181181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAH OMA:
182182 SECTION 1. NEW LAW A new section of law not to be
183183 codified in the Oklahoma Statutes reads as follows:
184184 This act shall be known and may be cited as the “Military
185185 Installation and Critical Infrastructure Protection Act of 2025”.
186186 SECTION 2. NEW LAW A new section of law to be codified
187187 in the Oklahoma Statutes as Section 128.1 of Title 60, unless there
188188 is created a duplication in numb ering, reads as follows:

241241 1. “Agricultural land” shall mean a land area that is either
242242 arable, under permanent crops, or under permanent pastures. Arable
243243 land includes land under temporary crops such as cereals, temporary
244244 meadows for mowing or pasture, land under market or kitchen gardens,
245245 and land temporarily fallow. Land abandoned as a result of shifting
246246 cultivation is excluded. Land under permanent crops is cultivated
247247 with crops that occupy the land for long periods and need not b e
248248 replanted after each harvest, such as orchards or vineyards. This
249249 category excludes land under trees grown for wood or timber.
250250 Permanent pasture land is land used for five (5) or more years for
251251 forage, including natural and cultivated crops;
252252 2. “Company” shall mean a for-profit sole proprietorship,
253253 organization, association, corporation, partnership, joint venture,
254254 limited partnership, limited liability partnership, or limited
255255 liability company, including a wholly owned subsidiary, majority -
256256 owned subsidiary, parent company, or affiliate of those entities or
257257 business associations , that exists to make a profit; or a nonprofit
258258 organization;
259259 3. “Critical infrastructure ” shall mean systems and assets,
260260 whether physical or virtual, so vital to Oklahoma or the United
261261 States that the incapacity or destruction of such systems and assets
262262 would have a debilitating impact on state or national security,
263263 state or national economic security, state or national public
264264 health, or any combination of those matters. A criti cal

316316 infrastructure may be publicly or privately owned and includes, but
317317 is not limited to:
318318 a. gas and oil production, storage, or delivery systems,
319319 b. water supply, refinement, storage, or delivery
320320 systems,
321321 c. telecommunications networks,
322322 d. electrical power delivery systems,
323323 e. emergency services,
324324 f. transportation systems and services, or
325325 g. personal data or otherwise classified information
326326 storage systems, including cybersecurity;
327327 4. “Cybersecurity” shall mean the measures taken to protect a
328328 computer, computer network, computer system, or other technology
329329 infrastructure against u nauthorized use or access;
330330 5. “Domicile” shall mean either the country in which a company
331331 is registered, where the affairs of the company are primarily
332332 completed, or where the m ajority of ownership share is held;
333333 6. “Foreign adversary” shall mean any country designated by the
334334 United States Secretary of State as hostile or a Country of
335335 Particular Concern (CPC);
336336 7. “Foreign principal” shall mean:
337337 a. the government or any official of the government of a

390390 b. a political party or member of a political party or
391391 any subdivision of a political party of a foreign
392392 adversary,
393393 c. a partnership, association, corporation, organization,
394394 or other combination of persons organiz ed under the
395395 laws of or having its principal place of business in a
396396 foreign adversary, or a subsidiary of such entity, or
397397 owned or controlled wholly or in part by any person,
398398 entity, or collection of persons or entities of a
399399 foreign adversary,
400400 d. any person who is domiciled in a foreign adversary and
401401 is not a citizen or lawful perma nent resident of the
402402 United States, or
403403 e. any person, entity, or collection of persons or
404404 entities, described in subparagraphs a through d of
405405 this paragraph having a controlling interest in a
406406 partnership, association, corporation, organization,
407407 trust, or any other legal entity or subsidiary formed
408408 for the purpose of owning real property;
409409 8. “Military base or installation ” shall mean any land,
410410 structure, or property owned or contr olled by any division of the
411411 United States Department of Defense, Oklahoma Nat ional Guard, or any
412412 other department of government, state or federal, critical to the
413413 safety and security of Oklahoma or the United States;

465465 9. “Non-notified transactions ” shall mean foreign investments
466466 in the United States that are not voluntarily submitted to the
467467 Committee on Foreign Investment in the United States for review
468468 under 50 U.S.C., Section 4565;
469469 10. “Operational software ” shall mean computer programs used
470470 for the operation, control, maneuver or maintenance of state
471471 infrastructure, or any other computer program applications related
472472 to state infrastructure;
473473 11. “Software” shall mean any program or routine, or any set of
474474 one or more programs or routines, which are used or intended for use
475475 to cause one or more computers or pieces of computer related
476476 peripheral equipment, or any combination thereof, to perform a task
477477 or set of tasks, as it relates to state infrastructure;
478478 12. “State infrastructure ” shall mean critical inf rastructure
479479 and transportation infrastructure; and
480480 13. “Transportation infras tructure” shall include, but not be
481481 limited to:
482482 a. airports including, but not limited to, commercial and
483483 intermodal airports and heliports and all airport
484484 infrastructure,
485485 b. roadways including, but not limited to, publicly
486486 accessible streets, roads, highways, and bridges and
487487 all roadway infrastructure including, but not limited
488488

541541 c. railways including, but not limited t o, all classes of
542542 freight rail and passenger rail and all railway
543543 infrastructure including, but not limited to,
544544 intermodal rail yards and signals,
545545 d. ports including, but not limited to, inland ports,
546546 seaports, deepwater ports, inland waterways, and
547547 levees and all port infrastructure including, but not
548548 limited to, intermodal stations, and
549549 e. public transit including bus, ferry, cable car, tram,
550550 trolley, and other types of publicly accessible
551551 transportation and all public transit infrastructure.
552552 SECTION 3. NEW LAW A new section of law to be codified
553553 in the Oklahoma Statutes as Section 128.2 of Title 60, unless there
554554 is created a duplication in numbering, reads as follows:
555555 A. A foreign principal from a foreign adversary country may not
556556 directly or indirectly own, have an interest of greater than twenty -
557557 five percent (25%) in, or acquire by purchase, grant, devise, or
558558 descent agricultural land or any interest, except a de minimis
559559 indirect interest, in such land in this state. A foreign p rincipal
560560 has a de minimis indirect interest if any ownership is the result of
561561 the foreign principal ’s ownership of registered equities in a

613613 publicly traded company owning the land and if the ownership of the
614614 foreign principal in the country is either:
615615 1. Less than five percent (5%) of any class of registered
616616 equities or less than five percent (5%) in the aggregate in multiple
617617 classes of registered equities; or
618618 2. A noncontrolling interest in an entity controlled by a
619619 company that is both registered with t he United States Securities
620620 and Exchange Commission as an investment advisor u nder the
621621 Investment Advisers Act of 1940, as amended, and is not a foreign
622622 entity.
623623 B. A foreign principal that directly or indirectly owns or
624624 otherwise controls agricultural lan d, as defined in Section 1 of
625625 this act, in this state must sell, transfer, or otherwise divest
626626 itself of the agricultural land within one hundred eighty (180) days
627627 of the effective date of this act.
628628 C. A foreign principal that directly or indirectly owns or
629629 acquires agricultural land or any interest in such land in this
630630 state shall register with the Oklahoma Department of Agriculture ,
631631 Food, and Forestry within sixty (60) days of the effective date of
632632 this act or the date of acquisition, whichever is latest . The
633633 Department shall establish a form for such registration which, at
634634 minimum, shall include all of the following:
635635 1. The name of the owner of the agricultural land or the owner
636636 of the interest in such land;

688688 2. The address of the agricultural land, th e parcel
689689 identification number of the property appraiser, and the legal
690690 description of the property; and
691691 3. The number of acres of the agricultural land.
692692 D. Notwithstanding the provisions of subsection A of this
693693 section, a foreign principal from a foreig n adversary country may
694694 acquire agricultural land on or after the effective date of this act
695695 by devise or descent, through the enforcement of security interests,
696696 or through the collection of debts, provided that the foreign
697697 principal sells, transfers, or o therwise divests itself of the
698698 agricultural land within one hundred eighty (18 0) days of acquiring
699699 the agricultural land.
700700 E. Any current deeds, contracts, rental agreements, or other
701701 legal agreements in conflict with the provisions of this act shall
702702 be deemed invalid from the date of adoption unless otherwise
703703 provided.
704704 F. The responsibility for determining whether an entity is
705705 subject to the provisions of this section rests solely with the
706706 foreign entity, the Attorney General, any qualifying whistleblower ,
707707 and no other individual or entity. An individual or entity who is
708708 not a foreign entity shall not be required to determine or inquire
709709 whether another person or entity is or may be subject to this
710710 section, and shall bear no civil or criminal liability und er the
711711 provisions of this section.

763763 G. If a foreign principal from a foreign adversary country does
764764 not divest the real property as required by this section, the
765765 Attorney General shall commence an action in district court within
766766 the jurisdiction of the real property.
767767 H. If the real property is held in violation of the provisions
768768 of this section, the district court shall order that the real
769769 property be sold through judicial foreclosure.
770770 I. If a whistleblower referral results in a divestiture of land
771771 or other assets held in violation of the provisions of this section,
772772 the whistleblower shall be entitled to a reward equal to thirty
773773 percent (30%) of the proceeds of the land sale that results from the
774774 violation of this section after payments to lienholders. Pr oceeds
775775 of the sale shall be disbursed in the following order, as
776776 applicable:
777777 1. The payment of authorized costs of the sale, including all
778778 approved fees and expenses of the referee and any taxes and
779779 assessments due;
780780 2. The payment, in an amount approved by the court, to the
781781 Office of the Attorney General for reimbursement of investigation
782782 and litigation costs and expenses;
783783 3. To bona fide lienholders, in their order of priority, except
784784 for liens which under the terms of the sale are to remain on the
785785 property;
786786 4. To whistleblowers; and

838838 5. To the restricted foreign entity.
839839 J. The Oklahoma Department of Agriculture , Food, and Forestry
840840 shall adopt rules to implement the provisions of this section.
841841 SECTION 4. NEW LAW A new section of law to be codified
842842 in the Oklahoma Statutes as Section 128.3 of Title 60, unless there
843843 is created a duplication in numbering, reads as follows:
844844 A. A foreign principal from a foreign adversary country shall
845845 not be allowed to directly or indirectly purchas e, hold, rent, or
846846 otherwise control any real property within ten (10) miles of a
847847 military base or installation.
848848 B. A foreign principal that directly or indirectly controls any
849849 real property covered by the provisions of subsection A of this
850850 section, excluding temporary contractual agreements such as rental
851851 or lease agreements, must sell, transfer, or otherwise divest itself
852852 of the property within one hundred eighty (180) days of the
853853 effective date of this act.
854854 C. Any current deeds, contracts, rental agreem ents, or other
855855 legal agreements in conflict with this law shall be deemed inva lid
856856 from the date of adoption unless otherwise provided.
857857 D. If a foreign principal from a foreign adversary country does
858858 not divest the real property as required by the provisio ns of this
859859 section, the Attorney General shall commence an action in the
860860 district court within the jurisdiction of the real property.

912912 E. If the real property is held in violation of the provisions

988988 entity shall not be required to determine or inquir e whether another
989989 person or entity is or may be subject to the provisions of this
990990 section, and shall bear no civil or criminal liability under the
991991 provisions of this section.
992992 SECTION 5. NEW LAW A new section of law to be codified
993993 in the Oklahoma Statutes as Section 128.4 of Title 60, unless there
994994 is created a duplication in numbering, reads as follows:
995995 A. Any individual may act as a whistleblower and provide a
996996 referral to the Office of the Attorney General for violations of the
997997 provisions of Section 3 and Section 4 of this act.
998998 B. If a whistleblower referral results in a divestiture of land
999999 or other assets held in violation of the provisions of this act, the
10001000 whistleblower shall be entitled to a reward equal to thirty percent
10011001 (30%) of the proceeds of the land sale that results from violation
10021002 of this act.
10031003 C. The whistleblower enforcement provision shall take effect
10041004 one hundred eighty (180) days after the effective date of this act.
10051005 SECTION 6. NEW LAW A new sect ion of law to be codified
10061006 in the Oklahoma Statutes as Section 13001 of Title 74, unless there
10071007 is created a duplication in numbering, reads as follows:
10081008 A. An entity constructing, repairing, operating, or otherwise
10091009 having significant access to critical infr astructure may not enter

10651065 B. A governmental entity may not enter into a contract or other
10661066 agreement relating to critical infrastructure in this state with a
10671067 company that is a foreign principal from a foreign adversary
10681068 country, or use products or services produced by a foreign principal
10691069 from a foreign adversary country.
10701070 C. Notwithstanding the provisions of subsection A and B of this
10711071 section, an entity or governmental entity may enter into a contract
10721072 or agreement relating to critical infrastructure with a foreign
10731073 principal from a foreign adve rsary country or use products or
10741074 services produced by a foreign principal from a foreign adversary
10751075 country if:
10761076 1. There is no other reasonable option for addressing the need
10771077 relevant to state critical infrastructure;
10781078 2. The contract is pre approved by the Office of the Attorney
10791079 General; and
10801080 3. Not entering into such a contract or agreement would pose a
10811081 greater threat to the state than the threat associated with entering
10821082 into the contract.
10831083 SECTION 7. NEW LAW A new section of law to be codified

11371137 A. In order to access critical infrastructure, a company must
11381138 file a certification form with and pay a certification f ee to the
11391139 Office of the Attorney General. The Office of the Attorney General
11401140 shall prescribe the registration form to be filed pursuant to the
11411141 provisions of this section.
11421142 B. To maintain registration as a company with access to
11431143 critical infrastructure, a company shall:
11441144 1. Identify all employee positions in the organization that
11451145 have access to critical infrastructure;
11461146 2. Before hiring a person described in paragraph 1 of this
11471147 subsection, obtain from the Oklahoma State Bureau of Investigation
11481148 or a private vendor criminal history record information relating to
11491149 the prospective employe e and any other background information
11501150 considered necessary by the company or required by the Office of the
11511151 Attorney General to protect critical infrastructure from foreign
11521152 adversary infiltration or interference;
11531153 3. Prohibit foreign nationals from a foreign adversary from
11541154 access to critical infrastructure; and
11551155 4. Be compliant with the provisions of Section 6 of this act.
11561156 C. The Office of the Attorney General shall set the fee i n an
11571157 amount sufficient to cover the costs of administering the
11581158 certification process but not to exceed One Hundred Fifty Dollars
11591159 ($150.00).

12121212 company is compliant with all requirements of this secti on or revoke
12131213 certification.
12141214 SECTION 8. NEW LAW A new section of law to be codified
12151215 in the Oklahoma Statutes as Section 13003 of Title 74, unless there
12161216 is created a duplication in numbering, reads as follows:
12171217 A. All software used in state infrastructure located within or
12181218 serving Oklahoma shall not include any software produced by a
12191219 federally banned corporation, nor any software banned at the federal
12201220 level.
12211221 B. All software used in state infrastructure located within or
12221222 serving Oklahoma shall not include any software produced in or by a
12231223 foreign adversary, a state -owned enterprise of a foreign adversary,
12241224 or a company domiciled within a foreign adversary.
12251225 C. All software used in state infrastructure in operation
12261226 within or serving Oklaho ma, to include any state infrastructure
12271227 which is not permanently disabled, sha ll have all software
12281228 prohibited by subsection A or B of this section removed and replaced
12291229 with software which is not prohibited by subsection A or B of this
12301230 section.
12311231 D. Any state infrastructure provider that removes,
12321232 discontinues, or replaces any prohibited software shall not be
12331233 required to obtain any additional permits from any state agency or
12341234 political subdivision for the removal, discontinuance, or

12901290 SECTION 9. NEW LAW A new section of law to be codified
12911291 in the Oklahoma Statutes as Section 13004 of Title 74, unless there
12921292 is created a duplication in numbering, reads as follows:
12931293 A. The Office of the Attorney General shall establish a process
12941294 by which local officials, states officials, or other persons may
12951295 submit information or concerns to the Office regarding non -notified
12961296 transactions in Oklahoma. The Office of the Attorney General may
12971297 adopt any necessary rules to implement the provisions of this
12981298 subsection.
12991299 B. The Office of the Attorney General may submit a mem orandum
13001300 or report concerning non -notified transactions the Attorney General
13011301 has identified in Oklahoma to the Committee on Foreign Investment in
13021302 the United States.
13031303 C. The Office of the Attorney General shall:
13041304 1. Retain a copy of any documents submitted t o the Committee on
13051305 Foreign Investment in the United States that are included w ith a
13061306 memorandum or report submitted under the provisions of subsection B
13071307 of this section; and
13081308 2. Notify the Legislature and the Governor as soon as
13091309 practicable after submitting a memorandum, report, or other
