79	79	BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE
80	80	1ST SESSION OF THE 60TH OKLAHOMA LEGISLATURE:
81	81	SECTION 1. The Secretary of State shall refer to the people for
82	82	their approval or rejection, as and in the manner provided by law,
83	83	the following proposed amendment s to Sections 1 and 23 of Article VI
84	84	of the Oklahoma Constitution to read as follows:
85	85	Section 1. A. The Executive authority of the state shall be
86	86	vested in a Governor, Lieutenant Governor, Secretary of State, State
87	87	Auditor and Inspector, Attorney General, State Treasurer,
88	88	Superintendent of Public Instruction, Commissioner of Labor,
89	89	Insurance Commissioner of Insurance, and other officers provided by

142	142	and public records, books , and papers at the seat of government, and
143	143	shall perform such duties as may be designated in this Constitution
144	144	or prescribed by law.
145	145	B. The Secretary of State shall be appointed by the Governor by
146	146	and with the consent of the Senate for a term of four (4) years to
147	147	run concurrently with the term of the Governor.
148	148	C. Upon expiration of the term of the Insurance Commissioner
149	149	elected in 2026, the Insurance Commissioner shall be appointed by
150	150	the Governor by and with the consent of the Senate and shall serve
151	151	at the pleasure of the Governor.
152	152	Section 23. A. There shall be elected by the qualified
153	153	electors of the State, at the first genera l election, a chief
154	154	officer of the Insurance Department, who shall be styled the
155	155	“Insurance Commissioner”, whose term of office shall be four years :
156	156	Provided, That the first term of the Insurance Commissioner so
157	157	elected, shall expire at the time of the exp iration of the term of
158	158	office of the first Governor elected The Insurance Commissioner
159	159	shall be appointed by the Governor by and with the consent of the
160	160	Senate as provided in Section 1 of this article . The Insurance
161	161	Commissioner shall be at least twenty -five (25) years of age and
162	162	well versed in insurance matters.
163	163	B. No person shall be eligi ble to serve as Insurance
164	164	Commissioner for a period of time in excess of eight (8) years .

216	216	Such years need not be consecutive. Any years served by a person
217	217	elected or appointed to serve less than a full term to fill a
218	218	vacancy in such office shall not be included in the limitation set
219	219	forth herein. Any person serving in such position at the time of
220	220	passage of this amendment shall be eligible to complete the term for
221	221	which he or she has been elected and shall be eligible to serve an
222	222	additional eight (8) yea rs thereafter, notwithstanding the
223	223	provisions of this amendment. The Legislature is hereby authorized
224	224	to enact laws to implement the provisions of this subsection.
225	225	SECTION 2. The Ballot Title for the proposed Constitutional
226	226	amendments as set forth in SECTION 1 of this resolution shall be in
227	227	the following form:

230	230	THE GIST OF THE PROPOSITI ON IS AS FOLLOWS:
231	231	This measure amends the Oklahoma Constitution. It amends
232	232	Sections 1 and 23 of Article 6. It directs the Governor to
233	233	appoint the Insurance Commissioner by and with the consent of
234	234	the Senate. The Commissioner would serve at the pleasure of the
235	235	Governor. The first appointment would be made upon expiration
236	236	of the term of the person elected in 202 6. It removes the term
237	237	limits for the Insurance Commissioner.
