147147 SECTION 1. NEW LAW A new section of law to be codified
148148 in the Oklahoma Statutes as Section 24 -162 of Title 70, unless there
149149 is created a duplication i n numbering, reads as follows:
150150 A. As used in this section:
151151 1. “Antisemitism” means a certain perception of Jews, which may
152152 be expressed as hatred toward Jews. Rhetorical and p hysical
153153 manifestations of anti semitism are directed toward Jewish or non -
154154 Jewish individuals or their properties, Jewish community
155155 institutions, and Jewish religious facilities. Antisemitism does
156156 not mean criticism of Israel that is similar to criticism to ward any
157157 other country. The provisions of this paragraph shall include any
158158 amendments adopted by the International Holocaust Remembrance
159159 Alliance;
160160 2. “Institution of higher education ” means an institution of
161161 higher education within The Oklahoma State Sys tem of Higher
162162 Education; and
163163 3. “Public school” shall have the same meaning as provided for
164164 in Section 1-106 of Title 70 of the Oklahoma Statutes.
165165 B. Discrimination on the basis of race, ethnicity, national
166166 origin, sex, disability, religion, or marital s tatus against a
167167 student or an employee in an institution of higher education o r a
168168 public school in this state shall be prohibited. No person in this
169169 state shall, on the basis of race, ethnicity, national origin, sex,
170170 disability, religion, or marital statu s, be excluded from

222222 participating in, be denied the benefits of, or be subjected to
223223 discrimination under any institution of higher education or public
224224 school program or activity or in any employment conditions or
225225 practices conducted by an institution of hi gher education or a
226226 public school that receives or benefits from federal or st ate
227227 financial assistance.
228228 C. The criteria for admission to a program or course at an
229229 institution of higher education shall not have the effect of
230230 restricting access by persons o f a particular race, ethnicity,
231231 national origin, sex, disability, religion, or marital status.
232232 D. All institution of higher education and public school
233233 classes shall be available to all students without regard to race,
234234 ethnicity, national origin, sex, dis ability, religion, or marital
235235 status. Provided, however, the provisions of th is subsection shall
236236 not prohibit the provision of programs designed to meet the needs of
237237 students with limited proficiency in English, gifted students, or
238238 students with disabilit ies or programs tailored to students with
239239 specialized talents or skills.
240240 E. Guidance, counseling, and financial assistance services in
241241 institutions of higher education and public schools shall be
242242 available to all students equally and provided in the same manner
243243 regardless of race, ethnicity, national origin, sex, disability,
244244 religion, or marital status.

296296 F. All education programs, activities, and opportunities
297297 offered by institutions of higher education and public schools shall
298298 be made available without di scrimination on the basis of race,
299299 ethnicity, national origin, sex, disability, religion, or marital
300300 status.
301301 SECTION 2. NEW LAW A new section of law to be codified
302302 in the Oklahoma Statutes as Section 24 -163 of Title 70, unless there
303303 is created a duplication in numbering, reads as follows:
304304 A. Institutions of higher education and public schools shall
305305 integrate the definition of anti semitism provided for in Section 1
306306 of this act into their student, faculty, and employee codes of
307307 conduct with penalties for violations identical to racism and
308308 prohibit such conduct at or by the institution and public school.
309309 Prohibited conduct as it specifically relates to anti semitism shall
310310 be incorporated and include harassing conduct and discrimination
311311 against Jews.
312312 B. Institutions of higher education and public schools shall
313313 treat harassment of or discrimination against students or employees
314314 or resulting from institutional policies or programs on their
315315 campuses motivated by or including antisemitic intent in an
316316 identical manner to discrimination motivated by race.
317317 C. Evidence of antisemitic intent shall include, but not be

370370 1. Encouraging, supporting, praising, participating in, or
371371 threatening violence or vandalism against Jews or Jewish pr operty;
372372 2. Praising designated terrorist groups such as Hamas or any
373373 group or individual calling for the genocide or killing of Jews;
374374 3. Wearing masks to conceal one ’s identity with the intent to
375375 demonstrate in general including, but not limited to, hara ssing or
376376 discriminating against Jewish or other students, faculty, and
377377 employees on campus property;
378378 4. Participating in or supporting the boycott, divestment, or
379379 sanctions of Israeli companies, institutions, or individuals
380380 including by any institution of higher education endowment;
381381 5. Allowing or participating in antisemitic events, such as
382382 encampments, lock-ins, walk-outs, or similar demonstrations on
383383 campus property when such events intimidate, harass, or otherwise
384384 violate Title VI protections provided for Jewish students. Students
385385 who participate in such events and miss class as a result shall
386386 receive unexcused absences and failure grades for any assignments or
387387 examinations taking place on such dates of participation; or
388388 6. Incorporating or allowing funding of antisemitic curriculum
389389 or activity in any domestic or study abroad programs or classes.
390390 D. All institutions of higher education and public schools are
391391 encouraged to:
392392 1. Incorporate anti semitism awareness training for all
393393 students, faculty, adm inistrators, and campus police; and

445445 2. Integrate Jewish American heritage curriculum for students
446446 that incorporates Jewish experiences in the United States of America
447447 pre- and post-revolution, pre- and post-World War II and the
448448 Holocaust, and in modern ti mes.
449449 SECTION 3. NEW LAW A new section of law to be cod ified
450450 in the Oklahoma Statutes as Section 24 -164 of Title 70, unless there
451451 is created a duplication in numbering, reads as follows:
452452 A. The Oklahoma State Regents for Higher Educ ation and the
453453 State Board of Education shall monitor, assess, and report on the
454454 performance of institutions of higher education , public school
455455 districts, and public schools with anti semitic activity. If the
456456 Oklahoma State Regents for Higher Education or t he State Board of
457457 Education, after reasonable investigation, determines that t he
458458 institution of higher education, public school district , or
459459 individual public school has engaged in, allowed, or not
460460 sufficiently disciplined prohibited anti semitic activity, the
461461 Oklahoma State Regents for Higher Education or the State Board of
462462 Education shall give written notice to the institution of higher
463463 education, public school district , or individual public school to
464464 address its concerns no later than thirty (30) days aft er receipt of
465465 the notice.
466466 B. If the Oklahoma State Regents for Higher Educati on or the
467467 State Board of Education determines the institution of higher
468468 education, public school district , or individual public school has

520520 not taken necessary actions by the expi ration of the thirty -day
521521 period, the Oklahoma State Regents for Higher Education shall
522522 immediately report same to the President Pro Tempore of the Senate
523523 and the Speaker of the House of Representatives. The Legislature
524524 shall impose at least a one -percent reduction in funding against the
525525 institution of higher education or the public school district. The
526526 Legislature may impose additional punitive actions as it deems
527527 necessary.
528528 SECTION 4. NEW LAW A new section of law to be codified
529529 in the Oklahoma Statutes as Section 24 -165 of Title 70, unless there
530530 is created a duplication in numbering, reads as follows:
531531 A. Nothing in this act shall be construed to diminish or
532532 infringe upon any right protected under the First Amendment to the
533533 United States Constitution or Section 22 of Article II of the
534534 Oklahoma Constitution.
535535 B. Nothing in this act shall be construed to conflict with
536536 federal or state discrimination laws.
537537 SECTION 5. This act shall become effective July 1, 2025.
538538 SECTION 6. It being immediately necessary for the preservation
539539 of the public peace, health, or safety, an emergency is hereby
540540 declared to exist, by reason whereof this act shall take effect and
541541 be in full force from and after its passage and app roval.
