87 | 87 | | in the Oklahoma Statutes as Section 16-105.1 of Title 26, unless |

144 | 144 | | 2. District attorneys shall have standing to bring actions in |

146 | 146 | | a. investigate and address violations of election laws, |
---|
147 | 147 | | including, but not limited to, vo ter fraud, ballot |
---|
148 | 148 | | tampering, unlawful voting practices, and breaches of |
---|
149 | 149 | | voting machine security, |
---|
150 | 150 | | b. seek injunctive relief to prevent further violations |
---|
151 | 151 | | or irregularities, and |
---|
152 | 152 | | c. pursue restitution or other remedies as deemed |
---|
153 | 153 | | appropriate by the court to pr otect the rights of |
---|
154 | 154 | | voters. |
---|
155 | 155 | | B. 1. District attorneys may request access to relevant |
---|
156 | 156 | | election records and data from the State Election Board and county |
---|
157 | 157 | | election boards to support investigations and litigation efforts. |
---|
158 | 158 | | 2. All records obtained for investig ation shall remain |
---|
159 | 159 | | confidential except as required by law or court order. |
---|
160 | 160 | | 3. Reports on litigation outcomes must be submitted annually to |
---|
161 | 161 | | the Oklahoma State Election Board for review and public record. |
---|
162 | 162 | | C. 1. Any action initiated under this act must rece ive prior |
---|
163 | 163 | | approval from the district court in the judicial district where the |
---|
164 | 164 | | alleged irregularity occurred. The court shall assess whether the |

222 | 222 | | authorized to promulgate rules necessary to facilitate the |

224 | 224 | | SECTION 3. This act shall become effective July 1, 2025. |
---|
225 | 225 | | SECTION 4. It being immediately necessary for the preservation |
---|
226 | 226 | | of the public peace, health or safety, an emergency is hereby |
---|
227 | 227 | | declared to exist, by reason whereof this act shall take effect and |
---|
228 | 228 | | be in full force from and after its passage and approval. |
