147	147	SECTION 1. NEW LAW A new section of law to be codified
148	148	in the Oklahoma Statutes as Section 24 -162 of Title 70, unless there
149	149	is created a duplication i n numbering, reads as follows:
150	150	A. As used in this section:
151	151	1. “Antisemitism” means a certain perception of Jews, which may
152	152	be expressed as hatred toward Jews. Rhetorical and p hysical
153	153	manifestations of anti semitism are directed toward Jewish or non -
154	154	Jewish individuals or their properties, Jewish community
155	155	institutions, and Jewish religious facilities. Antisemitism does
156	156	not mean criticism of Israel that is similar to criticism to ward any
157	157	other country. The provisions of this paragraph shall include any
158	158	amendments adopted by the International Holocaust Remembrance
159	159	Alliance;
160	160	2. “Institution of higher education ” means an institution of
161	161	higher education within The Oklahoma State Sys tem of Higher
162	162	Education; and
163	163	3. “Public school” shall have the same meaning as provided for
164	164	in Section 1-106 of Title 70 of the Oklahoma Statutes.
165	165	B. Discrimination on the basis of race, ethnicity, national
166	166	origin, sex, disability, religion, or marital s tatus against a
167	167	student or an employee in an institution of higher education o r a
168	168	public school in this state shall be prohibited. No person in this
169	169	state shall, on the basis of race, ethnicity, national origin, sex,
170	170	disability, religion, or marital statu s, be excluded from

222	222	participating in, be denied the benefits of, or be subjected to
223	223	discrimination under any institution of higher education or public
224	224	school program or activity or in any employment conditions or
225	225	practices conducted by an institution of hi gher education or a
226	226	public school that receives or benefits from federal or st ate
227	227	financial assistance.
228	228	C. The criteria for admission to a program or course at an
229	229	institution of higher education shall not have the effect of
230	230	restricting access by persons o f a particular race, ethnicity,
231	231	national origin, sex, disability, religion, or marital status.
232	232	D. All institution of higher education and public school
233	233	classes shall be available to all students without regard to race,
234	234	ethnicity, national origin, sex, dis ability, religion, or marital
235	235	status. Provided, however, the provisions of th is subsection shall
236	236	not prohibit the provision of programs designed to meet the needs of
237	237	students with limited proficiency in English, gifted students, or
238	238	students with disabilit ies or programs tailored to students with
239	239	specialized talents or skills.
240	240	E. Guidance, counseling, and financial assistance services in
241	241	institutions of higher education and public schools shall be
242	242	available to all students equally and provided in the same manner
243	243	regardless of race, ethnicity, national origin, sex, disability,
244	244	religion, or marital status.

296	296	F. All education programs, activities, and opportunities
297	297	offered by institutions of higher education and public schools shall
298	298	be made available without di scrimination on the basis of race,
299	299	ethnicity, national origin, sex, disability, religion, or marital
300	300	status.
301	301	SECTION 2. NEW LAW A new section of law to be codified
302	302	in the Oklahoma Statutes as Section 24 -163 of Title 70, unless there
303	303	is created a duplication in numbering, reads as follows:
304	304	A. Institutions of higher education and public schools shall
305	305	integrate the definition of anti semitism provided for in Section 1
306	306	of this act into their student, faculty, and employee codes of
307	307	conduct with penalties for violations identical to racism and
308	308	prohibit such conduct at or by the institution and public school.
309	309	Prohibited conduct as it specifically relates to anti semitism shall
310	310	be incorporated and include harassing conduct and discrimination
311	311	against Jews.
312	312	B. Institutions of higher education and public schools shall
313	313	treat harassment of or discrimination against students or employees
314	314	or resulting from institutional policies or programs on their
315	315	campuses motivated by or including antisemitic intent in an
316	316	identical manner to discrimination motivated by race.
317	317	C. Evidence of antisemitic intent shall include, but not be
318	318	limited to:

370	370	1. Encouraging, supporting, praising, participating in, or
371	371	threatening violence or vandalism against Jews or Jewish pr operty;
372	372	2. Praising designated terrorist groups such as Hamas or any
373	373	group or individual calling for the genocide or killing of Jews;
374	374	3. Wearing masks to conceal one ’s identity with the intent to
375	375	demonstrate in general including, but not limited to, hara ssing or
376	376	discriminating against Jewish or other students, faculty, and
377	377	employees on campus property;
378	378	4. Participating in or supporting the boycott, divestment, or
379	379	sanctions of Israeli companies, institutions, or individuals
380	380	including by any institution of higher education endowment;
381	381	5. Allowing or participating in antisemitic events, such as
382	382	encampments, lock-ins, walk-outs, or similar demonstrations on
383	383	campus property when such events intimidate, harass, or otherwise
384	384	violate Title VI protections provided for Jewish students. Students
385	385	who participate in such events and miss class as a result shall
386	386	receive unexcused absences and failure grades for any assignments or
387	387	examinations taking place on such dates of participation; or
388	388	6. Incorporating or allowing funding of antisemitic curriculum
389	389	or activity in any domestic or study abroad programs or classes.
390	390	D. All institutions of higher education and public schools are
391	391	encouraged to:
392	392	1. Incorporate anti semitism awareness training for all
393	393	students, faculty, adm inistrators, and campus police; and

446	446	that incorporates Jewish experiences in the United States of America
447	447	pre- and post-revolution, pre- and post-World War II and the
448	448	Holocaust, and in modern ti mes.
449	449	SECTION 3. NEW LAW A new section of law to be cod ified
450	450	in the Oklahoma Statutes as Section 24 -164 of Title 70, unless there
451	451	is created a duplication in numbering, reads as follows:
452	452	A. The Oklahoma State Regents for Higher Educ ation and the
453	453	State Board of Education shall monitor, assess, and report on the
454	454	performance of institutions of higher education , public school
455	455	districts, and public schools with anti semitic activity. If the
456	456	Oklahoma State Regents for Higher Education or t he State Board of
457	457	Education, after reasonable investigation, determines that t he
458	458	institution of higher education, public school district , or
459	459	individual public school has engaged in, allowed, or not
460	460	sufficiently disciplined prohibited anti semitic activity, the
461	461	Oklahoma State Regents for Higher Education or the State Board of
462	462	Education shall give written notice to the institution of higher
463	463	education, public school district , or individual public school to
464	464	address its concerns no later than thirty (30) days aft er receipt of
465	465	the notice.
466	466	B. If the Oklahoma State Regents for Higher Educati on or the
467	467	State Board of Education determines the institution of higher
468	468	education, public school district , or individual public school has

521	521	period, the Oklahoma State Regents for Higher Education shall
522	522	immediately report same to the President Pro Tempore of the Senate
523	523	and the Speaker of the House of Representatives. The Legislature
524	524	shall impose at least a one -percent reduction in funding against the
525	525	institution of higher education or the public school district. The
526	526	Legislature may impose additional punitive actions as it deems
527	527	necessary.
528	528	SECTION 4. NEW LAW A new section of law to be codified
529	529	in the Oklahoma Statutes as Section 24 -165 of Title 70, unless there
530	530	is created a duplication in numbering, reads as follows:
531	531	A. Nothing in this act shall be construed to diminish or
532	532	infringe upon any right protected under the First Amendment to the
533	533	United States Constitution or Section 22 of Article II of the
534	534	Oklahoma Constitution.
535	535	B. Nothing in this act shall be construed to conflict with
536	536	federal or state discrimination laws.
537	537	SECTION 5. This act shall become effective July 1, 2025.
538	538	SECTION 6. It being immediately necessary for the preservation
539	539	of the public peace, health, or safety, an emergency is hereby
540	540	declared to exist, by reason whereof this act shall take effect and
541	541	be in full force from and after its passage and app roval.
