7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
7676 SECTION 1. AMENDATORY 69 O.S. 2021, Section 1711, is
7777 amended to read as follows:
7878 Section 1711. The Oklahoma Turnpike Authority, subject to the
7979 provisions hereof, is hereby authorized to fix, revise, charge and
8080 collect tolls for the use of each turnpike project and the different
8181 parts or sections thereof, except for use by law enforcement
8282 officers responsible for enforcing the traffic laws and the general
8383 laws of the state and federal governments on turnpikes, who shall be
8484 entitled to free use of every such project in the performance of
8585 official duties connected with such turnpike project, and to
8686 contract with any person, partnership, association , or corporation
8787 desiring the use of any part thereof, including the right -of-way

139139 adjoining the paved portion, for placing thereon telephone,
140140 telegraph, electric light or power lines, gas stations, garages,
141141 stores, hotels, restaurants , and advertising signs, or for any other
142142 purpose except for tracks for railroad or railway use, and to fix
143143 the terms, conditions, rents , and rates of charges for such use.
144144 Such tolls, subject to the other restrictions hereof, shall be so
145145 fixed and adjusted in respect of the aggregate of tolls from the
146146 turnpike project or projects in connection with whic h the bonds of
147147 any issue shall have been issued pursuant to Section 2 of this act
148148 as to provide a fund sufficient with other revenues, if any, to pay
149149 (a) the cost of maintaining, repairing, and operating such turnpike
150150 project or projects, and (b) the principal of and the interest of
151151 such bonds as the same shall become due and payabl e, and to create
152152 reserves for such purposes. The tolls and all other revenues
153153 derived from the turnpike project or projects in connection with
154154 which the bonds of any issue shall have been issued, except such
155155 part thereof as may be necessary to pay such cost of maintenance,
156156 repair, and operation and to provide such reserves therefor as may
157157 be provided for in the resolution authorizing the issuance of such
158158 bonds or in the trust agr eement securing the same shall be set aside
159159 at such regular intervals as may b e provided in such resolution or
160160 such trust agreement in a sinking fund which is hereby pledged to,
161161 and charged with, the payment of (a) the interest upon such bonds as
162162 such interest shall fall due, (b) the principal of such bonds as the

214214 same shall fall due, (c) the necessary charges of paying agents for
215215 paying principal and interest, and (d) the redemption price or the
216216 purchase price of bonds retired by call or purchase as therei n
217217 provided, which are a charge against such fund. The use and
218218 disposition of monies to the credit of such sinking fund shall be
219219 subject to the provisions of the resolution authorizing the issuance
220220 of such bonds or of such trust agreement. Except as may otherwise
221221 be provided in such resolution or such trust agreement, such sinking
222222 fund shall be a fund for all such bonds without distinction or
223223 priority of one over another. The monies in the sinking fund, less
224224 such reserve as may be provided in such resolut ion or trust
225225 agreement, if not used within a reasonable time for the purchase of
226226 bonds for cancellation as above provided, shall be applied to the
227227 redemption of bonds at the redemption price then applicable. Any
228228 person who leases, rents, or acquires contr ol of any gas station,
229229 garage, store, hotel, or restaurant must have been a resident of, or
230230 been doing business in, Oklahoma for the past five (5) years.
231231 Notwithstanding anything else herein contained to the contrary, the
232232 Corporation Commission of the State of Oklahoma shall exercise the
233233 jurisdiction now or hereafter vested in it t o regulate and control
234234 the operation of motor carriers of passengers and freight, using or
235235 desiring to use any turnpike project, in the manner and to the
236236 extent that it regulates or controls such carriers using the
237237 highways of the state. The Authority shall not discriminate against

289289 any group or class or individual member thereof in fixing the amount
290290 of toll tolls, rents, or charge charges for the use of the turnpike
291291 project.
292292 SECTION 2. NEW LAW A new section of law to be codified
293293 in the Oklahoma Statutes as Section 1711.1 of Title 69, unless there
294294 is created a duplication in numbering, reads as follows:
295295 A. The Oklahoma Turnpike Authority shall have legislat ive
296296 approval before increasing toll rates on any turnpikes in this
297297 state. The Legislature shall give approval by joint resolution for
298298 any increase in rates.
299299 B. The Legislature shall not give approval to any toll rate
300300 increase that gives more than a ten p ercent (10%) discount to
301301 members of a specific class.
302302 SECTION 3. This act shall become effective November 1, 2025.
