7979 BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE
8080 1ST SESSION OF THE 60TH OKLAHOMA LEGISLATURE:
8181 SECTION 1. The Secretary of State shall refer to the people for
8282 their approval or rejection, as and in the manner provided by law,
8383 the following proposed amendment s to Sections 1 and 23 of Article VI
8484 of the Oklahoma Constitution to read as follows:
8585 Section 1. A. The Executive authority of the state shall be
8686 vested in a Governor, Lieutenant Governor, Secretary of State, State
8787 Auditor and Inspector, Attorney General, State Treasurer,
8888 Superintendent of Public Instruction, Commissioner of Labor,
8989 Insurance Commissioner of Insurance, and other officers provided by

141141 law and this Constitution, each of who m shall keep his or her office
142142 and public records, books , and papers at the seat of government, and
143143 shall perform such duties as may be designated in this Constitution
144144 or prescribed by law.
145145 B. The Secretary of State shall be appointed by the Governor by
146146 and with the consent of the Senate for a term of four (4) years to
147147 run concurrently with the term of the Governor.
148148 C. Upon expiration of the term of the Insurance Commissioner
149149 elected in 2026, the Insurance Commissioner shall be appointed by
150150 the Governor by and with the consent of the Senate and shall serve
151151 at the pleasure of the Governor.
152152 Section 23. A. There shall be elected by the qualified
153153 electors of the State, at the first genera l election, a chief
154154 officer of the Insurance Department, who shall be styled the
155155 “Insurance Commissioner”, whose term of office shall be four years :
156156 Provided, That the first term of the Insurance Commissioner so
157157 elected, shall expire at the time of the exp iration of the term of
158158 office of the first Governor elected The Insurance Commissioner
159159 shall be appointed by the Governor by and with the consent of the
160160 Senate as provided in Section 1 of this article . The Insurance
161161 Commissioner shall be at least twenty -five (25) years of age and
162162 well versed in insurance matters.
163163 B. No person shall be eligi ble to serve as Insurance
164164 Commissioner for a period of time in excess of eight (8) years .

216216 Such years need not be consecutive. Any years served by a person
217217 elected or appointed to serve less than a full term to fill a
218218 vacancy in such office shall not be included in the limitation set
219219 forth herein. Any person serving in such position at the time of
220220 passage of this amendment shall be eligible to complete the term for
221221 which he or she has been elected and shall be eligible to serve an
222222 additional eight (8) yea rs thereafter, notwithstanding the
223223 provisions of this amendment. The Legislature is hereby authorized
224224 to enact laws to implement the provisions of this subsection.
225225 SECTION 2. The Ballot Title for the proposed Constitutional
226226 amendments as set forth in SECTION 1 of this resolution shall be in
227227 the following form:

230230 THE GIST OF THE PROPOSITI ON IS AS FOLLOWS:
231231 This measure amends the Oklahoma Constitution. It amends
232232 Sections 1 and 23 of Article 6. It directs the Governor to
233233 appoint the Insurance Commissioner by and with the consent of
234234 the Senate. The Commissioner would serve at the pleasure of the
235235 Governor. The first appointment would be made upon expiration
236236 of the term of the person elected in 202 6. It removes the term
237237 limits for the Insurance Commissioner.
