8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new sec tion of law not to be
8383 codified in the Oklahoma Statutes reads as follows:
8484 This act shall be known and may be cited as the “Election
8585 Integrity Enforcement Act ”.
8686 SECTION 2. NEW LAW A new section of law to be codified
8787 in the Oklahoma Statutes as Section 16-105.1 of Title 26, unless
8888 there is created a duplication in numbering, reads as follows:
8989 A. 1. District attorneys in this state are hereby authorized
9090 to initiate civil actions on behalf of voters within their

142142 respective judicial dis tricts in cases where election irregularities
143143 or fraud are alleged to have occurred.
144144 2. District attorneys shall have standing to bring actions in
145145 district court to:
146146 a. investigate and address violations of election laws,
147147 including, but not limited to, vo ter fraud, ballot
148148 tampering, unlawful voting practices, and breaches of
149149 voting machine security,
150150 b. seek injunctive relief to prevent further violations
151151 or irregularities, and
152152 c. pursue restitution or other remedies as deemed
153153 appropriate by the court to pr otect the rights of
154154 voters.
155155 B. 1. District attorneys may request access to relevant
156156 election records and data from the State Election Board and county
157157 election boards to support investigations and litigation efforts.
158158 2. All records obtained for investig ation shall remain
159159 confidential except as required by law or court order.
160160 3. Reports on litigation outcomes must be submitted annually to
161161 the Oklahoma State Election Board for review and public record.
162162 C. 1. Any action initiated under this act must rece ive prior
163163 approval from the district court in the judicial district where the
164164 alleged irregularity occurred. The court shall assess whether the

216216 allegations present a prima facie case of election fraud or
217217 irregularity.
218218 2. District attorneys shall not file lawsuits frivolously.
219219 3. Penalties for repeated misuse of this authority inc lude
220220 censure, suspension, or removal under applicable state law.
221221 D. The Secretary of the State Election Board shall be
222222 authorized to promulgate rules necessary to facilitate the
223223 implementation of this act.
224224 SECTION 3. This act shall become effective July 1, 2025.
225225 SECTION 4. It being immediately necessary for the preservation
226226 of the public peace, health or safety, an emergency is hereby
227227 declared to exist, by reason whereof this act shall take effect and
228228 be in full force from and after its passage and approval.
