57 | 50 | | BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA: |

58 | 51 | | SECTION 1. AMENDATORY 47 O.S. 2021, Section 6 -212.5, as |
---|
59 | 52 | | last amended by Section 4, Chapter 265, O.S.L. 2024 (47 O.S. Supp. |

60 | 53 | | 2024, Section 6-212.5), is amended to read as follows: |

61 | 54 | | Section 6-212.5. A. The Impaired Driver Accountability Program |
---|
62 | 55 | | (IDAP) established by the Department of Public Safety is hereby |
---|
63 | 56 | | transferred to the Board of Tests for Alcohol and Drug Influence for |
---|
64 | 57 | | impaired driving arrests occurring on or after Nove mber 1, 2022. |
---|
65 | 58 | | The Board of Tests for Alco hol and Drug Influence shall charge an |
---|
66 | 59 | | administrative fee of One Hundred Fifty Dollars ($150.00) to each |
---|
97 | 89 | | administrative fee shall be deposited in the Department of Public |
---|
98 | 90 | | Safety Restricted Revolving Fund. Twenty -five Dollars ($25.00) of |

99 | 91 | | each administrative fee shall be deposit ed in the Board of Tests for |

100 | 92 | | Alcohol and Drug Influence Revolving Fund. The Board of Tests for |

101 | 93 | | Alcohol and Drug Influence shall promulgate rules necessary to |

103 | 95 | | 1. Installation of an approved ignition interlock device for |

104 | 96 | | the periods set forth in Section 6 -205.1 of this title; |

105 | 97 | | 2. A description of ignition interlock violations; |
---|
106 | 98 | | 3. A description of criteria to determine acceptable |

107 | 99 | | participation in the program; |
---|
108 | 100 | | 4. Required violation free pe riods of no less than ninety (90) |
---|
109 | 101 | | days at the end of each program to demonstrate compliance by the |
---|
110 | 102 | | participant; |
---|
111 | 103 | | 5. Criteria for medical exemptions from ignition interlock |
---|
112 | 104 | | requirements for persons submitting a pulmonologist ’s certification |
---|
113 | 105 | | indicating the person has a documented medical condition p reventing |
---|
114 | 106 | | the person from providing a breath sample of at least one and two - |
---|
115 | 107 | | tenths (1.2) liters. Medical exemptions shall not be construed to |
---|
116 | 108 | | grant the person driving privileges during the revocation; |
---|
148 | 139 | | Accountability Program. Employer exceptions under this parag raph |
---|
149 | 140 | | are only authorized for revocations imposed in accordance with |
---|
150 | 141 | | paragraph 1 of subsection A of Section 6 -205.1 of this title; and |

151 | 142 | | 7. Criteria for granting affordability accommodations to |
---|
152 | 143 | | persons on public assi stance programs or whose family income is at |
---|
153 | 144 | | or below one hundred fifty percent (150%) of the federal poverty |
---|
154 | 145 | | level. |

155 | 146 | | B. Upon successful completion of the program, in accordance |
---|
156 | 147 | | with the rules of the Board of Tests for Alcohol and Drug Influence, |
---|
157 | 148 | | the person will be provided a completion certificat e. Upon |
---|
158 | 149 | | presentation of the IDAP completion certificate and documentation |
---|
159 | 150 | | required by Section 6 -212.2 of this title and payment of the |
---|
160 | 151 | | required statutory fees, Service Oklahoma will reinstate the driving |
---|
161 | 152 | | privileges of the person, if otherwise eligible. |
---|
162 | 153 | | C. The Board is authorized to promulgate rules necessary to |
---|
163 | 154 | | regulate ignition interlock devices and the providers of such |
---|
164 | 155 | | devices, which shall be subject to suspension or revocation in |
---|
165 | 156 | | accordance with the rules promulgated by the Board. The Board is |
---|
166 | 157 | | authorized to charge appropriate fees for operations incidental to |
---|
167 | 158 | | its required duties and responsibilities. No interlock provider |
---|
198 | 188 | | D. The Board is authorized to prescribe uniform standards and |
---|
199 | 189 | | conditions for, and to approve satisfactory methods, procedures, |
---|
200 | 190 | | techniques, devices, equipment, and records for , ignition interlock |
---|
201 | 191 | | device performance and data. |
---|
202 | 192 | | E. The Board is authorized to prescribe and approve the |
---|
203 | 193 | | requisite education and training for the performance of ignition |
---|
204 | 194 | | interlock services. The Board shall establish standard s and |
---|
205 | 195 | | ascertain the qualifications and com petence of individuals who |
---|
206 | 196 | | provide ignition interlock services and to issue permits to such |
---|
207 | 197 | | individuals and service centers which shall be subject to suspension |
---|
208 | 198 | | or revocation in accordance with the rules promulgated by the Board. |
---|
209 | 199 | | F. The driving record of a person subject to revocation under |
---|
210 | 200 | | the provisions of Section 753 or 754 of this title contained in |
---|
211 | 201 | | paragraph 1 of subsection A of Section 6 -205.1 of this title, |
---|
212 | 202 | | excluding those subject to revocation under the pro visions of |
---|
213 | 203 | | paragraph 2 of subsection A of Section 6-205 of this title, who |
---|
214 | 204 | | enrolls in IDAP in accordance with this paragraph shall be updated |
---|
215 | 205 | | to indicate completion of IDAP without revocation, provided the |
---|
216 | 206 | | following requirements are satisfied: |
---|

250 | 239 | | calendar days from the date of the arrest receipt of the revocation |

251 | 240 | | notice from Service Oklahoma ; |

252 | 241 | | 3. The person is otherwise eligible for driving privileges in |

253 | 242 | | Oklahoma on the date he or she enrolls in IDAP; |
---|
254 | 243 | | 4. The person provides proof of enrollment in IDAP to Service |
---|
255 | 244 | | Oklahoma and obtains a restricted driver license pursuant to Section |
---|
256 | 245 | | 6-212.3 of this title prior to the revocation taking effect; |
---|
257 | 246 | | 5. The person provide s proof of completion of IDAP to Service |
---|
258 | 247 | | Oklahoma; |
---|
259 | 248 | | 6. The person has complied with the reinstatement requirements |
---|
260 | 249 | | set forth in Section 6 -212 of this title, including the payment of |
---|
261 | 250 | | any necessary fees; |
---|
262 | 251 | | 7. The person provides proof of completion of the alcohol and |
---|
263 | 252 | | drug assessment and evaluation re quired by Section 6-212.2 of this |
---|

265 | 254 | | 8. The person enrolling in IDAP in accordance to with the |

266 | 255 | | provisions of this subsection shall waive the right to file an |
---|
294 | | - | appeal pursuant to Section 6 -211 of this title regarding the arrest |

296 | | - | SECTION 2. It being immediately necessary for the preservation |
