7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. NEW LAW A new section of law to be cod ified
7777 in the Oklahoma Statutes as Section 16.2 of Title 76, unless there
7878 is created a duplication in numbering, reads as follows:
7979 A. As used in this section:
8080 1. “Bodily injury” means any physical injury, any mental,
8181 psychological, or emotional injury, de ath, or any combination
8282 thereof;
8383 2. “Criminal act of another ” means any act or conduct which is
8484 prohibited by law and could result in punishment by a governmental
8585 entity; and
8686 3. “Property damage” means any injury to or loss of use of real
8787 or personal property, or both.

139139 B. No person or entity shall have civil liability under any
140140 theory of law or equity for bodily injury or property damage arising
141141 out of or resulting from the criminal act of another, including
142142 where committed by an employee or agent, excep t where the person or
143143 entity upon which such civil liability is sought to be imposed has
144144 first been convicted of being a criminal accomplice in the
145145 commission of such criminal act.
146146 C. The immunity from civil liability required by this section
147147 shall apply regardless of whether the person who committed the
148148 criminal act which caused b odily injury or property damage is
149149 apprehended, prosecuted, or convicted as a result of the criminal
150150 conduct.
151151 D. The provisions of this section provide immunity from civil
152152 liability for simple negligence but do not provide immunity for
153153 willful, wanton, or malicious acts of negligence or for gross
154154 negligence.
155155 SECTION 2. It being immediately necessary for the preservation
156156 of the public peace, health or safety, an e mergency is hereby
157157 declared to exist, by reason whereof this act shall take ef fect and
158158 be in full force from and after its passage and approval.
