77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 24.1A of Title 51, unless there
80	80	is created a duplication in numbering, rea ds as follows:
81	81	A. Any state or education employee who is charged with a felony
82	82	by a court of competent jurisdiction shall forfeit all benefits of
83	83	the office or employment, including, but not limited to, retirement
84	84	benefits provided by law. Upon a felony charge, the employee shall
85	85	forfeit the right to access, withdraw from, or liqu idate the
86	86	retirement benefits of the member.
87	87	B. 1. The state prosecutor responsible for the employee ’s
88	88	charge or charges shall notify the employer and the retirement

140	140	system of which the employee is a member within three (3) days of
141	141	the filed charge. Upon notification, the system shall immediately
142	142	implement the requirements of this section.
143	143	2. Upon receipt of the notice required by this subsection, the
144	144	retirement system shall i mmediately suspend all benefits of the
145	145	employee and notify the employee of his or her right to a hearing to
146	146	review whether the charge qualifies for forfeiture of benefits under
147	147	this section. If the charge occurs in federal court or the notice
148	148	of forfeiture is not forthcoming from the state prosecutor, the
149	149	retirement system may investigate and gather court documents and
150	150	contact prosecutors to determine whether the charge qualifies under
151	151	this section. Upon obtaining sufficient documentation of the
152	152	charge, the retirement system shall immediately suspend all benefits
153	153	of the employee and notify the employee of his or her right to a
154	154	hearing to review whether the charge qualifies for forfeiture of
155	155	benefits under this section.
156	156	C. Any claims for payment to a membe r upon being charged with a
157	157	felony shall be rejected by the system pursuant to this section.
158	158	D. Nothing in this section shall be construed to limit access
159	159	to retirement benefits by a member who is found not guilty in a
160	160	court of competent jurisdiction. If the member is found not guilty,
161	161	retirement benefits shall be reinstated, and the member shall regain
162	162	access to such benefits. No credit shall be accrued for the time
163	163	that benefits are forfeited.
