7777 BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE
7878 1ST SESSION OF THE 60TH OKLAHOMA LEGISLATURE:
7979 SECTION 1. The Secretary of State shall refer to the people for
8080 their approval or rejection, as and in the manner provided by law,
8181 the following proposed amendment to Section 3 of Articl e VII-B of
8282 the Oklahoma Constitution to read as follows:
8383 Section 3. (a) A. There is established as a part of the
8484 Judicial Department a Judicial Nominating Commission of fifteen (15)
8585 members, to consist of:
8686 (1) six 1. Six members to be appointed by the Governor, which
8787 shall include at least one from each congressional district
8888 established by the Statutes of Oklahoma and existing at the date of

140140 the adoption of this Article, none of whom shall be admitted to
141141 practice law in the State of Oklahoma or have an y immediate family
142142 member who has been admitted to the practice of law in the State of
143143 Oklahoma or any other state;
144144 (2) six 2. Six members, which shall include at least one from
145145 each congressional district established by the Statutes of Oklahoma
146146 and existing at the date of the adoption of this Article who are,
147147 however, members of the Oklahom a Bar Association and who have been
148148 elected by the other active members of their district under
149149 procedures adopted by the Board of Governors of the Oklahoma Bar
150150 Association, until changed by statute; and
151151 (3) three 3. Three members at large who shall not have been
152152 admitted to the practice of law in the State of Oklahoma or any
153153 other state or have any immediate family member who has been
154154 admitted to the practice of law in the State of Oklahoma or any
155155 other state but who shall be a resident of the State of O klahoma,
156156 one to be selected by not less than eight members of the Nominating
157157 Commission. In the event eight members of the Commission cannot
158158 agree upon the member at large within thirty (30) days of the
159159 initial organization of the Commission or within thirty (30) days of
160160 a vacancy in the member at large position, the Governor shall make
161161 the appointment of the member at large; one to be selected by the
162162 President Pro Tempore of the Senate; and one to be selected by the

214214 Speaker of the House of Representatives . No more than two members
215215 at large shall belong to any one political party.
216216 The Commission shall elect one of its members to serve as chair
217217 for a term of one (1) yea r.
218218 The six lay members of the Commission who are appointed by the
219219 Governor shall be appointed within ninety (90) days from the date
220220 that this Article becomes effective. Two members shall be appointed
221221 for a term of two (2) years, two members for a term of four (4)
222222 years, and two members for a term of six (6) years. The Oklahoma
223223 Bar Association shall hold its election and certify to the Secretary
224224 of State its members within ninety (90) days from the effective date
225225 of this Article, two of whom shall be elect ed for a term of two (2)
226226 years, two for a term of four (4) years, and two for a term of six
227227 (6) years. Thereafter all of the members of the Commission, whether
228228 elected or appointed, shall serve for a term of six (6) years,
229229 except that the member at large shall serve for a term of two (2)
230230 years.
231231 (b) B. Vacancies arising during the term of any lay
232232 commissioner, other than the member at large, shall be filled by
233233 appointment by the Governor for the remainder of his or her term.
234234 Vacancies of any lawyer commis sioner shall be filled by the Board of
235235 Governors of the Oklahoma Bar Association for the remainder of his
236236 or her term.

288288 (c) C. In the event of vacancy in the member at large position,
289289 the said vacancy shall be filled in the same manner as the original
290290 selection.
291291 (d) Of those Commissioners named by the Governor, not more than
292292 three shall belong to any one political party.
293293 (e) D. The concurrence of the majority of Commissioners in
294294 office at the time shall be sufficient to decide any question,
295295 unless otherwise provided herein. The Commission shall have
296296 jurisdiction to determine whether the qualifications of nominees to
297297 hold Judicial Office have been met and to determine the existence of
298298 vacancies on the Commission.
299299 (f) E. No Commissioner, while a member of the Commission, shall
300300 hold any other public office by election or appointment or any
301301 official position in a political party and he or she shall not be
302302 eligible, while a member of the Commission and for five (5) years
303303 thereafter, for nomination as a Judicia l Officer.
304304 (g) F. Commissioners shall serve without compensation but the
305305 Legislature shall provide funds to reimburse them for their
306306 necessary travel and lodging expenses while performing their duties
307307 as such Commissioners.
308308 (h) G. No Commissioner shall b e permitted to succeed himself or
309309 herself.

361361 (i) H. As used herein, the words “Oklahoma Bar Association”

363363 organized Bar of this state.
364364 SECTION 2. The Ballot Title for the propose d Constitutional
365365 amendment as set forth in SECTION 1 of this resolution shall be in

369369 THE GIST OF THE PROPOSITION IS AS FOLLOWS:
370370 This measure amends Section 3 of Article 7-B of the Oklahoma
371371 Constitution. The current law requires certain appointed
372372 members to be affiliated with a political party. This amendment
373373 removes that requirement.
