59 | 60 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA : |

60 | 61 | | SECTION 1. AMENDATORY 2 O.S. 2021, Section 5 -107, is |

61 | 62 | | amended to read as follows: |

62 | 63 | | Section 5-107. A. There is hereby created the “Oklahoma Meat |
---|
63 | 64 | | Consumer Protection Act”. |

64 | 65 | | B. As used in the Oklahoma Meat Consumer Protection Act: |

65 | 66 | | 1. “Cell-cultured food product”, also referred to as lab -grown |
---|
66 | 67 | | meat, cultivated meat, clean meat, in vitro meat, imitation meat, |
---|
95 | 95 | | animal cell cultures rather than through the traditional ra ising and |

96 | 96 | | slaughtering of livestock. Cell -cultured food product does not |
---|
97 | 97 | | include imitation meat made of non -meat ingredients including, but |
---|
98 | 98 | | not limited to, plant -based protein; |
---|
99 | 99 | | 2. “Insect-protein food product” means a food product having |
---|
100 | 100 | | one or more sensory attributes that resemble a type of tissue |
---|
101 | 101 | | originating from an agricultural food animal but that, in lieu of |
---|
102 | 102 | | being derived from meat processing, is derived from manufacturing |
---|
103 | 103 | | insect parts; |
---|
104 | 104 | | 3. “Livestock” means animals defined by paragraph 9 of Section |
---|
105 | 105 | | 1-3 of Title 2 of the Oklahoma Statutes; |
---|
106 | 106 | | 2. 4. “Meat” means any edible portion of livestock or part |
---|
107 | 107 | | thereof; |
---|
108 | 108 | | 3. 5. “Misrepresent” means the use of any untrue, misleading , |
---|
109 | 109 | | or deceptive oral or written statement, advertisement, label, |
---|
110 | 110 | | display, picture, ill ustration, or sample; and |
---|
111 | 111 | | 4. 6. “Represent” means the use of any form of oral or written |
---|
112 | 112 | | statement, advertisement, label, display, picture, illustration , or |
---|
113 | 113 | | sample. |

114 | 114 | | C. Pursuant to the Oklahoma Meat Consumer Protection Act, no |
---|
115 | 115 | | person advertising, offering for sale, or selling meat shall engage |
---|
116 | 116 | | in any misleading or deceptive practices, including, but not limited |
---|

148 | 147 | | packaging for plant-based items shall not be considered in violation |

149 | 148 | | of the provisions of this paragraph so long as the packaging |
---|
150 | 149 | | displays that the product is derived from plant -based sources in |
---|
151 | 150 | | type that is uniform in size and prominence to the name of the |
---|
152 | 151 | | product; |
---|
153 | 152 | | 2. Using a USDA-quality grade on a product not graded by the |
---|
154 | 153 | | United States Department of Agriculture (USDA) or Oklahoma |
---|
155 | 154 | | Department of Agriculture, Food, and Forestry (ODAF F); or |
---|
156 | 155 | | 3. Failing to fully and conspicuously disclose the correct |
---|
157 | 156 | | government grade for any product if the product is represented as |
---|
158 | 157 | | having been graded by the USDA or ODAFF ; or |
---|
159 | 158 | | 4. Failing to fully and conspicuously disclose that a product |
---|
160 | 159 | | is a cell-cultured food product or is an insect-protein food |
---|
161 | 160 | | product. |
---|
162 | 161 | | D. The State Board of Agriculture shall promulgate rules |
---|
163 | 162 | | necessary to enforce compliance with the Oklahoma Meat Consumer |
---|
164 | 163 | | Protection Act. |
---|
165 | 164 | | SECTION 2. This act shall become effective Nove mber 1, 2025. |
