	67	+	cruelty; creating misdemeanor offense; modifying
	68	+	scope and penalty of certain felony offense; creating
	69	+	felony offense; providing penalt ies; updating
	70	+	statutory language; and providing an effective date .

47	75		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
48	76		SECTION 1. AMENDATORY 21 O.S. 2021, Section 1685, is
49	77		amended to read as follows:
50	78		Section 1685. A. Any person who shall knowingly deprive any
51	79		animal in subjugation or captivity, whether wild or tame, and
52	80		whether belonging to the person or to another , of necessary food,
53	81		drink, shelter, or veterinary care; or who shall cause, procure, or
54	82		permit any such animal to b e deprived by another shall be guilty,
55	83		upon conviction, of a misdemeanor punishable by imprisonment in the
56	84		county jail for a term not to exc eed one (1) year, by a fine not
57	85		more than One Thousand Dollars ($1,000.00), or by both such
58	86		imprisonment and fine. Any animal so maltreated shall be considered
59	87		a neglected animal.

	139	+	B. Any person who shall willfully or maliciously torture
	140	+	knowingly, destroy, or kill, or cruelly beat or injure, maim , or
89	141		mutilate any animal in subjugation or captivity, whether wild or
90	142		tame, and whether belonging to the person or to another , or deprive
91	143		any such animal of necessary food, drink, shelter, or veterinary
92	144		care to prevent suffering; or who shall cause, procure , or permit
93	145		any such animal to be so tortured, destroyed , or killed, or cruelly
94	146		beaten or injured, maimed , or mutilated, or deprived of necessary
95	147		food, drink, shelter, or veterinary care to prevent suffering ; or
96	148		who shall willfully set on foot, instigate, engage in, or in any way
97	149		further any act of cruelty to any animal, or any act tending to
98	150		produce such cruelty, shall be guilty , upon conviction, of a felony
99	151		and shall be punished punishable by imprisonment in the State
100	152		Penitentiary custody of the Department of Corrections for a term not
101	153		exceeding to exceed five (5) years, or by imprisonment in the county
102	154		jail for a term not to exceed exceeding one (1) year, or by a fine
103	155		not exceeding more than Five Thousand Dollar s ($5,000.00), or by
104	156		both such imprisonment and fine . Any animal so maltreated or abused
105	157		shall be considered an abused or neglected animal.
106	158		C. Any person providing commercial services for animals,
107	159		including, but not limited to, veterinary care, grooming services,
108	160		or boarding, who shall willfully or maliciously destroy, kill, beat,
109	161		injure, maim, or mutilate an animal or pet in his or her care,
110	162		shall, upon conviction, be guilty of a felony punishable by
111		-	imprisonment in the Department of Corrections for a term not to
