4365 An Act relating to state government; defining terms;

5375 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5476 SECTION 1. NEW LAW A new section of law to be codified
5577 in the Oklahoma Statutes as Section 4263 of Title 74, unless there
5678 is created a duplication in n umbering, reads as follows:
5779 A. For the purposes of this section:
5880 1. “Executive lobbyist” means any individual who is employed or
5981 retained by another for financial or other compe nsation to perform
6082 services that include executive lobbying, other than an individual
6183 whose lobbying activities are only incidental to, and are not a
6284 significant part of, the services provided by such individual to the
6385 client, except the following individu als shall not be considered
6486 executive lobbyists:

92138 a. an individual appearing b efore a state officer or
93139 employee of an agency who receives no compensation for
94140 his or her appearance other than reimbursement from
95141 the state for expenses and who engages in no fu rther
96142 lobbying, and
97143 b. any person exercising his or her constitutional right
98144 to petition the government who receives no
99145 compensation or anything of value for lobbying;
100146 2. “Legislative liaison” means any state officer or employee
101147 whose duties in fact inclu de legislative lobbying, regardless of the
102148 state officer or employee ’s title and regardless of whether
103149 legislative lobbying is included within the state officer or state
104150 employee’s job description, other than an individual whose lobbying
105151 activities are only incidental to, and are not a significant part
106152 of, the services provided by such individual to the agency;
107153 3. “Legislative lobbyist ” means any individual who is employed
108154 or retained by another for financial or other compensation to
109155 perform services that include legislative lobbying, other than an
110156 individual whose lobbying activit ies are only incidental to, and are
111157 not a significant part of, the services provided by such individual
112158 to the client, except the following individuals shall not be
113159 considered legislative lobbyists:
114160 a. an individual appearing before the Governor or a
115161 meeting of a legislative body who receives no

149219 4. “Lobbyist” means a lobbyist principal, an executive
150220 lobbyist, or a legislative lobbyist ;
151221 5. “Lobbyist principal” means any person or entity, including
152222 an agency, who employs or retains another person for financial or
153223 other compensation to conduct executive or legislative lobbying
154224 activities on behalf of the lobbyist principal; provided, however,
155225 it shall not mean any individual members, partners, officers , or
156226 shareholders of an ag ency, corporation, association, firm, joint
157227 venture, joint stock company, syndicate, business trust, estate,
158228 trust, company, partnership, limited partnership, organization,
159229 committee, club, or a group of persons who are voluntarily acting in
160230 concert; and
161231 6. “State agency” means a state agency as defined pursuant to
162232 Section 327 of Title 61 of the Oklahoma Statutes .
163233 B. No state agency shall :
164234 1. Enter into any new, or renew any exi sting, contract or any
165235 other agreement with a lobbyist for the purpose of lob bying; or
166236 2. Hire a legislative liaison for the purpose of lobbying ,
