77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 13001 of Title 74, unless there
80	80	is created a duplication in numbering, reads as follo ws:
81	81	A. There is hereby created the Oklahoma Commission on Race and
82	82	Equality. The Commission shall be appointed as follows:
83	83	1. Three members shall be appointed by the Governor;
84	84	2. Three members shall be appointed by the President Pro
85	85	Tempore of the Senate;
86	86	3. Three members shall be appointed by the Speaker of the House

139	139	4. Four members shall be appointed by the Oklahoma Legislative
140	140	Black Caucus.
141	141	B. All members shall be appointed by the appropriate appointing
142	142	authority for a term of three (3) years commencing upon the date
143	143	that the previous appointee ’s term expired. Each member shall serve
144	144	no more than three (3) terms. Each member shall only serve two (2)
145	145	consecutive terms and shall be inactive for a period of one (1) year
146	146	prior to serving the maximum three -term limit.
147	147	C. In making such appointments, co nsideration shall be given to
148	148	making the membership broadly representative of the geographic areas
149	149	of this state and the racial and ethnic groups residing in this
150	150	state.
151	151	D. Each member shall hold office until the successor of the
152	152	member is appointed and has qualified. A member appointed to fill a
153	153	vacancy occurring before the expiration of a term of a member
154	154	removed from the Commission for any cause shall be appointed for the
155	155	remainder of the term of the member whose office has been vacated.
156	156	E. A member of the Commission may be removed by the appropriate
157	157	appointing authority for cause.
158	158	F. Members of the Commission shall receive no salary but shall
159	159	be entitled to travel reimbursem ent as provided by the State Travel
160	160	Reimbursement Act from funds available to the appropriate appointing

213	213	G. The Office of Management and Enterprise Services shall
214	214	provide staff support to the Oklahoma Commission on Race and
215	215	Equality and make ar rangements for a suitable meeting space for the
216	216	Commission as needed.
217	217	H. The initial chair shall be appointed by the Oklahoma
218	218	Legislative Black Caucus, with the approval of the Governor,
219	219	President Pro Tempore of the Senate, and Speaker of the House of
220	220	Representatives. After the initial chair ’s first term ends, the
221	221	President Pro Tempore of the Senate shall name the chair of the
222	222	Oklahoma Commission on Race and Equality, and the Speaker of the
223	223	House of Representatives shall name the vice chair. Any other
224	224	officers deemed necessary shall be elected from among the members at
225	225	the first meeting of the Commission. Thereafter, at the first
226	226	meeting of each fiscal year, the Commission shall elect a chair, a
227	227	vice chair, and such other officers deemed necessary to con duct the
228	228	business of the Commission from among its members. A majority of
229	229	the members shall constitute a quorum for the purpose of conducting
230	230	the business of the Commission. The Commission shall meet at least
231	231	once every three (3) months and at such other times as called by the
232	232	chair or by a majority of the Commission.
233	233	I. The Oklahoma Commission on Race and Equality shall have the
234	234	power and duty to:
235	235	1. Advise on equality issues relating to racial discrimination
236	236	and bias, state agencies and employees, com munities, organizations,

289	289	Commission;
290	290	2. Monitor legislation to determine whether legislation is
291	291	discriminatory toward one race or ethnicity or whether the race or
292	292	ethnicity of an individual woul d have an effect on the enforcement
293	293	of the legislation;
294	294	3. Act as a resource and a clearinghouse for research on issues
295	295	related to racial discrimination and bias;
296	296	4. Act as a resource in any state appointments to commissions
297	297	and boards for diversity;
298	298	5. Conduct meetings and seminars within the state as
299	299	appropriate to support the goals and duties of the Commission; and
300	300	6. Electronically submit an annual report to the Governor, the
301	301	President Pro Tempore of the Senate, and the Speaker of the House of
302	302	Representatives on its activities. The report may include
303	303	recommendations concern ing needed legislation or regulatory change
304	304	relating to racial discrimination and bias.
305	305	SECTION 2. NEW LAW A new section of law to be codified

308	308	There is hereby created in the State Treasury a revolving fund
309	309	for the Office of Management and Enterprise Services to be
310	310	designated the “Oklahoma Commission on Race and Equality Revolving
311	311	Fund”. The fund shall be a con tinuing fund, not subject to fiscal

363	363	year limitations, and shall consist of all monies received by the
364	364	Office of Management and Enterprise Services from all gifts and
365	365	donations provided for the purpose of supporting the work of the
366	366	Oklahoma Commission on Race and Equality. All monies accruing to
367	367	the credit of the fund are hereby appropriated and may be budgeted
368	368	and expended by the Director of the Office of Management and
369	369	Enterprise Services on behalf of the Oklahoma Commission on Race and
370	370	Equality for the purpose provided for in this section. Expenditures
371	371	from the fund shall be made upon warrants issued by the State
372	372	Treasurer against claims filed as prescribed by law with the
373	373	Director of the Office of Management and Enterprise Services for
374	374	approval and payment.
375	375	SECTION 3. This act shall become effective November 1, 2025.
