83	83	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
84	84	SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -2515, is
85	85	amended to read as follows:
86	86	Section 1-2515. A. Notwithstanding any other provision of this
87	87	title, Emergency Medical Services (EMS) Regions emergency medical
88	88	service (EMS) regions , Ambulance Service ambulance service districts
89	89	or, and municipalities are hereby authorized to regulate and
90	90	control, pursuant to duly enacted ordinance or regulation, Ambulance
91	91	Service ambulance service transports originating within the

143	143	jurisdiction of such EMS Regions regions, Ambulance Service
144	144	ambulance service districts, or municipalities.
145	145	B. Any ordinance or regulation adopted pursuant to subsection A
146	146	of this section shall meet and may exceed, but shall not be in
147	147	contravention of, the standards promulgated by the State Board
148	148	Commissioner of Health for Ambulance Service ambulance service
149	149	transports.
150	150	C. 1. Any ordinance or regulation adopted by an EMS Region,
151	151	Ambulance Service district region or a municipality may establish a
152	152	sole-provider system for wheelchair, stretcher van and/or Ambulance
153	153	Service, or ambulance service transports, or a combination thereof;
154	154	provided, however, any such designated or contracted sole -provider
155	155	which is not an EMS Region, Ambulance Service district region,
156	156	municipality, or other public entity shall be select ed by
157	157	competitive bidding.
158	158	2. A contract entered into pursuant to such biddin g shall be
159	159	with the lowest and best bidder and may be for an initial term of
160	160	such duration as deemed operationally and fiscally prudent by the
161	161	contracting agency. The term of su ch sole-provider contract shall
162	162	be made public at the time bids are solicited, which solicitation
163	163	shall be not less than sixty (60) days prior to the contract start
164	164	date.
165	165	D. Any EMS Region, Ambulance Service district region or
166	166	municipality may establish a sole-provider system for wheelchair,

219	219	transports, or a combination thereof , and may allow additional
220	220	geographic or political subdivisions to join such a system at any
221	221	time. Whenever such a geogr aphic or political subdivision joins
222	222	such a sole-provider system, competitive bidding shall not be
223	223	required and provision for servicing the new jurisdiction may be
224	224	accomplished by amending the existing sole -provider contract.
225	225	Furthermore, in the event the expansion of the service area of the
226	226	EMS Region, Ambulance Service district region or the municipality is
227	227	substantial (in the sole opinion of the governing body of the EMS
228	228	Region region, Ambulance Service ambulance service district or
229	229	municipality), the e xisting sole-provider contract may be extended
230	230	for a period sufficient to allow reasonable opportunity for recovery
231	231	of capital costs of expansion, as determined by the contracting
232	232	agency.
233	233	E. 1. All ambulance service districts shall be sole -provider
234	234	systems for all emergency and nonemergency wheelchair, stretcher
235	235	van, and ambulance service transports within their geographical
236	236	boundaries. No ambulance service provider or other provider of such
237	237	transports shall operate within the ambulance service district
238	238	without the prior written authorization of the ambulance service
239	239	district, and licensure of the provider by the State Department of
240	240	Health to provide such transports within the ambulance service

292	292	district shall be contingent upon obtainment of such prior wr itten
293	293	authorization.
294	294	2. An ambulance service district may petition the distri ct
295	295	court for relief when a provider violates the provision s of
296	296	paragraph 1 of this subsection and the court shall award any
297	297	appropriate relief including, but not limited to, inju nctive relief,
298	298	compensatory damages, punitive damages, and reasonable attorney
299	299	fees.
300	300	F. The provisions of this section shall not be construed or
301	301	applied to limit:
302	302	1. Limit the operation of any emergency medical service
303	303	district established and operating pursuant to Section 9C of Article
304	304	10 X of the Oklahoma Constitution; provided, however, that, upon
305	305	invitation and approval of a majority of the voters of the district,
306	306	any such district is hereby authorized to join by appropriate
307	307	agreement any system estab lished by an EMS Region region, Ambulance
308	308	Service ambulance service district, or a municipality pursuant to
309	309	the provisions of this section ; or
310	310	2. Prohibit a hospital, medical facility, or long-term care
311	311	facility from entering into a contract with an ambul ance service
312	312	district to provide transports within the ambulance service distr ict
313	313	as stipulated in the contract and subject to the prior written
314	314	authorization required by subsection E of this section .

366	366	F. G. The following types of patient transports shall be exempt
367	367	from regulation by EMS Regions regions, Ambulance Service ambulance
368	368	service districts, or municipalities:
369	369	1. Any ambulance owned or operated by, or under contract to
370	370	perform ambulance transport services for, the Federal federal or
371	371	State state government, or any agency thereof;
372	372	2. Any ambulance owned and operated by a hos pital and in use to
373	373	transport a patient of the owner -hospital, which patient has been
374	374	admitted to and not been discharged from the owner -hospital, to or
375	375	from another hospital or medical care facility at which the patient
376	376	receives a diagnostic or therapeutic procedure not available at the
377	377	owner-hospital, provided that the patient is not discharged from the
378	378	care of the owner-hospital at any point during transport or while
379	379	the patient is at the other hospital or medical facility ;
380	380	3. Any ambulance engaged in a routine transport call to
381	381	transport a patient from a hospital, nursing home, or dialysis
382	382	center located within an EMS Region, Ambulance Service district or
383	383	municipality to any l ocation outside the EMS Region, Ambulance
384	384	Service district or municipality;
385	385	4. Any ambulance engaged in the transport of a patient from a
386	386	location outside an EMS Region region, Ambulance Service ambulance
387	387	service district, or municipality to a location in side an EMS Region
388	388	region, Ambulance Service ambulance service district, or
389	389	municipality; or
