77	77	BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE
78	78	1ST SESSION OF THE 60TH OKLAHOMA LEGISLATURE:
79	79	SECTION 1. The Secretary of State shall refer to the people for
80	80	their approval or rejection, as and in the manner provided by law,
81	81	the following proposed amendment to Section 3 of Articl e VII-B of
82	82	the Oklahoma Constitution to read as follows:
83	83	Section 3. (a) A. There is established as a part of the
84	84	Judicial Department a Judicial Nominating Commission of fifteen (15)
85	85	members, to consist of:
86	86	(1) six 1. Six members to be appointed by the Governor, which
87	87	shall include at least one from each congressional district
88	88	established by the Statutes of Oklahoma and existing at the date of

140	140	the adoption of this Article, none of whom shall be admitted to
141	141	practice law in the State of Oklahoma or have an y immediate family
142	142	member who has been admitted to the practice of law in the State of
143	143	Oklahoma or any other state;
144	144	(2) six 2. Six members, which shall include at least one from
145	145	each congressional district established by the Statutes of Oklahoma
146	146	and existing at the date of the adoption of this Article who are,
147	147	however, members of the Oklahom a Bar Association and who have been
148	148	elected by the other active members of their district under
149	149	procedures adopted by the Board of Governors of the Oklahoma Bar
150	150	Association, until changed by statute; and
151	151	(3) three 3. Three members at large who shall not have been
152	152	admitted to the practice of law in the State of Oklahoma or any
153	153	other state or have any immediate family member who has been
154	154	admitted to the practice of law in the State of Oklahoma or any
155	155	other state but who shall be a resident of the State of O klahoma,
156	156	one to be selected by not less than eight members of the Nominating
157	157	Commission. In the event eight members of the Commission cannot
158	158	agree upon the member at large within thirty (30) days of the
159	159	initial organization of the Commission or within thirty (30) days of
160	160	a vacancy in the member at large position, the Governor shall make
161	161	the appointment of the member at large; one to be selected by the
162	162	President Pro Tempore of the Senate; and one to be selected by the

214	214	Speaker of the House of Representatives . No more than two members
215	215	at large shall belong to any one political party.
216	216	The Commission shall elect one of its members to serve as chair
217	217	for a term of one (1) yea r.
218	218	The six lay members of the Commission who are appointed by the
219	219	Governor shall be appointed within ninety (90) days from the date
220	220	that this Article becomes effective. Two members shall be appointed
221	221	for a term of two (2) years, two members for a term of four (4)
222	222	years, and two members for a term of six (6) years. The Oklahoma
223	223	Bar Association shall hold its election and certify to the Secretary
224	224	of State its members within ninety (90) days from the effective date
225	225	of this Article, two of whom shall be elect ed for a term of two (2)
226	226	years, two for a term of four (4) years, and two for a term of six
227	227	(6) years. Thereafter all of the members of the Commission, whether
228	228	elected or appointed, shall serve for a term of six (6) years,
229	229	except that the member at large shall serve for a term of two (2)
230	230	years.
231	231	(b) B. Vacancies arising during the term of any lay
232	232	commissioner, other than the member at large, shall be filled by
233	233	appointment by the Governor for the remainder of his or her term.
234	234	Vacancies of any lawyer commis sioner shall be filled by the Board of
235	235	Governors of the Oklahoma Bar Association for the remainder of his
236	236	or her term.

288	288	(c) C. In the event of vacancy in the member at large position,
289	289	the said vacancy shall be filled in the same manner as the original
290	290	selection.
291	291	(d) Of those Commissioners named by the Governor, not more than
292	292	three shall belong to any one political party.
293	293	(e) D. The concurrence of the majority of Commissioners in
294	294	office at the time shall be sufficient to decide any question,
295	295	unless otherwise provided herein. The Commission shall have
296	296	jurisdiction to determine whether the qualifications of nominees to
297	297	hold Judicial Office have been met and to determine the existence of
298	298	vacancies on the Commission.
299	299	(f) E. No Commissioner, while a member of the Commission, shall
300	300	hold any other public office by election or appointment or any
301	301	official position in a political party and he or she shall not be
302	302	eligible, while a member of the Commission and for five (5) years
303	303	thereafter, for nomination as a Judicia l Officer.
304	304	(g) F. Commissioners shall serve without compensation but the
305	305	Legislature shall provide funds to reimburse them for their
306	306	necessary travel and lodging expenses while performing their duties
307	307	as such Commissioners.
308	308	(h) G. No Commissioner shall b e permitted to succeed himself or
309	309	herself.

369	369	THE GIST OF THE PROPOSITION IS AS FOLLOWS:
370	370	This measure amends Section 3 of Article 7-B of the Oklahoma
371	371	Constitution. The current law requires certain appointed
372	372	members to be affiliated with a political party. This amendment
373	373	removes that requirement.

377	377	SECTION 3. The President Pro Tempore of the Senate shall,
