149149 SECTION 1. NEW LAW A new section of law to be codified
150150 in the Oklahoma Statutes as Section 146.1 of Title 17, unless there
151151 is created a duplication in numbering, reads as follows:
152152 This act shall be known and may be cited as the “Secure
153153 Telecommunications Act of 2025 ”.
154154 SECTION 2. NEW LAW A new section of law to be codified
155155 in the Oklahoma Statutes as Section 146.2 of Title 17, unless there
156156 is created a duplication in numbering, reads as follows:
157157 As used in this act:
158158 1. “Critical telecommunications infrastructure ” shall mean all
159159 physical broadband infrastructure and equipment which supports the
160160 transmission of infor mation of a user’s choosing, regardless of the
161161 transmission medium or technology employed that connects to a
162162 network which permits the end user to engage in communications
163163 including, but not limited to, service provided directly to:
164164 a. the public, or
165165 b. such classes of users as to be effectively available
166166 directly to the public;
167167 2. “Federally banned corporation ” shall mean any company or
168168 designated equipment currently banned or a t any point hereto banned
169169 at the federal level. This shall include , but not be limited to,
170170 bans resulting from the following federal agencies and acts:
171171 a. the Federal Communications Commission including, but
172172 not limited to, any equipment or service deeme d to

225225 Covered List developed pursuant to 47 C.F.R., Section
226226 1.50002, as such act existed July 1, 2024, and
227227 published by the Public Safety and Homeland Security
228228 Bureau of the Federal Communications Commiss ion
229229 pursuant to the federal Secure and Trusted
230230 Communications Networks Act of 2019, 47 U.S.C.,
231231 Section 1601 et seq., as such act existed on July 1,
232232 2024,
233233 b. the U.S. Department of Commerce,
234234 c. the Cybersecurity and Infrastructure Security Agency,
235235 d. the Federal Acquisition Security Council, and
236236 e. Section 889 of the John S. McCain National Defense
237237 Authorization Act for Fiscal Year 2019 [Pub. L. 115 -
238238 232];
239239 3. “Foreign adversary” shall mean any country designated by the
240240 United States Secretary of State as hos tile or a Country of
241241 Particular Concern (CPC); and
242242 4. “Telecommunications pro vider” shall mean any corporation,
243243 public or private, which operates any system which supports the
244244 transmission of information of a user ’s choosing regardless of the
245245 transmission medium or technology employed that connects to a
246246 network which permits the end user to engage in communications
247247 including, but not limited to, service provided directly to:

302302 SECTION 3. NEW LAW A new section of la w to be codified
303303 in the Oklahoma Statutes as Section 146.3 of Title 17, unless there

305305 A. All critical telecommunications infrastructure located
306306 within or serving this state shall not utilize any equipment
307307 manufactured by a federally banned corporation, nor any equipment
308308 banned at the federal level.
309309 B. All critical telecommunications infrastructure located
310310 within or serving this state shall not utilize any equipment
311311 manufactured in or by, including an y equipment whose critical or
312312 necessary components are manufactured in or by a foreign adversary,
313313 a state-owned enterprise of a foreign adversary, or a company
314314 domiciled within a foreign adversary.
315315 C. All critical telecommunications infrastructure in operation
316316 within or serving this state, to include any critical
317317 telecommunications infrastructure which is not permanently disabled,
318318 shall have all equipment prohibited by subsection A or B of this
319319 section removed and replaced with equipment which is not prohi bited
320320 by subsection A or B of this section. Any telecommunications
321321 provider that removes, discontinues, or replaces any prohibited
322322 telecommunications equipment or service shall not be required to

374374 obtain any additional permits from any state agency or political
375375 subdivision for the removal, discontinuance, or replacement of such
376376 communications equipment or service as long as the state agency or
377377 political subdivision is properly not ified of the necessary
378378 replacements and the replacement communications equipme nt is similar
379379 to the existing communications equipment.
380380 SECTION 4. NEW LAW A new section of law to be codified
381381 in the Oklahoma Statutes as Section 146.4 o f Title 17, unless there
382382 is created a duplication in numbering, reads as follows:
383383 A. Any telecommunications provider providing service in this
384384 state shall file a registration form with and pay a registration fee
385385 to the Corporation Commission by September 1, 2025, and then on
386386 January 1 of each year henceforth. Any communications pr ovider
387387 shall register with the Commission prior to providing service. The
388388 Commission shall prescribe the registration form to be filed
389389 pursuant to this section.
390390 B. A telecommunications provider shall provide the Commission
391391 with the name, address, telephone number, and email address of a
392392 person with managerial responsibility for the provider ’s operations
393393 within this state.
394394 C. A telecommunications provider shall:
395395 1. Submit a registration fee at the time the registration form
396396 is submitted. The Commission shall set the fee in an amount

448448 sufficient to cover the costs of administering the registration
449449 process, but such fee shall not exceed Fifty Dollars ($50.00);
450450 2. Keep the informa tion required by this section current and
451451 notify the Commission of any changes to such information within
452452 sixty (60) days after the change; and
453453 3. Certify to the Commission by January 1 each year that all
454454 critical telecommunications equipment and infrastr ucture within its
455455 operation does not use or provide any communications equipme nt or
456456 service prohibited pursuant to Section 3 of this act.
457457 D. The Commission shall administratively fine any
458458 telecommunications provider which violates this section with a fine
459459 no less than Ten Thousand Dollars ($10,000.00) per day and no
460460 greater than One Hundred Thousand Dollars ($100,000.00) per day of
461461 noncompliance.
462462 E. The Commission shall administratively fine any
463463 telecommunications provider which knowingly submits a false
464464 registration form described in this section with a fine no less than
465465 Ten Thousand Dollars ($10,000.00) per day and no greater than One
466466 Hundred Thousand Dollars ($100,000.00) per day of noncompliance.
467467 F. Any telecommunications provider that fails to comply with
468468 this section is prohibited from receiving any state or local funds
469469 for the development or support of new or existing critical
470470 telecommunications infrastructure, including the Oklahoma Universal
471471 Service Fund, and is prohibited from receiving any feder al funds

524524 development or support of new or existing critical
525525 telecommunications infrastructure.
526526 SECTION 5. This act shall become effective July 1, 2025.
527527 SECTION 6. It being immediately necessary for the preservation
528528 of the public peace, health or safety, an emergency is hereby
529529 declared to exist, by reason whereof this act shall take effect and
530530 be in full force from and after its passage and approval.
