5448 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5549 SECTION 1. AMENDATORY 63 O.S. 2021, Section 5009.2, is
5650 amended to read as follows:
5751 Section 5009.2. A. The Advisory Committee on Medical Care for
5852 Public Assistance Recipients, created by the Oklahoma Health Care
5953 Authority pursuant to 42 Code of Federal Regulations, Section
6054 431.12, for the purpose of advising the Authority about health and
6155 medical care services, shall include among its membership of no more
6256 than fifteen (15) sixteen (16) the following:
6357 1. Board-certified physicians and other representatives of the
6458 health professions who are familiar with the medical needs of low -

60+required for their care. The Advisory Committee shall, at all

92-required for their care. The Advisory Committee shall, at all
93-times, include at least o ne physician from each of the six classes
9488 of physicians listed in Section 725.2 of Title 59 of the Oklaho ma
9589 Statutes. All such physicians and other representatives of the
9690 health professions shall be pa rticipating providers in the State
9791 Medicaid Plan;
9892 2. Members of consumers ’ groups, including, but not limited to:
9993 a. Medicaid recipients, and
10094 b. representatives from consumer organizations including
10195 a member representing nursing homes, a member
10296 representing individuals with developmental
10397 disabilities and a member representing one or more
10498 behavioral health professions;
10599 3. The Director of the Department of Human Services or
106100 designee;
107101 4. The Commissioner of Mental Health and Substance Abuse
108102 Services or designee;
109103 5. A member approved and appointed by a state organization or
110104 state chapter of a national organization of pediatricians dedicated
111105 to the health, safety and well-being of infants, children,
112106 adolescents and young adults, who shall:
113107 a. monitor provider relations with the Oklahoma Health
114108 Care Authority, and

141-b. create a forum to address grievances; and
142136 6. A member who is a member or citizen of a federally
143137 recognized American Indian tribe or nation whose primary tribal
144138 headquarters is located in this stat e; and
145139 7. A member representing a contracted entity as defined in
146140 Section 4002.2 of Title 56 of the Oklahoma Statutes or a health plan
147141 association representin g more than one such contracted entity .
148142 Beginning on January 1, 2022, appointments made to the Advisory
149143 Committee shall be for a duration not to exceed four (4) consecutive
150144 calendar years.
151145 B. The Advisory Committee shall meet bimonthly to review and
152146 make recommendations related to:
153147 1. Policy development and program administration;
154148 2. Policy changes proposed by the Authority prior to
155149 consideration of such changes by the Authority;
156150 3. Financial concerns related to the Authority and the
157151 administration of the programs under the Authority; and
158152 4. Other pertinent information related to the management and
159153 operation of the Authority and the delivery of health and medical
160154 care services.
161155 C. 1. The Administrator of the Authority shall provide such
162156 staff support and independent technical assistance as needed by the
163157 Advisory Committee to enable the Advisory C ommittee to make
164158 effective recommendations.

191185 2. The Advisory Committee shall elect from among its members a
192186 chair and a vice-chair vice chair who shall serve one-year terms. A
193187 member may serve more than one (1), but not more than four (4),
194188 consecutive one-year terms as chair or vice-chair vice chair. A
195189 majority of the members of the Advisory Committee shall constitute a
196190 quorum to transact business, but no vaca ncy shall impair the right
197191 of the remaining members to exercise all of the powers of the
198192 Advisory Committee.
199193 3. Members shall not receive any compensation for their
200194 services but shall be reimbursed pursuant to the provisions of the
201195 State Travel Reimbursem ent Act, Section 500.1 et seq. of Title 74 of
202196 the Oklahoma Statutes.
203197 D. The Authority shall give due consideration to the comments
204198 and recommendations of the Advisory Committee in the Authority ’s
205199 deliberations on policies, administration, management and o peration
206200 of the Authority.
207201 SECTION 2. This act shall become effective November 1 , 2025.
