54	48		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	49		SECTION 1. AMENDATORY 63 O.S. 2021, Section 5009.2, is
56	50		amended to read as follows:
57	51		Section 5009.2. A. The Advisory Committee on Medical Care for
58	52		Public Assistance Recipients, created by the Oklahoma Health Care
59	53		Authority pursuant to 42 Code of Federal Regulations, Section
60	54		431.12, for the purpose of advising the Authority about health and
61	55		medical care services, shall include among its membership of no more
62	56		than fifteen (15) sixteen (16) the following:
63	57		1. Board-certified physicians and other representatives of the
64	58		health professions who are familiar with the medical needs of low -

	59	+	income population groups and with the resources available and
	60	+	required for their care. The Advisory Committee shall, at all
	61	+	times, include at least one physician from each of the six classes

92		-	required for their care. The Advisory Committee shall, at all
93		-	times, include at least o ne physician from each of the six classes
94	88		of physicians listed in Section 725.2 of Title 59 of the Oklaho ma
95	89		Statutes. All such physicians and other representatives of the
96	90		health professions shall be pa rticipating providers in the State
97	91		Medicaid Plan;
98	92		2. Members of consumers ’ groups, including, but not limited to:
99	93		a. Medicaid recipients, and
100	94		b. representatives from consumer organizations including
101	95		a member representing nursing homes, a member
102	96		representing individuals with developmental
103	97		disabilities and a member representing one or more
104	98		behavioral health professions;
105	99		3. The Director of the Department of Human Services or
106	100		designee;
107	101		4. The Commissioner of Mental Health and Substance Abuse
108	102		Services or designee;
109	103		5. A member approved and appointed by a state organization or
110	104		state chapter of a national organization of pediatricians dedicated
111	105		to the health, safety and well-being of infants, children,
112	106		adolescents and young adults, who shall:
113	107		a. monitor provider relations with the Oklahoma Health
114	108		Care Authority, and

141		-	b. create a forum to address grievances; and
142	136		6. A member who is a member or citizen of a federally
143	137		recognized American Indian tribe or nation whose primary tribal
144	138		headquarters is located in this stat e; and
145	139		7. A member representing a contracted entity as defined in
146	140		Section 4002.2 of Title 56 of the Oklahoma Statutes or a health plan
147	141		association representin g more than one such contracted entity .
148	142		Beginning on January 1, 2022, appointments made to the Advisory
149	143		Committee shall be for a duration not to exceed four (4) consecutive
150	144		calendar years.
151	145		B. The Advisory Committee shall meet bimonthly to review and
152	146		make recommendations related to:
153	147		1. Policy development and program administration;
154	148		2. Policy changes proposed by the Authority prior to
155	149		consideration of such changes by the Authority;
156	150		3. Financial concerns related to the Authority and the
157	151		administration of the programs under the Authority; and
158	152		4. Other pertinent information related to the management and
159	153		operation of the Authority and the delivery of health and medical
160	154		care services.
161	155		C. 1. The Administrator of the Authority shall provide such
162	156		staff support and independent technical assistance as needed by the
163	157		Advisory Committee to enable the Advisory C ommittee to make
164	158		effective recommendations.

191	185		2. The Advisory Committee shall elect from among its members a
192	186		chair and a vice-chair vice chair who shall serve one-year terms. A
193	187		member may serve more than one (1), but not more than four (4),
194	188		consecutive one-year terms as chair or vice-chair vice chair. A
195	189		majority of the members of the Advisory Committee shall constitute a
196	190		quorum to transact business, but no vaca ncy shall impair the right
197	191		of the remaining members to exercise all of the powers of the
198	192		Advisory Committee.
199	193		3. Members shall not receive any compensation for their
200	194		services but shall be reimbursed pursuant to the provisions of the
201	195		State Travel Reimbursem ent Act, Section 500.1 et seq. of Title 74 of
202	196		the Oklahoma Statutes.
203	197		D. The Authority shall give due consideration to the comments
204	198		and recommendations of the Advisory Committee in the Authority ’s
205	199		deliberations on policies, administration, management and o peration
206	200		of the Authority.
207	201		SECTION 2. This act shall become effective November 1 , 2025.
