---|
145 | 145 | | 1. The person seeking relief may file a petition for a |
---|
146 | 146 | | protective order with the district court in the county in wh ich the |
---|
147 | 147 | | victim resides, the county in which the defendant resides, or the |
---|
148 | 148 | | county in which the domestic violence occurred. If the person |
---|
149 | 149 | | seeking relief is not a family or household member or an individual |
---|
150 | 150 | | who is or has been in a dating relationship with th e defendant, the |
---|
151 | 151 | | person seeking relief must file a complaint against the defendant |
---|
152 | 152 | | with the proper law enforcement agency before filing a petition for |
---|
153 | 153 | | a protective order with the district court. The person seeking |
---|
154 | 154 | | relief shall provide a copy of the compla int that was filed with the |
---|
155 | 155 | | law enforcement agency at the full hearing if the complaint is not |
---|
156 | 156 | | available from the law enforcement agency. Failure to provide a |
---|
157 | 157 | | copy of the complaint filed with the law enforcement agency shall |
---|
158 | 158 | | constitute a frivolous filing and the court may assess attorney fees |
---|
159 | 159 | | and court costs against the plaintiff pursuant to paragraph 2 of |
---|
160 | 160 | | subsection C of this section. The filing of a petition for a |
---|
161 | 161 | | protective order shall not require jurisdiction or venue of the |
---|
162 | 162 | | criminal offense if either the plaintiff or defendant resides in the |
---|

226 | 226 | | children are named as petitioners, shall remain a |
---|
227 | 227 | | separate action and a separate order shall be entered |
---|
228 | 228 | | in the protective order action. Protective orders may |
---|
229 | 229 | | be dismissed in favor of restraining orders in the |
---|
230 | 230 | | divorce or separate maintenance action if the court |
---|
231 | 231 | | specifically finds, upon hearing, that such dismissal |
---|
232 | 232 | | is in the best interests of the parties and does not |
---|
233 | 233 | | compromise the safety of any petitioner. |
---|
234 | 234 | | If the defendant is a minor child, the petition shall be filed |
---|
235 | 235 | | with the court having jurisdiction over juvenile matters. |
---|
236 | 236 | | 2. When the abuse occurs when the court is not open for |
---|
237 | 237 | | business, such person may request an emergency temporary order of |
---|
238 | 238 | | protection as authorized by Section 40.3 of this title. |
---|
239 | 239 | | 3. A petition for a protective order may include all members of |
---|
240 | 240 | | the residence of the petitioner seeking relief as part of the same |
---|

293 | 293 | | B. The petition forms shall be provided by the clerk of the |
---|
294 | 294 | | court. The Administrativ e Office of the Courts shall develop a |
---|
295 | 295 | | standard form for the petition. |
---|
296 | 296 | | C. 1. Except as otherwise provided by this section, no filing |
---|
297 | 297 | | fee, service of process fee, attorney fees or any other fee or costs |
---|
298 | 298 | | shall be charged the plaintiff or victim at any time for filing a |
---|
299 | 299 | | petition for a protective order whether a protective order is |
---|
300 | 300 | | granted or not granted. The court may assess court costs, service |
---|
301 | 301 | | of process fees, attorney fees, oth er fees and filing fees against |
---|
302 | 302 | | the defendant at the hearing on the petition, if a protective order |
---|
303 | 303 | | is granted against the defendant; provided, the court shall have |
---|
304 | 304 | | authority to waive the costs and fees if the court finds that the |
---|
305 | 305 | | party does not have the a bility to pay the costs and fees. |
---|
306 | 306 | | 2. If the court makes specific findings that a petition for a |
---|
307 | 307 | | protective order has been filed frivolously and no victim exists, |
---|
308 | 308 | | the court may assess attorney fees and court costs against the |
---|
309 | 309 | | plaintiff. |
---|
310 | 310 | | D. The person seeking relief shall prepare the petition or, at |
---|
311 | 311 | | the request of the plaintiff, the court clerk or the victim -witness |
---|
312 | 312 | | coordinator, victim support person, and court case manager shall |
---|
313 | 313 | | prepare or assist the plaintiff in preparing the petition. |
---|
314 | 314 | | E. The person seeking a protective order may further request |
---|
315 | 315 | | the exclusive care, possession, or control of any animal owned, |
---|
316 | 316 | | possessed, leased, kept, or held by either the petitioner, defendant |
---|

373 | 373 | | F. A court may not requ ire the victim to seek legal sanctions |
---|
374 | 374 | | against the defendant including, but not limited to, divorce, |
---|
375 | 375 | | separation, paternity , or criminal proceedings prior to hearing a |
---|
376 | 376 | | petition for protective order. |
---|
377 | 377 | | G. A victim of rape, forcible sodomy, a sex offense, |
---|
378 | 378 | | kidnapping, assault and battery with a deadly weapon, child abuse, |
---|
379 | 379 | | or member of the immediate family of a victim of first -degree |
---|
380 | 380 | | murder, as such terms are defined in Section 40 of this title, may |
---|
381 | 381 | | petition, or have a petition filed on the victim ’s behalf if the |
---|
382 | 382 | | victim is a minor, for an emergency temporary order or emergency ex |
---|
383 | 383 | | parte order regardless of any relationship or scenario pursuant to |
---|
384 | 384 | | the provisions of this section. The Administrative Office of the |
---|
385 | 385 | | Courts shall modify the petition forms as necessary to effectuate |
---|
386 | 386 | | the provisions of this subsection. |

453 | 453 | | 2. Emergency temporary orders, emergency ex parte orders and |

454 | 454 | | notice of hearings shall be given priority for service and can be |
---|
455 | 455 | | served twenty-four (24) hours a day when the location of the |
---|
456 | 456 | | defendant is known. When service cannot be made upon the defendant |
---|
457 | 457 | | by the sheriff, the sheriff may contact another law enforcement |
---|
458 | 458 | | officer or a private investigator or private process server to serve |
---|
459 | 459 | | the defendant. |
---|
460 | 460 | | 3. An emergency temporary order, emergency ex parte order, a |
---|
461 | 461 | | petition for protective order, and a notice of hearing shall have |
---|
462 | 462 | | statewide validity and may be transferred to any law enforcement |
---|

752 | 752 | | participate in court -approved counseling services for victims of |

753 | 753 | | domestic abuse, the court may order the defendant to pay all or any |

754 | 754 | | part of the cost of such treatment or counseling services if the |
---|
755 | 755 | | court determines that payment by the defendant is appropriate. |
---|
756 | 756 | | F. When necessary to protect the victim and when authorized by |
---|
757 | 757 | | the court, protective orders granted pursuant to the provisions of |
---|
758 | 758 | | this section may be served upon the defendant by a peace officer, |
---|
759 | 759 | | sheriff, constable, or policeman or other officer whose duty it is |
---|
760 | 760 | | to preserve the peace, as defined by Section 99 of Title 21 of the |
---|
761 | 761 | | Oklahoma Statutes. |

899 | 899 | | 2. The court shall notify the parties at the time of the |

900 | 900 | | issuance of the protective order of the duration of the protective |

902 | 902 | | 3. Upon the filing of a motion by either party to modify, |

903 | 903 | | extend, or vacate a protecti ve order, a hearing shall be scheduled |

904 | 904 | | and notice given to the parties. At the hearing, the issuing court |

971 | 971 | | period not exceeding one (1) year or by a fine not to exceed Five |

972 | 972 | | Thousand Dollars ($5,000.00), or by both such fine and imprisonment. |

973 | 973 | | 3. A second or subsequent conviction under this subsection |

974 | 974 | | shall be a felony punishable by imprisonment in the custody of the |

1127 | 1127 | | utility provider shall notify the petitioner. Such circumstances |

1197 | 1197 | | 6. The provisions of this subsection shall not preclude a |

1198 | 1198 | | wireless service provider or public utility provider from applying |
---|
1199 | 1199 | | any routine and customary re quirements for account establishment to |
---|
1200 | 1200 | | the petitioner as part of this transfer of billing responsibility |
---|
1201 | 1201 | | for a household utility account or for a wireless telephone number |
---|
1202 | 1202 | | or numbers and any mobile devices attached to that number including, |
---|
1203 | 1203 | | but not limited to, identification, financial information and |
---|
1204 | 1204 | | customer preferences. |

1205 | 1205 | | 7. The provisions of this subsection shall not affect the |

1206 | 1206 | | ability of the court to apportion the assets and debts of the |

1272 | 1272 | | delivery or furnishing of water, heat or light with |

1273 | 1273 | | gas or electric current for heat, light or power, for |

1274 | 1274 | | public use in this state, and |

1275 | 1275 | | c. “household utility account ” shall include utility |
---|
1276 | 1276 | | services for water, heat, light, power or gas that are |
---|
1277 | 1277 | | provided by a public utility provider. |
---|
1278 | 1278 | | K. 1. A court shall not issue any mutual protec tive orders. |
---|
1279 | 1279 | | 2. If both parties allege domestic abuse by the other party, |
---|
1280 | 1280 | | the parties shall do so by separate petitions. The court shall |
---|
1281 | 1281 | | review each petition separately in an i ndividual or a consolidated |
---|
1282 | 1282 | | hearing and grant or deny each petition on its individual merits. |

1283 | 1283 | | If the court finds cause to grant both motions, the court shall do |

1352 | 1352 | | by a victim support person at court proceedings. A victim support |

1353 | 1353 | | person shall not make legal arguments; however , a victim support |

1354 | 1354 | | person who is not a licensed attorney may offer the plaintiff or |
