7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law not to be
8181 codified in the Oklahoma Statutes reads as follows:
8282 A. This act shall be known and may be cited as the “Oklahoma
8383 Medical Freedom Act”.
8484 B. The Legislature finds and declares the following:
8585 1. During the years 2020 through 2022, federal government
8686 agencies collaborated with medic al organizations, media
8787 personalities, social media platforms, and other influ ential
8888 entities to orchestrate a coordinated and coercive propaganda
8989 campaign. This campaign was characterized by psychological pressure

141141 and public shaming directed at individua ls who declined COVID-19
142142 vaccinations, coupled with the aggressive suppression of dissenting
143143 views, including those expressed by esteemed medical and scientific
144144 professionals with extensive credentials;
145145 2. This coordinated effort created an environment co nducive to
146146 the implementation of unconstitutional and unethical medical
147147 mandates at federal, state, and local levels. These mandates
148148 disregarded individual autonomy and the principles of informed
149149 consent and due process, which are cornerstones of ethical medical
150150 practice;
151151 3. As a result of these mandates, thousands of Americans in the
152152 public and private sectors, including Oklahoma citizens, were
153153 unjustly terminated from their employment and/or lost retirement
154154 benefits for exercising their right to medical freedom. Many others
155155 were denied access to essential public accommodations, violating
156156 their constitutional rights and creating severe social and economic
157157 repercussions;
158158 4. Emerging peer-reviewed studies and post -marketing
159159 surveillance data have revealed that COVID-19 vaccinations, contrary
160160 to the assertions of the propaganda campaign:
161161 a. provided a substantially lower level of protection
162162 against contracting and transmitting C OVID-19 than
163163 initially claimed, undermining the justification for
164164 their widespread and mandatory administration, and

216216 b. were associated with increased risks t o heart health,
217217 including myocarditis and pericarditis, particularly
218218 in younger populations, as well as potential adverse
219219 effects on fertility, raising significant public
220220 health concerns; and
221221 5. The State of Oklahoma bears a profound ethical and
222222 constitutional obligation to safeguard its citizens from any future
223223 recurrence of coercive medical mandates or campaigns that compromise
224224 the principles of bodily autonomy, medical ethics, and public trust
225225 in health care.
226226 SECTION 2. NEW LAW A new section of law to be codified
227227 in the Oklahoma Statutes as Section 2010 of Title 25, unless there
228228 is created a duplication in numbering, reads as follows:
229229 A. The right of a person to refuse any medical procedure,
230230 medical treatment, device, vaccine, or prophylactic shall not be
231231 questioned or interfered with in any manner. The right of a person
232232 to public accommodation, to the equal protection of the law, and to
233233 seek restitution for harm shall not be denied or infringed upon
234234 because of the exercise of th e rights contained in this section.
235235 B. Health care professionals, including physicians, nurses, and
236236 allied health providers, shall be protected from any disciplinary
237237 action, loss of licensure, or professional penalties for:
238238 1. Voicing concerns or dissent regarding medical mandates,
239239 treatments, or protocols;

291291 2. Advocating for patients ’ rights to informed consent, medical
292292 freedom, or access to alternative treatments; and
293293 3. Disclosing information about unethical practices, coercive
294294 mandates, or improper a ctions by health care institutions or
295295 governing bodies.
296296 C. State medical licensing boards, professional oversight
297297 organizations, or any other regulatory authority shall not:
298298 1. Revoke, suspend, or threaten the licensure of a healthcare
299299 professional for engaging in protected speech or whistleblowing
300300 activities related to public health policies or medical mandates; or
301301 2. Investigate or sanction professionals solely for their
302302 public or private statements opposing official medical
303303 recommendations or practice s.
304304 D. A cause of action is hereby created for any health care
305305 professional who experiences retaliation, intimidation, or
306306 professional harm as a result of engaging in protected a ctivities
307307 under this act. Such individuals may seek:
308308 1. Injunctive relief to prevent or reverse any adverse actions;
309309 and
310310 2. Compensatory and punitive damages, including reasonable
311311 attorney fees and court costs.
312312 E. Any action taken by a regulatory body against a health care
313313 professional that is alleged to violate this section sha ll be
314314 subject to expedited judicial review. The burden of proof shall

366366 rest on the regulatory body to demonstrate, by clear and convincing
367367 evidence, that the action was unrelated to the professional’s
368368 exercise of protected activities under this act.
369369 SECTION 3. It being immediately necessary for the preservation
370370 of the public peace, health or safety, an emergency is hereby
371371 declared to exist, by reason whereof this act shall take effect and
372372 be in full force from and after its passage and appr oval.
