5750 BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
5851 SECTION 1. AMENDATORY 47 O.S. 2021, Section 6 -212.5, as
5952 last amended by Section 4, Chapter 265, O.S.L. 2024 (47 O.S. Supp.
6053 2024, Section 6-212.5), is amended to read as follows:
6154 Section 6-212.5. A. The Impaired Driver Accountability Program
6255 (IDAP) established by the Department of Public Safety is hereby
6356 transferred to the Board of Tests for Alcohol and Drug Influence for
6457 impaired driving arrests occurring on or after Nove mber 1, 2022.
6558 The Board of Tests for Alco hol and Drug Influence shall charge an
6659 administrative fee of One Hundred Fifty Dollars ($150.00) to each
60+person entered into IDAP. One Hundred Dollars ($100.00) of each
61+administrative fee shall be deposited in the General Revenue Fund of
62+the State Treasury. Twenty-five Dollars ($25.00) of each

94-person entered into IDAP. One Hundred Dollars ($100.00) of each
95-administrative fee shall be deposited in the General Revenue Fund of
96-the State Treasury. Twenty -five Dollars ($25.00) of each
9789 administrative fee shall be deposited in the Department of Public
9890 Safety Restricted Revolving Fund. Twenty -five Dollars ($25.00) of
9991 each administrative fee shall be deposit ed in the Board of Tests for
10092 Alcohol and Drug Influence Revolving Fund. The Board of Tests for
10193 Alcohol and Drug Influence shall promulgate rules necessary to
10294 administer the program. The IDAP rules shall require, at a minimum:
10395 1. Installation of an approved ignition interlock device for
10496 the periods set forth in Section 6 -205.1 of this title;
10597 2. A description of ignition interlock violations;
10698 3. A description of criteria to determine acceptable
10799 participation in the program;
108100 4. Required violation free pe riods of no less than ninety (90)
109101 days at the end of each program to demonstrate compliance by the
110102 participant;
111103 5. Criteria for medical exemptions from ignition interlock
112104 requirements for persons submitting a pulmonologist ’s certification
113105 indicating the person has a documented medical condition p reventing
114106 the person from providing a breath sample of at least one and two -
115107 tenths (1.2) liters. Medical exemptions shall not be construed to
116108 grant the person driving privileges during the revocation;
109+6. Criteria for granting employer exceptions to ignit ion
110+interlock requirements in vehicles owned or leased by the employer.
111+Employer exceptions under this paragraph shall not be construed to
112+relieve the person from completing the Impaired Driver

144-6. Criteria for granting employer exceptions to ignit ion
145-interlock requirements in vehicles owned or leased by the employer.
146-Employer exceptions under this paragraph shall not be construed to
147-relieve the person from completing the Impaired Driver
148139 Accountability Program. Employer exceptions under this parag raph
149140 are only authorized for revocations imposed in accordance with
150141 paragraph 1 of subsection A of Section 6 -205.1 of this title; and
151142 7. Criteria for granting affordability accommodations to
152143 persons on public assi stance programs or whose family income is at
153144 or below one hundred fifty percent (150%) of the federal poverty
154145 level.
155146 B. Upon successful completion of the program, in accordance
156147 with the rules of the Board of Tests for Alcohol and Drug Influence,
157148 the person will be provided a completion certificat e. Upon
158149 presentation of the IDAP completion certificate and documentation
159150 required by Section 6 -212.2 of this title and payment of the
160151 required statutory fees, Service Oklahoma will reinstate the driving
161152 privileges of the person, if otherwise eligible.
162153 C. The Board is authorized to promulgate rules necessary to
163154 regulate ignition interlock devices and the providers of such
164155 devices, which shall be subject to suspension or revocation in
165156 accordance with the rules promulgated by the Board. The Board is
166157 authorized to charge appropriate fees for operations incidental to
167158 its required duties and responsibilities. No interlock provider
159+utilizing a lease, clause, or contractual agreement that authorizes
160+the provider to impo und, physically immobilize, or seize a veh icle
161+for outstanding debts or arrears may be licensed by the Board.

195-utilizing a lease, clause , or contractual agreement that authorizes
196-the provider to impound, physically immobilize, or seize a veh icle
197-for outstanding debts or arrears may be licensed by the Board.
198188 D. The Board is authorized to prescribe uniform standards and
199189 conditions for, and to approve satisfactory methods, procedures,
200190 techniques, devices, equipment, and records for , ignition interlock
201191 device performance and data.
202192 E. The Board is authorized to prescribe and approve the
203193 requisite education and training for the performance of ignition
204194 interlock services. The Board shall establish standard s and
205195 ascertain the qualifications and com petence of individuals who
206196 provide ignition interlock services and to issue permits to such
207197 individuals and service centers which shall be subject to suspension
208198 or revocation in accordance with the rules promulgated by the Board.
209199 F. The driving record of a person subject to revocation under
210200 the provisions of Section 753 or 754 of this title contained in
211201 paragraph 1 of subsection A of Section 6 -205.1 of this title,
212202 excluding those subject to revocation under the pro visions of
213203 paragraph 2 of subsection A of Section 6-205 of this title, who
214204 enrolls in IDAP in accordance with this paragraph shall be updated
215205 to indicate completion of IDAP without revocation, provided the
216206 following requirements are satisfied:
207+1. At the time of the arrest, the person was a holder of a
208+Class D driver license and was not driving or in actual physical
209+control of a commercial motor vehicle;
210+2. The Board of Tests for Alcohol and Drug Influence receives
211+the request for IDAP participation and pa yment of the program

244-1. At the time of the arrest, the person was a holder of a
245-Class D driver license and was not driving or in actual physical
246-control of a commercial motor vehicle;
247-2. The Board of Tests for Alcohol and Dr ug Influence receives
248-the request for IDAP participation and payment of the program
249238 administration fee as set forth in this section within thirty (30)
250239 calendar days from the date of the arrest receipt of the revocation
251240 notice from Service Oklahoma ;
252241 3. The person is otherwise eligible for driving privileges in
253242 Oklahoma on the date he or she enrolls in IDAP;
254243 4. The person provides proof of enrollment in IDAP to Service
255244 Oklahoma and obtains a restricted driver license pursuant to Section
256245 6-212.3 of this title prior to the revocation taking effect;
257246 5. The person provide s proof of completion of IDAP to Service
258247 Oklahoma;
259248 6. The person has complied with the reinstatement requirements
260249 set forth in Section 6 -212 of this title, including the payment of
261250 any necessary fees;
262251 7. The person provides proof of completion of the alcohol and
263252 drug assessment and evaluation re quired by Section 6-212.2 of this
264253 title; and
265254 8. The person enrolling in IDAP in accordance to with the
266255 provisions of this subsection shall waive the right to file an
256+appeal pursuant to Section 6 -211 of this title regarding the arrest
257+related to the IDAP e nrollment.
258+SECTION 2. It being immediately necessary for the preservation
259+of the public peace, health or safety, an emergency is hereby
260+declared to exist, by reason whereof this act shall take effect and
261+be in full force from and after its passage and approval.
