102	100		As used in this section and Sections 1 -9-320.1 through 1-9-320.7
103	101		of this title:
104	102		(a) “Buyer in the ordinary course of business” means a
105	103		person who, in the ordinary course of business, buys
106	104		farm products from a person engaged in farming
107	105		operations who is in the business of selling farm
108	106		products.
109	107		(b) “Central filing system” means a system for filing
110	108		effective financing statements on a statewide basis
111	109		and which has been certified by the Secretary of the
112	110		United States Department of Agriculture.
113	111		(c) “Commission merchant” means any person engaged in the
114	112		business of receiving any farm product for sale, on
115	113		commission, or for or on behalf of another person.
116	114		(d) “Effective financing statement” means a statement
117	115		that:
118	116		(i) is an original or reproduced form consistent with
119	117		the provisions of this act and approved by the
120	118		Secretary of State Oklahoma County Clerk ;
121	119		(ii) is signed and filed with the Secretary of State
122	120		Oklahoma County Clerk by the secured party;
123	121		(iii) is signed by the debtor;

172	169		effective financing statement, is to be
173	170		subject to the particular security interest.

201	197		(v) (iv) must be amended in writing, within three
202	198		(3) months, similarly signed and filed, to
203	199		reflect material changes;
204	200		(vi) (v) remains effective for a period of five (5)
205	201		years from the date of filing, subject to
206	202		extensions for additional periods of five (5)

216	212		(viii) (vii) is accompanied by the requisite filing fee
217	213		provided for in Section 111 of Title 28 of the
218	214		Oklahoma Statutes; and
219	215		(ix) (viii) substantially complies with the
220	216		requirements of this paragraph even though it
221	217		contains minor errors that are not seriously
222	218		misleading.
223	219		(x) (ix) may reflect multiple products or prod ucts
224	220		in multiple counties.

252	247		(e) “Farm product” means an agricultural commodity such as
253	248		wheat, corn, soybeans, or a species of livestock such
254	249		as cattle, hogs, sheep, horses, or poultry used or
255	250		produced in farming operations, or a product of such
256	251		crop or livestock in its unmanufactured state (such as
257	252		ginned cotton, wool-clip, maple syrup, milk, and
258	253		eggs), that is in the possession of a person engaged
259	254		in farming operations.
260	255		(f) “Knows” or “knowledge” means actual knowledge.
261	256		(g) “Person” means any individual, pa rtnership,
262	257		corporation, limited liability company, trust, or any
263	258		other business entity.
264	259		(h) “Security interest” means an interest in farm products
265	260		that secures payment or performance of an obligation.
266	261		(i) “Selling agent” means any person, other than a
267	262		commission merchant, who is engaged in the business of
268	263		negotiating the sale and purchase of any farm product
269	264		on behalf of a person engaged in farming operations.
270	265		(2) Unless otherwise provided for in this act, for purposes of
271	266		this section and Sections 4 and 6 of this act, receipt of notice
272	267		shall be presumed if notice is sent by first -class mail, postage
273	268		prepaid.

305	299		The Secretary of State Oklahoma County Clerk shall develop and
306	300		maintain a standard form for an effective financing statement and
307	301		for a statement of continuation, partial release, amendment, or
308	302		assignment thereof, which shall be consistent with the provisions of
309	303		Sections 1-9-320.1 through 1-9-320.7 of this title.
310	304		SECTION 3. AMENDATORY 12A O.S. 2021, Section 1 -9-320.4,
311	305		is amended to read as follows:
312	306		Section 1-9-320.4.
313	307		PROTECTION OF BUYERS OF FARM PRODUCTS,
314	308		COMMISSION MERCHANTS AND SELLING AGENTS
315	309		A buyer of farm products, commission merchant, or selling agent
316	310		who purchases or sells farm products in the ordinary course of
317	311		business from or for a person engaged in farming operations takes
318	312		subject to a security interest in the farm products if:
319	313		(a) (i) the buyer of the farm products, commission merchant,
320	314		or selling agent has failed to register with the
321	315		Secretary of State Oklahoma County Clerk prior to the
322	316		purchase of the farm products and the secured par ty
323	317		has filed an effective financing statement that covers
324	318		the farm products being sold; or
325	319		(ii) the buyer of farm products, commission merchant or
326	320		selling agent receives from the Secretary of State

362	355		(b) the secured party or the seller provides written notice of
363	356		the security interest pursuant to the provisions of Section
364	357		1-9-320.7 of this title.
365	358		SECTION 4. AMENDATORY 12A O.S. 2021, Section 1-9-320.6,
366	359		as amended by Section 1, Chapter 109, O.S.L. 2022 (12A O.S. Supp.
367	360		2024, Section 1-9-320.6), is amended to read as follows:
368	361		Section 1-9-320.6.
369	362		CENTRAL FILING SYSTEM RELATING TO FARM PRODUCTS
370	363		(1) The Secretary of State Oklahoma County Clerk shall be
371	364		responsible for developing and implementing maintaining the central
372	365		filing system. This responsibility shall include obtaining the
373	366		necessary certification for the system from the United States
374	367		Department of Agriculture (“USDA”) (USDA). The effective date for
375	368		the implementation of the central filing system was October 24, 1988
376	369		shall be one hundred eighty (180) days from the certification of the
377	370		central filing system by the USDA .

405	397		(2) The Secretary of State Oklahoma County Clerk may
406	398		promulgate, in accordance with the applicable provisions of the
407	399		Administrative Procedures Act, laws governing business within its
408	400		office, appropriate rules and practices of the filing office in
409	401		harmony with the rules and practices of filing office s in other
410	402		jurisdictions that enact substantially this part and to keep the
411	403		technology used by the filing office compatible with the technology
412	404		used by filing offices in other jurisdictions that enact
413	405		substantially this part. The Oklahoma County Clerk, so far as is
414	406		consistent with the purposes, policies, and provisions of this
415	407		article in adopting, amending, and repealing filing office rules,
416	408		shall:
417	409		(a) consult with filing offices in other jurisdictions
418	410		that enact substantially this part,
419	411		(b) consult the International Association of Commercial
420	412		Administrators or any successor organization, and
421	413		(c) take into consideration the rules and practices of,
422	414		and the technology used by, filing offices in other
423	415		jurisdictions that enact substantially this part, for
424	416		the implementation and operation of the central filing
425	417		system.
426	418		(3) The Office of Management and Enterprise Services shall
427	419		assist the Secretary of State in developing and implementing the
428	420		central filing system.

456	447		(4) The central filing system shall conform to the following
457	448		requirements:
458	449		(a) The Secretary of State Oklahoma County Clerk shall
459	450		record the date and, hour, minute, and second of the
460	451		filing of each effective financing statement;
461	452		(b) The Secretary of State Oklahoma County Clerk shall
462	453		compile all effective financing statements into a
463	454		master list:
464	455		(i) organized according to farm products;
465	456		(ii) arranged within each such product:
466	457		(A) in alphabetical order according to the last
467	458		name of the individual debtors or, in the
468	459		case of debtors doing business other than a s
469	460		individuals, the first word in the name of
470	461		the debtors;
471	462		(B) in numerical order according to the Social
472	463		Security number of the individual debtors
473	464		or, in the case of debtors doing business
474	465		other than as individuals, the Internal
475	466		Revenue Service taxpayer id entification
476	467		number of the debtors;
477	468		(C) geographically by county produced; and
478	469		(D) by crop year; and

510	500		hard copy, electronic formats, or via Internet
511	501		download, and may be organized by other sorting
512	502		methods in addition to the methods listed above .
513	503		(c) The Secretary of State Oklahoma County Clerk shall
514	504		maintain records of all buyers of far m products,
515	505		commission merchants, selling agents and others who
516	506		register with the Secretary of State Oklahoma County
517	507		Clerk, on a form containing:
518	508		(i) the name and address of each registrant;
519	509		(ii) the information on the farm product or products
520	510		that the registrant is requesting;
521	511		(iii) the name of each county where the product is
522	512		produced or to be produced, or a blanket code
523	513		covering all seventy -seven (77) counties of this
524	514		state; and
525	515		(iv) an authorized signature.
526	516		(d) (i) A copy of those portions of the master list
527	517		covering the information requested by a
528	518		registrant shall be distributed to such
529	519		registrants by the Secretary of State Oklahoma

561	550		(ii) Registrants shall be deemed to be registered only
562	551		as to those portions of the master list for which
563	552		they register, and shall be deemed to have failed
564	553		to register and shall not be considered to be
565	554		registrants as to thos e portions for which they
566	555		do not register.
567	556		(iii) Registrants are subject only to security
568	557		interests shown on the portions of the master
569	558		list which they receive as a consequence of
570	559		registration with the Secretary of State Oklahoma
571	560		County Clerk.
572	561		(iv) If a particular security interest is shown on the
573	562		master list, but was included since the last
574	563		regular distribution of portions of the master
575	564		list to registrants, registrants shall not be
576	565		subject to that security interest;
577	566		(e) The duration of the registration wit h the Secretary of
578	567		State Oklahoma County Clerk of a buyer of farm
579	568		products, commission merchant, selling agent or other
580	569		registrant shall be one (1) year from the effective

610	598		(f) (i) Upon request, within twenty-four (24) hours of
611	599		any inquiry, for information, the Secretary of
612	600		State Oklahoma County Clerk shall provide verbal
613	601		confirmation of the existence or nonexistence of
614	602		any effective financing statement on file. By
615	603		the close of the business day following the day
616	604		on which the request was received, written
617	605		confirmation of the existence of an effective
618	606		financing statement will be provided to buyers of
619	607		farm products, commission merchants, and selling
620	608		agents who have not registered, and o thers who
621	609		request it.
622	610		(ii) The state or political subdivision shall not be
623	611		liable if a loss or claim results from any
624	612		confirmation of the existence or nonexistence of
625	613		any effective financing statement on file in the
626	614		Office of the Secretary of State Oklahoma County
627	615		Clerk’s office made in good faith by an employee
628	616		of the Office of the Secretary of State Oklahoma
629	617		County Clerk’s office as required by the
630	618		provisions of this section.

658	645		(5) (4) The filing in the office of the Secretary of State
659	646		Oklahoma County Cler k under this section shall be in addition to the
660	647		filing requirements provided for in this article.
661	648		(6) (5) A financing or continuation statement covering farm
662	649		products that has not lapsed and which was filed pursuant to this
663	650		title between December 23, 198 6, and October 24, 1988, inclusive,
664	651		and for which no written notice was furnished as provided in Section
665	652		1-9-320.7 of this title, shall become ineffective as to a buyer of
666	653		farm products, commission merchant or selling agent, unless the
667	654		secured party files an effective financing statement in the office
668	655		of the Secretary of State Oklahoma County Clerk .
669	656		(7) (6) An effective financing statement shall not be deemed
670	657		filed in accordance with the provisions of this section until all
671	658		fees authorized by Section 111 o f Title 28 of the Oklahoma Statutes
672	659		relating to the filing of the statement are tendered to the
673	660		Secretary of State Oklahoma County Clerk .
674	661		(8) (7) The secured party shall file a termination statement
675	662		within twenty (20) days after there is no outstanding se cured
676	663		obligation or commitment to make advances, incur obligations or
677	664		otherwise give value. The termination statement shall refer to the
678	665		unique document ID number. The secured party shall not be required
679	666		to file a termination statement if the debtor, in writing, addressed
680	667		to the secured party, requests that a termination not be filed. The
681	668		request shall be signed by the debtor or an authorized

709	695		representative and the request may be made at any time prior to the
710	696		expiration date of an effective financing sta tement set forth
711	697		herein. If the affected secured party fails to file a termination
712	698		statement as required by this subsection, the party shall be liable
713	699		to the Secretary of State Oklahoma County Clerk for Five Hundred
714	700		Dollars ($500.00). In addition the aff ected secured party shall be
715	701		liable to the debtor for any loss caused to the debtor by the
716	702		failure to terminate the effective financing statement.
717	703		(9) (8) The Attorney General Oklahoma County District Attorney
718	704		shall be responsible for enforcing the provis ions of subsection (8)
719	705		(7) of this section on behalf of the Secretary of State Oklahoma
720	706		County Clerk and is authorized to take appropriate actions to
721	707		collect any penalties owed to the Secretary of State Oklahoma County
722	708		Clerk pursuant to subsection (8) (7) of this section. When
723	709		collected, the Oklahoma County District Attorney General shall cause
724	710		the penalty to be deposited into the Central Filing System Revolving
725	711		Fund Oklahoma County Clerk’s Uniform Commercial Code Central Filing
726	712		Fund created pursuant to Section 276.3 of Title 62 of the Oklahoma
727	713		Statutes Section 1-9-525.1 of Title 12A of the Oklahoma Statutes .
728	714		(9) As the purpose of an effective financing statement filing
729	715		is to ensure that a joint check is made payable to the debtor and
730	716		all applicable secure d parties, there shall be no priority among
731	717		filings. Filings shall be processed according to the order in which
732	718		they were filed, as recorded in a timestamp within the filing.

768	753		SECTION 5. AMENDATORY 12A O.S. 2021, Section 1 -9-525, is

817	801		(e) This section does not require a fee with respect to a
818	802		record of a mortgage which is effective as a financing statement
819	803		filed as a fixture filing or as a financing statement covering as -
820	804		extracted collateral or timber to be cut under subsection (c) of
821	805		Section 1-9-502 of this title. However, the recording and
822	806		satisfaction fees that otherwise would be applicable to the record
823	807		of the mortgage apply pursuant to paragraphs 1, 2, 4, 7, 11, 15 an d
824	808		16 of subsection A of Section 32 of Title 28 of the Oklahoma
825	809		Statutes.
826	810		(f) The fee for providing certified copies shall be One Dollar
827	811		($1.00) per page regardless of medium.
828	812		(g) The fee for providing bulk data of indexed records as
829	813		described in subsecti on (f) of Section 1-9-523 of this title is as
830	814		follows:
831	815		(1) Five Hundred Dollars ($500.00) for the initial database
832	816		history.
833	817		(2) Fifty Dollars ($50.00) for weekly updates to the database.

863	846		clearing house or by a nationally recognized debit or credit card.
864	847		If payment is made by a credit or debit card, the filing office may

866	849		the acceptance of the payment. The filing office may enter into
867	850		contracts for credit card processing services according to
868	851		applicable county purchasing laws or may enter into agreements with
869	852		the State Treasurer to participate in any credit card pr ocessing
870	853		agreements entered into by the State Treasurer .
871	854		(i) In addition to the other fees provided by law, the Oklahoma
872	855		County Clerk shall, upon the effective date of the central filing
873	856		system provided for in Section 1-9-320.6 of this title, collect the
874	857		following fees:

876	859		County Clerk’s office pursuant to Section 1 -9-320.6 of this title,

1019	999		(C) In providing for the transfer of the information
1020	1000		specified by this paragraph, the Oklahoma County Clerk
1021	1001		shall ensure the integrity of confidential information
1022	1002		through data security measures, internal contro ls, and
1023	1003		appropriate database management; and
1024	1004		(7) For issuing a written confirmation of the existence or
1025	1005		nonexistence of active effective financing statements on file for a
1026	1006		debtor in the Oklahoma County Clerk’s office, Six Dollars ($6.00).
1027	1007		(j) All fees shall be properly accounted for and shall be paid
1028	1008		to the Oklahoma County Clerk monthly. The fees generated by
1029	1009		subsection (i) of this section shall be deposited to the credit of
1030	1010		the Oklahoma County Clerk’s Uniform Commercial Code Central Filing
1031	1011		Fund created pursuant to Section 1 -9-525.1 of this title.
1032	1012		SECTION 6. AMENDATORY 28 O.S. 2021, Section 111, as

1274	1249		acted and, where appropriate, the identity of the seal or stamp
1275	1250		which it bears; provided, however, a fee of Ten Dollars ($10.00)
1276	1251		shall be collected for any apostille requeste d for an international
1277	1252		adoption not to exceed One Hundred Dollars ($100.00) for the
1278	1253		adoption of each child; and
1279	1254		11. For each service rendered and not specified in this
1280	1255		section, such fees as are allowed for similar services in other
1281	1256		cases.
1282	1257		B. All fees shall be properly accounted for and shall be paid
1283	1258		into the State Treasury monthly. The fees generated by paragraphs
1284	1259		1, 2, 10 and 11 of subsection A of this section shall be deposited
1285	1260		to the credit of the Revolving Fund for the Office of the Secretary
1286	1261		of State created pursuant to Section 276.1 of Title 62 of the
1287	1262		Oklahoma Statutes. The fees generated by paragraphs 3 through 9 of
1288	1263		subsection A of this section and other fees collected by the central
1289	1264		filing system shall be deposited to the credit of the Central Fi ling
1290	1265		System Revolving Fund created pursuant to Section 276.3 of Title 62
1291	1266		of the Oklahoma Statutes.
