149	149	SECTION 1. NEW LAW A new section of law to be codified
150	150	in the Oklahoma Statutes as Section 146.1 of Title 17, unless there
151	151	is created a duplication in numbering, reads as follows:
152	152	This act shall be known and may be cited as the “Secure
153	153	Telecommunications Act of 2025 ”.
154	154	SECTION 2. NEW LAW A new section of law to be codified
155	155	in the Oklahoma Statutes as Section 146.2 of Title 17, unless there
156	156	is created a duplication in numbering, reads as follows:
157	157	As used in this act:
158	158	1. “Critical telecommunications infrastructure ” shall mean all
159	159	physical broadband infrastructure and equipment which supports the
160	160	transmission of infor mation of a user’s choosing, regardless of the
161	161	transmission medium or technology employed that connects to a
162	162	network which permits the end user to engage in communications
163	163	including, but not limited to, service provided directly to:
164	164	a. the public, or
165	165	b. such classes of users as to be effectively available
166	166	directly to the public;
167	167	2. “Federally banned corporation ” shall mean any company or
168	168	designated equipment currently banned or a t any point hereto banned
169	169	at the federal level. This shall include , but not be limited to,
170	170	bans resulting from the following federal agencies and acts:
171	171	a. the Federal Communications Commission including, but
172	172	not limited to, any equipment or service deeme d to

226	226	1.50002, as such act existed July 1, 2024, and
227	227	published by the Public Safety and Homeland Security
228	228	Bureau of the Federal Communications Commiss ion
229	229	pursuant to the federal Secure and Trusted
230	230	Communications Networks Act of 2019, 47 U.S.C.,
231	231	Section 1601 et seq., as such act existed on July 1,
232	232	2024,
233	233	b. the U.S. Department of Commerce,
234	234	c. the Cybersecurity and Infrastructure Security Agency,
235	235	d. the Federal Acquisition Security Council, and
236	236	e. Section 889 of the John S. McCain National Defense
237	237	Authorization Act for Fiscal Year 2019 [Pub. L. 115 -
238	238	232];
239	239	3. “Foreign adversary” shall mean any country designated by the
240	240	United States Secretary of State as hos tile or a Country of
241	241	Particular Concern (CPC); and
242	242	4. “Telecommunications pro vider” shall mean any corporation,
243	243	public or private, which operates any system which supports the
244	244	transmission of information of a user ’s choosing regardless of the
245	245	transmission medium or technology employed that connects to a
246	246	network which permits the end user to engage in communications
247	247	including, but not limited to, service provided directly to:

305	305	A. All critical telecommunications infrastructure located
306	306	within or serving this state shall not utilize any equipment
307	307	manufactured by a federally banned corporation, nor any equipment
308	308	banned at the federal level.
309	309	B. All critical telecommunications infrastructure located
310	310	within or serving this state shall not utilize any equipment
311	311	manufactured in or by, including an y equipment whose critical or
312	312	necessary components are manufactured in or by a foreign adversary,
313	313	a state-owned enterprise of a foreign adversary, or a company
314	314	domiciled within a foreign adversary.
315	315	C. All critical telecommunications infrastructure in operation
316	316	within or serving this state, to include any critical
317	317	telecommunications infrastructure which is not permanently disabled,
318	318	shall have all equipment prohibited by subsection A or B of this
319	319	section removed and replaced with equipment which is not prohi bited
320	320	by subsection A or B of this section. Any telecommunications
321	321	provider that removes, discontinues, or replaces any prohibited
322	322	telecommunications equipment or service shall not be required to

375	375	subdivision for the removal, discontinuance, or replacement of such
376	376	communications equipment or service as long as the state agency or
377	377	political subdivision is properly not ified of the necessary
378	378	replacements and the replacement communications equipme nt is similar
379	379	to the existing communications equipment.
380	380	SECTION 4. NEW LAW A new section of law to be codified
381	381	in the Oklahoma Statutes as Section 146.4 o f Title 17, unless there
382	382	is created a duplication in numbering, reads as follows:
383	383	A. Any telecommunications provider providing service in this
384	384	state shall file a registration form with and pay a registration fee
385	385	to the Corporation Commission by September 1, 2025, and then on
386	386	January 1 of each year henceforth. Any communications pr ovider
387	387	shall register with the Commission prior to providing service. The
388	388	Commission shall prescribe the registration form to be filed
389	389	pursuant to this section.
390	390	B. A telecommunications provider shall provide the Commission
391	391	with the name, address, telephone number, and email address of a
392	392	person with managerial responsibility for the provider ’s operations
393	393	within this state.
394	394	C. A telecommunications provider shall:
395	395	1. Submit a registration fee at the time the registration form
396	396	is submitted. The Commission shall set the fee in an amount

448	448	sufficient to cover the costs of administering the registration
449	449	process, but such fee shall not exceed Fifty Dollars ($50.00);
450	450	2. Keep the informa tion required by this section current and
451	451	notify the Commission of any changes to such information within
452	452	sixty (60) days after the change; and
453	453	3. Certify to the Commission by January 1 each year that all
454	454	critical telecommunications equipment and infrastr ucture within its
455	455	operation does not use or provide any communications equipme nt or
456	456	service prohibited pursuant to Section 3 of this act.
457	457	D. The Commission shall administratively fine any
458	458	telecommunications provider which violates this section with a fine
459	459	no less than Ten Thousand Dollars ($10,000.00) per day and no
460	460	greater than One Hundred Thousand Dollars ($100,000.00) per day of
461	461	noncompliance.
462	462	E. The Commission shall administratively fine any
463	463	telecommunications provider which knowingly submits a false
464	464	registration form described in this section with a fine no less than
465	465	Ten Thousand Dollars ($10,000.00) per day and no greater than One
466	466	Hundred Thousand Dollars ($100,000.00) per day of noncompliance.
467	467	F. Any telecommunications provider that fails to comply with
468	468	this section is prohibited from receiving any state or local funds
469	469	for the development or support of new or existing critical
470	470	telecommunications infrastructure, including the Oklahoma Universal
471	471	Service Fund, and is prohibited from receiving any feder al funds

526	526	SECTION 5. This act shall become effective July 1, 2025.
527	527	SECTION 6. It being immediately necessary for the preservation
528	528	of the public peace, health or safety, an emergency is hereby
529	529	declared to exist, by reason whereof this act shall take effect and
530	530	be in full force from and after its passage and approval.
