upon conviction, be deemed guilty of a felony punishable by
253251 imprisonment in the State Penitentiary custody of the Department of
254252 Corrections for a term of not less than one (1) year nor more than
255253 five (5) years, or by a fine of not less than One Thousand Dollars
256254 ($1,000.00) nor more than Five Thousand Dollars ($5,000.00), or by
257255 both such fine and imprisonment.
258256 C. 1. Any person who causes an accident, while eluding or
259257 attempting to elude an officer, resulting in great bodily injury to
260258 any other person while driving or operating a motor vehicle within
261259 this state and who is in violation of the provisions of subsection A
262260 of this section may be charged with a violation of the provisions of
263261 this subsection. Any person w ho is convicted of a violation of the
264262 provisions of this subsection shall be deemed guilty of a felony

296293 2. As used in this subsection, “great bodily injury” means
297294 bodily injury which creates a substantial risk of death or which
298295 causes serious, permanent disfigurement or protracted loss or
299296 impairment of the function of any bodily member or organ.
300297 SECTION 3. This act shall become effective November 1, 2025.
