8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. AMENDATORY 22 O.S. 2021, Section 60.2, as
8585 last amended by Section 1, Chapter 305, O.S.L. 2023 (22 O.S. Supp.
8686 2024, Section 60.2), is amended to read as follows:
8787 Section 60.2. A. A victim of domestic abuse, a victim of
8888 stalking, a victim of hara ssment, a victim of rape, any adult or
8989 emancipated minor household member on behalf of any other family or
9090 household member who is a minor or incompetent, any minor age
9191 sixteen (16) or seventeen (17) years, or any adult victim of a crime

143143 may seek relief under the provisions of the Protection from Domestic
144144 Abuse Act.
145145 1. The person seeking relief may file a petition for a
146146 protective order with the district court in the county in wh ich the
147147 victim resides, the county in which the defendant resides, or the
148148 county in which the domestic violence occurred. If the person
149149 seeking relief is not a family or household member or an individual
150150 who is or has been in a dating relationship with th e defendant, the
151151 person seeking relief must file a complaint against the defendant
152152 with the proper law enforcement agency before filing a petition for
153153 a protective order with the district court. The person seeking
154154 relief shall provide a copy of the compla int that was filed with the
155155 law enforcement agency at the full hearing if the complaint is not
156156 available from the law enforcement agency. Failure to provide a
157157 copy of the complaint filed with the law enforcement agency shall
158158 constitute a frivolous filing and the court may assess attorney fees
159159 and court costs against the plaintiff pursuant to paragraph 2 of
160160 subsection C of this section. The filing of a petition for a
161161 protective order shall not require jurisdiction or venue of the
162162 criminal offense if either the plaintiff or defendant resides in the
163163 county. If a petition has been fil ed in an action for divorce or
164164 separate maintenance and either party to the action files a petition
165165 for a protective order in the same county where the action for
166166 divorce or separate maintenance is filed, the petition for the

218218 protective order may be heard by the court hearing the divorce or
219219 separate maintenance action if:
220220 a. there is no established protective order docket in
221221 such court, or
222222 b. the court finds that, in the interest of judicial
223223 economy, both actions may be heard together; provided,
224224 however, the petition for a protective order,
225225 including, but not limited to, a petition in which
226226 children are named as petitioners, shall remain a
227227 separate action and a separate order shall be entered
228228 in the protective order action. Protective orders may
229229 be dismissed in favor of restraining orders in the
230230 divorce or separate maintenance action if the court
231231 specifically finds, upon hearing, that such dismissal
232232 is in the best interests of the parties and does not
233233 compromise the safety of any petitioner.
234234 If the defendant is a minor child, the petition shall be filed
235235 with the court having jurisdiction over juvenile matters.
236236 2. When the abuse occurs when the court is not open for
237237 business, such person may request an emergency temporary order of
238238 protection as authorized by Section 40.3 of this title.
239239 3. A petition for a protective order may include all members of
240240 the residence of the petitioner seeking relief as part of the same
241241 petition.

293293 B. The petition forms shall be provided by the clerk of the
294294 court. The Administrativ e Office of the Courts shall develop a
295295 standard form for the petition.
296296 C. 1. Except as otherwise provided by this section, no filing
297297 fee, service of process fee, attorney fees or any other fee or costs
298298 shall be charged the plaintiff or victim at any time for filing a
299299 petition for a protective order whether a protective order is
300300 granted or not granted. The court may assess court costs, service
301301 of process fees, attorney fees, oth er fees and filing fees against
302302 the defendant at the hearing on the petition, if a protective order
303303 is granted against the defendant; provided, the court shall have
304304 authority to waive the costs and fees if the court finds that the
305305 party does not have the a bility to pay the costs and fees.
306306 2. If the court makes specific findings that a petition for a
307307 protective order has been filed frivolously and no victim exists,
308308 the court may assess attorney fees and court costs against the
309309 plaintiff.
310310 D. The person seeking relief shall prepare the petition or, at
311311 the request of the plaintiff, the court clerk or the victim -witness
312312 coordinator, victim support person, and court case manager shall
313313 prepare or assist the plaintiff in preparing the petition.
314314 E. The person seeking a protective order may further request
315315 the exclusive care, possession, or control of any animal owned,
316316 possessed, leased, kept, or held by either the petitioner, defendant

368368 or minor child residing in the residence of the petitioner or
369369 defendant. The court may order the defendant to make no contact
370370 with the animal and forbid the defendant from taking, transferring,
371371 encumbering, concealing, molesting, attacking, striking,
372372 threatening, harming, or otherwise disposing of the animal.
373373 F. A court may not requ ire the victim to seek legal sanctions
374374 against the defendant including, but not limited to, divorce,
375375 separation, paternity , or criminal proceedings prior to hearing a
376376 petition for protective order.
377377 G. A victim of rape, forcible sodomy, a sex offense,
378378 kidnapping, assault and battery with a deadly weapon, child abuse,
379379 or member of the immediate family of a victim of first -degree
380380 murder, as such terms are defined in Section 40 of this title, may
381381 petition, or have a petition filed on the victim ’s behalf if the
382382 victim is a minor, for an emergency temporary order or emergency ex
383383 parte order regardless of any relationship or scenario pursuant to
384384 the provisions of this section. The Administrative Office of the
385385 Courts shall modify the petition forms as necessary to effectuate
386386 the provisions of this subsection.
387387 SECTION 2. AMENDATORY 22 O.S. 2021, Section 60.4, as
388388 amended by Section 7, Chapter 318, O.S.L. 2022 (22 O.S. Supp. 2024,
389389 Section 60.4), is amended to read as follows:
390390 Section 60.4. A. 1. A copy of a petition for a protective

443443 order or emergency ex parte order issued by the court shall be
444444 served upon the defendant in the same manner as a bench warrant. In
445445 addition, if the service is to be in another county, the court clerk
446446 may issue service to the sheriff by facsimile or other electronic
447447 transmission for service by the sheriff and receive the return of
448448 service from the sheriff in the same manner. Any fee for service o f
449449 a petition for protective order, notice of hearing, and emergency ex
450450 parte order shall only be charged pursuant to subsection C of
451451 Section 60.2 of this title and, if charged, shall be the same as the
452452 sheriff’s service fee plus mileage expenses.
453453 2. Emergency temporary orders, emergency ex parte orders and
454454 notice of hearings shall be given priority for service and can be
455455 served twenty-four (24) hours a day when the location of the
456456 defendant is known. When service cannot be made upon the defendant
457457 by the sheriff, the sheriff may contact another law enforcement
458458 officer or a private investigator or private process server to serve
459459 the defendant.
460460 3. An emergency temporary order, emergency ex parte order, a
461461 petition for protective order, and a notice of hearing shall have
462462 statewide validity and may be transferred to any law enforcement
463463 jurisdiction to effect service upon the defendant. The sheriff may
464464 transmit the document by electronic means.

516516 4. The return of service shall be submitted to the sheriff ’s
517517 office or court clerk in the court where the petition, notice of
518518 hearing or order was issued.
519519 5. When the defendant is a minor child who is ordered removed
520520 from the residence of the victim, in addition to those documents
521521 served upon the defendant, a copy of the petition, notice of hearing
522522 and a copy of any temporary order or ex parte ord er issued by the
523523 court shall be delivered with the child to the caretaker of the
524524 place where such child is taken pursuant to Section 2 -2-101 of Title
525525 10A of the Oklahoma Statutes .
526526 B. 1. Within fourteen (14) days of the filing of the petition
527527 for a protective order, the court shall schedule a full hearing on
528528 the petition, if the court finds sufficient grounds within the scope
529529 of the Protection from Domestic Abuse Act stated in th e petition to
530530 hold such a hearing, regardless of whether an emergency temporar y
531531 order or ex parte order has been previously issued, requested or
532532 denied. Provided, however, when the defendant is a minor child who
533533 has been removed from the residence pursuan t to Section 2-2-101 of
534534 Title 10A of the Oklahoma Statutes, the court shall schedule a full
535535 hearing on the petition within seventy -two (72) hours, regardless of
536536 whether an emergency temporary order or ex parte order has been
537537 previously issued, requested or denied.
538538 2. The court may schedule a full hearing on the petition for a
539539 protective order within seventy -two (72) hours when the court issues

591591 an emergency temporary order or ex parte order suspending child
592592 visitation rights due to physical violence or thre at of abuse.
593593 3. If service has not been made on the defendant at the time of
594594 the hearing, the court shall, at the request of the petitioner,
595595 issue a new emergency order reflecting a new hearing date and direct
596596 service to issue.
597597 4. A petition for a protec tive order shall, upon the request of
598598 the petitioner, renew every fourteen (14 ) days with a new hearing
599599 date assigned until the defendant is served. A petition for a
600600 protective order shall not expire unless the petitioner fails to
601601 appear at the hearing or fails to request a new order. A petitioner
602602 may move to dismiss the petition and emergency or final order at any
603603 time; however, a protective order must be dismissed by court order.
604604 5. Failure to serve the defendant shall not be grounds for
605605 dismissal of a petition or an ex parte order unless the victim
606606 requests dismissal or fails t o appear for the hearing thereon.
607607 6. A final protective order shall be granted or denied within
608608 six (6) months of service on the defendant unless all parties agree
609609 that a temporary protective order remain in effect; provided, a
610610 victim shall have the right to request a final protective order
611611 hearing at any time after the passage of six (6) months.
612612 C. 1. At the hearing, the court may impose any terms and
613613 conditions in the protect ive order that the court reasonably
614614 believes are necessary to bring about the cessation of domestic

666666 abuse against the victim or stalking or harassment of the victim or
667667 the immediate family of the victim but shall not impose any term and
668668 condition that may compromise the safety of the victim including,
669669 but not limited to, mediation, couples counseling, family
670670 counseling, parenting classes or joint victim -offender counseling
671671 sessions. The court may order the defendant to obtain domestic
672672 abuse counseling or t reatment in a program certified by the Attorney
673673 General at the expense of the defendant pursuant to Section 644 of
674674 Title 21 of the Oklahoma Statutes.
675675 2. The court shall consider a defendant ’s criminal history in
676676 determining any terms and conditions in the protective order that
677677 the court reasonably believes are necessary to bring about the
678678 cessation of domestic abuse against the victim or stalking or
679679 harassment of the victim or the immediate family of the victim.
680680 3. If the court grants a protective order a nd the defendant is
681681 a minor child, the court shall order a preliminary inquiry in a
682682 juvenile proceeding to determine whether further court action
683683 pursuant to the Oklahoma Juvenile Code should be taken against a
684684 juvenile defendant.
685685 D. Final protective orde rs authorized by this section shall be
686686 on a standard form developed by the Administrative Office of the
687687 Courts.
688688 E. 1. After notice and hearing, protective orders authorized
689689 by this section may require the defendant to undergo treatment or

741741 participate in the court-approved counseling services necessary to
742742 bring about cessation of d omestic abuse against the victim pursuant
743743 to Section 644 of Title 21 of the Oklahoma Statutes but shall not
744744 order any treatment or counseling that may compromise the safety of
745745 the victim including, but not limited to, mediation, couples
746746 counseling, family counseling, parenting classes or joint victim -
747747 offender counseling sessions.
748748 2. The defendant may be required to pay all or any part of the
749749 cost of such treatment or counseling s ervices. The court shall not
750750 be responsible for such cost.
751751 3. Should the plaintiff choose to undergo treatment or
752752 participate in court -approved counseling services for victims of
753753 domestic abuse, the court may order the defendant to pay all or any
754754 part of the cost of such treatment or counseling services if the
755755 court determines that payment by the defendant is appropriate.
756756 F. When necessary to protect the victim and when authorized by
757757 the court, protective orders granted pursuant to the provisions of
758758 this section may be served upon the defendant by a peace officer,
759759 sheriff, constable, or policeman or other officer whose duty it is
760760 to preserve the peace, as defined by Section 99 of Title 21 of the
761761 Oklahoma Statutes.
762762 G. 1. Any protective order issued on or after November 1,
763763 2012, pursuant to subsection C of this section shall be:

815815 a. for a fixed period not to exceed a period of five (5)
816816 years unless extended, modified, vacated or rescinded
817817 upon motion by either party or if the court approves
818818 any consent agreement entered into by the plaintiff
819819 and defendant; provided, if the defendant is
820820 incarcerated, the protective order shall remain in
821821 full force and effect during the period of
822822 incarceration. The period of incarceration, in any
823823 jurisdiction, shall not be in cluded in the calculation
824824 of the five-year time limitation, or
825825 b. continuous upon a specific finding by the court of one
826826 of the following:
827827 (1) the person has a history of violating the orders
828828 of any court or governmental entity,
829829 (2) the person has previous ly been convicted of a
830830 violent felony offense,
831831 (3) the person has a previous f elony conviction for
832832 stalking as provided in Section 1173 of Title 21
833833 of the Oklahoma Statutes,
834834 (4) a court order for a final Victim Protection Order
835835 has previously been issued a gainst the person in
836836 this state or another state, or

888888 (5) the victim provides proof that a continuous
889889 protective order is necessary for his or her
890890 protection.
891891 Further, the court may take into consideration whether the person
892892 has a history of domestic violen ce or a history of other violent
893893 acts. The protective order shall remain in e ffect until modified,
894894 vacated or rescinded upon motion by either party or if the court
895895 approves any consent agreement entered into by the plaintiff and
896896 defendant. If the defenda nt is incarcerated, the protective order
897897 shall remain in full force and effect during the period of
898898 incarceration.
899899 2. The court shall notify the parties at the time of the
900900 issuance of the protective order of the duration of the protective
901901 order.
902902 3. Upon the filing of a motion by either party to modify,
903903 extend, or vacate a protecti ve order, a hearing shall be scheduled
904904 and notice given to the parties. At the hearing, the issuing court
905905 may take such action as is necessary under the circumstances.
906906 4. If a child has been removed from the residence of a parent
907907 or custodial adult because of domestic abuse committed by the child,
908908 the parent or custodial adult may refuse the return of such child to
909909 the residence unless, upon further consideration by the court in a
910910 juvenile proceeding, it is determined that the child is no longer a
911911 threat and should be allowed to return to the residence.

963963 H. 1. It shall be unlawful for any person to knowingly and
964964 willfully seek a protective order against a spouse or ex -spouse
965965 pursuant to the Protection from Domestic Abuse Act for purposes of
966966 harassment, undue advantage, intimidation, or limitation of child
967967 visitation rights in any divorce proceeding or separation action
968968 without justifiable cause.
969969 2. The violator shall, upon convi ction thereof, be guilty of a
970970 misdemeanor punishable by imprisonment in the co unty jail for a
971971 period not exceeding one (1) year or by a fine not to exceed Five
972972 Thousand Dollars ($5,000.00), or by both such fine and imprisonment.
973973 3. A second or subsequent conviction under this subsection
974974 shall be a felony punishable by imprisonment in the custody of the
975975 Department of Corrections for a period not to exceed two (2) years,
976976 or by a fine not to exceed Ten Thousand Dollars ($10,000.00), or by
977977 both such fine and i mprisonment.
978978 I. 1. A protective order issued under the Protection from
979979 Domestic Abuse Act shall not in any manner affect title to real
980980 property, purport to grant to the parties a divorce or otherwise
981981 purport to determine the issues between the parties as to child
982982 custody, visitation or visitation schedules, child support or
983983 division of property or any other like relief obtainable pursuant to

10411041 2. When granting any protective order for the protection of a
10421042 minor child from violence or threats of abuse, the court shall allow
10431043 visitation only under conditions that provide adequate supervision
10441044 and protection to the child while maintaining the integr ity of a
10451045 divorce decree or temporary order.
10461046 J. 1. In order to ensure that a petitioner can maintain an
10471047 existing wireless telephone number or household utility account, the
10481048 court, after providing notice and a hearing, may issue an order
10491049 directing a wireless service provider or public utility provider to
10501050 transfer the billing responsibility for and rights to the wireless
10511051 telephone number or numbers of any minor children in the care of the
10521052 petitioning party or household utility account to the petitioner if
10531053 the petitioner is not the wireless service or public utility account
10541054 holder.
10551055 2. The order transferring billing responsibility for and rights
10561056 to the wireless telephone number or numbers or household utility
10571057 account to the petitioner shall list the name and b illing telephone
10581058 number of the account holder, the name and contact information of
10591059 the person to whom the telephone number or numbers or household
10601060 utility account will be transferred and each telephone number or
10611061 household utility to be transferred to that person. The court shall

11161116 3. Upon issuance, a copy of the final order of protection shall
11171117 be transmitted, either electron ically or by certified mail, to the
11181118 registered agent of the wireless service provider or public utility
11191119 provider listed with the Secretary of State or Corporation
11201120 Commission of Oklahoma or electronically to the email address
11211121 provided by the wireless servic e provider or public utility
11221122 provider. Such transmittal shall constitute adeq uate notice for the
11231123 wireless service provider or public utility provider.
11241124 4. If the wireless service provider or public utility provider
11251125 cannot operationally or technically effe ctuate the order due to
11261126 certain circumstances, the wireless service provider or public
11271127 utility provider shall notify the petitioner. Such circumstances
11281128 shall include, but not be limited to, the following:
11291129 a. the account holder has already terminated the a ccount,
11301130 b. the differences in network technology prevent the
11311131 functionality of a mobile device on the network, or
11321132 c. there are geographic or other limitations on network
11331133 or service availability.
11341134 5. Upon transfer of billing responsibility for and rights to a
11351135 wireless telephone number or numbers or household utility account to
11361136 the petitioner under the provisions of this subsection by a wireless

11891189 assume all financial responsibility for the transf erred wireless
11901190 telephone number or numbers or household utility account, month ly
11911191 service and utility billing costs and costs for any mobile device
11921192 associated with the wireless telephone number or numbers. The
11931193 wireless service provider or public utility pr ovider shall have the
11941194 right to pursue the original account holder for purposes of
11951195 collecting any past due amounts owed to the wireless service
11961196 provider or public utility provider.
11971197 6. The provisions of this subsection shall not preclude a
11981198 wireless service provider or public utility provider from applying
11991199 any routine and customary re quirements for account establishment to
12001200 the petitioner as part of this transfer of billing responsibility
12011201 for a household utility account or for a wireless telephone number
12021202 or numbers and any mobile devices attached to that number including,
12031203 but not limited to, identification, financial information and
12041204 customer preferences.
12051205 7. The provisions of this subsection shall not affect the
12061206 ability of the court to apportion the assets and debts of the
12071207 parties as provided for in law or the ability to determine the
12081208 temporary use, possession and control of personal property.
12091209 8. No cause of action shall lie against any wireless service
12101210 provider or public utility provider, its officers, employe es or

12641264 9. As used in this subsection:
12651265 a. “wireless service provider ” means a provider of
12661266 commercial mobile service under Section 332(d) o f the
12671267 federal Telecommunications Act of 1996,
12681268 b. “public utility provider ” means every corporation
12691269 organized or doing business in this state that owns,
12701270 operates or manages any plant or equipment for the
12711271 manufacture, production, transmission, transportation ,
12721272 delivery or furnishing of water, heat or light with
12731273 gas or electric current for heat, light or power, for
12741274 public use in this state, and
12751275 c. “household utility account ” shall include utility
12761276 services for water, heat, light, power or gas that are
12771277 provided by a public utility provider.
12781278 K. 1. A court shall not issue any mutual protec tive orders.
12791279 2. If both parties allege domestic abuse by the other party,
12801280 the parties shall do so by separate petitions. The court shall
12811281 review each petition separately in an i ndividual or a consolidated
12821282 hearing and grant or deny each petition on its individual merits.
12831283 If the court finds cause to grant both motions, the court shall do
12841284 so by separate orders and with specific findings justifying the
12851285 issuance of each order.

13371337 3. The court may only consolidate a hearing if:
13381338 a. the court makes specific finding s that:
13391339 (1) sufficient evidence exists of domestic abuse,
13401340 stalking, harassment or rape against each party,
13411341 and
13421342 (2) each party acted primarily as aggressors,
13431343 b. the defendant filed a petition with the court for a
13441344 protective order no less than three (3) days, not
13451345 including weekends or holidays, prior to the first
13461346 scheduled full hearing on the petition filed by the
13471347 plaintiff, and
13481348 c. the defendant had no less than forty -eight (48) hours
13491349 of notice prior to the full hearing on the petition
13501350 filed by the plaintiff.
13511351 L. The court may allow a plaintiff or victim to be accompanied
13521352 by a victim support person at court proceedings. A victim support
13531353 person shall not make legal arguments; however , a victim support
13541354 person who is not a licensed attorney may offer the plaintiff or
13551355 victim comfort or support and may remain in close proximity to the
13561356 plaintiff or victim.

14121412 1. Has been served with an emergency temporary, ex parte or
14131413 final protective order or foreign protective order and is in
14141414 violation of such protective o rder, upon conviction, shall be guilty
14151415 of a misdemeanor felony and shall be punished by a fine of not more
14161416 than One Thousand Dollars ($1,000.00) or Two Thousand Dollars
14171417 ($2,000.00), by a term of imprisonment in the county jail of custody
14181418 of the Department of Corrections for not more than one (1) year two
14191419 years, or by both such fine and imprisonment; and
14201420 2. After a previous conviction of a violation of a protective
14211421 order, is convicted of a second or subsequent offense pursuant to
14221422 the provisions of this sect ion shall, upon conviction, be guilty of
14231423 a felony and shall be punished by a term of imprisonment in the
14241424 custody of the Department of Corrections for not less than one (1)
14251425 year nor more than three (3) four (4) years, or by a fine of not
14261426 less than Two Thousand Dollars ($2,000.00) nor more than Ten

14281428 imprisonment.
14291429 B. 1. Any person who has been served with an emergency

14311431 order who violates the protective order and causes physical injury
14321432 or physical impairment to the plaintiff or to any other person named
14331433 in said protective order shall, upon conviction, be guilty of a

14931493 the protective order shall be guilty of a felony and shall be
14941494 punished by a term of imprisonment in the custody of the Department
14951495 of Corrections of not less than one (1) year nor more than five (5)
14961496 years six (6) years, or by a fine of not less than Three Thousand
14971497 Dollars ($3,000.00) nor more than Ten Thousand Dol lars ($10,000.00),
14981498 or by both such fine and imprisonment.
14991499 3. In determining the term of imprisonment required by this
15001500 section, the jury or sentencing judge shall consider the degree of
15011501 physical injury or physical impairment to the victim.
15021502 4. The provisions of this subsection shall not affect the
15031503 applicability of Sections 644, 645, 647 and 652 of Title 21 of the
15041504 Oklahoma Statutes.
15051505 C. The minimum sentence of imprisonment issued pursuant to the
15061506 provisions of paragraph 2 of subsection A and paragraph 2 of
15071507 subsection B of this section shall not be subject to statutory
15081508 provisions for suspended sentences, deferred sentences or probation,

15631563 D. In addition to any other penalty specified by this section,
15641564 the court shall require a defendant to undergo the treatment or
15651565 participate in the counseling services necessary to bring about the
15661566 cessation of domestic abuse against the victim or to bring about the
15671567 cessation of stalking or harassment of the victim. For every
15681568 conviction of violation of a protective order:
15691569 1. The court shall specifically order as a condition of a
15701570 suspended sentence or probatio n that a defendant participate in
15711571 counseling or undergo treatment to bring abo ut the cessation of
15721572 domestic abuse as specified in paragraph 2 of this subsection;
15731573 2. a. The court shall require the defendant to participate
15741574 in counseling or undergo treatment f or domestic abuse
15751575 by an individual licensed practitioner or a domestic
15761576 abuse treatment program certified by the Attorney
15771577 General. If the defendant is ordered to participate
15781578 in a domestic abuse counseling or treatment program,
15791579 the order shall require the d efendant to attend the
15801580 program for a minimum of fifty -two (52) weeks,
15811581 complete the program, and be evaluated before and
15821582 after attendance of the program by a program counselor
15831583 or a private counselor.

16351635 b. A program for anger management, couples counseling, or
16361636 family and marital counseling shall not solely qualify
16371637 for the counseling or treatment requirement for
16381638 domestic abuse pursuant to this subsection. The
16391639 counseling may be ordered in addition to counseling
16401640 specifically for the treatment of domestic abuse or
16411641 per evaluation as set forth below. If, after
16421642 sufficient evaluation and atten dance at required
16431643 counseling sessions, the domestic violence treatment
16441644 program or licensed professional determines that the
16451645 defendant does not evaluate as a perpetrator of
16461646 domestic violence or does evaluate as a perpetrator of
16471647 domestic violence and should complete other programs
16481648 of treatment simultaneously or prior to domestic
16491649 violence treatment, including but not limited to
16501650 programs related to the mental health, apparent
16511651 substance or alcohol abuse or inability or refusal to
16521652 manage anger, the defendant shal l be ordered to
16531653 complete the counseling as per the recommendations of
16541654 the domestic violence treatment program or licensed
16551655 professional;
16561656 3. a. The court shall set a review hearing no more than one
16571657 hundred twenty (120) days after the defendant is

17141714 b. The court shall set a second review hearing after the
17151715 completion of the counseling or treatment to assure
17161716 the attendance and compliance of the defendant with
17171717 the provisions of this su bsection and the domestic
17181718 abuse counseling or treatment requirements. The court
17191719 may suspend sentencing of the defendant until the
17201720 defendant has presented proof to the court of
17211721 enrollment in a program of treatment for domestic
17221722 abuse by an individual licens ed practitioner or a
17231723 domestic abuse treatment program certified by the
17241724 Attorney General and attendance at weekly sessions of
17251725 such program. Such proof shall be presented to the
17261726 court by the defendant no later than one hundred
17271727 twenty (120) days after the de fendant is ordered to
17281728 such counseling or treatment. At such time, the court
17291729 may complete sentencing, beginning the period of the
17301730 sentence from the date that proof of enrollment is
17311731 presented to the court, and schedule reviews as
17321732 required by subparagraphs a and b of this paragraph
17331733 and paragraphs 4 and 5 of this subsection. The court

17881788 4. The court may set subsequent or other revie w hearings as the
17891789 court determines necessary to assure the defendant attends and fully
17901790 complies with the provisions of this subsection and the domestic
17911791 abuse counseling or treatment requirements;
17921792 5. At any review hearing, if the defendant is not
17931793 satisfactorily attending individual counseling or a domestic abuse
17941794 counseling or treatm ent program or is not in compliance with any
17951795 domestic abuse counseling or treatment requirements, the court may
17961796 order the defendant to further or continue counseling, treatment, or
17971797 other necessary services. The court may revoke all or any part of a
17981798 suspended sentence, deferred sentence, or probation pursuant to
17991799 Section 991b of this title and subject the defendant to any or all
18001800 remaining portions of the original sentence;
18011801 6. At the first review hearing, the court shall require the
18021802 defendant to appear in co urt. Thereafter, for any subsequent review
18031803 hearings, the court may accept a report on the progress of the
18041804 defendant from individual counseling, domestic abuse counseling, or
18051805 the treatment program. There shall be no requirement for the victim
18061806 to attend review hearings; and
18071807 7. If funding is available, a referee may be appointed and
18081808 assigned by the presiding judge of the district court to hear

18611861 compensation for the referees shall be fixed by the presiding judge.
18621862 The referee shall meet the requirements and perform all duties in
18631863 the same manner and procedure as set forth in Sections 1 -8-103 and
18641864 2-2-702 of Title 10A of the Oklahoma Statutes pertaining to referees
18651865 appointed in juvenile proceedings.
18661866 E. Emergency temporary, ex parte and final protective orders
18671867 shall include notice of these penalties.
18681868 F. When a minor child violates the provisions of any protective
18691869 order, the violation shall be heard in a juvenile proceeding and the
18701870 court may order the child and the parent or parents of the child to
18711871 participate in family counseling services necessary to bring about
18721872 the cessation of domestic abuse against the victim and may order
18731873 community service hours to be performed in lieu of any fine or
18741874 imprisonment authorized by this section.
18751875 G. Any district court of this state and any judge thereof shall
18761876 be immune from any liability or prosecution for issuing an order
18771877 that requires a defendant to:
18781878 1. Attend a treatment program for domestic abusers certified by
18791879 the Attorney General;
18801880 2. Attend counseling or treatment services ordered as part of
18811881 any final protective order or for any violation of a protective
18821882 order; and

19341934 3. Attend, complete, and be evaluated before and after
19351935 attendance by a treatment program for domestic abusers certified by
19361936 the Attorney General.
19371937 H. At no time, under any proceeding, may a person protected by
19381938 a protective order be held to be in violation of that protectiv e
19391939 order. Only a defendant against whom a protective order has been
19401940 issued may be held to have violated the order.
19411941 I. In addition to any other penalty specified by this section,
19421942 the court may order a defendant to use an active, real -time, twenty-
19431943 four-hour Global Positioning System (GPS) monitoring device as a
19441944 condition of a sentence. The court may further order the defendant
19451945 to pay costs and expenses related to the GPS device and monitoring.
19461946 SECTION 4. This act shall become effective Nove mber 1, 2025.
