6565 A Resolution affirming Oklahoma’s right to opt out of
6666 the federal REAL ID system ; supporting the state ’s
6767 obligation to offer resid ents a meaningful choice
6868 between REAL ID-compliant and -noncompliant

7575 WHEREAS, the Legislature finds that the enactment into law by
7676 the United States Congress of t he federal REAL ID Act of 2005,
7777 Public Law Number 109 -13, is an action that individ ual Oklahomans do
7878 have the right to refuse to comply with the enactment under the
7979 principles of federalism protected by the Tenth Amendment to the
8080 United States Constitution ; and
8181 WHEREAS, a REAL ID-compliant driver license o r identification
8282 card requires the collection and retention of personal and sensitive
8383 biometric information from each applicant ; and
8484 WHEREAS, the State of Oklahoma does provide an option for
8585 Oklahomans to choose between a REAL ID -compliant or a REAL ID -
8686 noncompliant driver license o r identification card; and

138138 WHEREAS, this choice provides a distinction without a difference
139139 as the state, in fact, collects, stores , and shares all applicants ’
140140 personal and sensitive biometric information in exactly the same
141141 manner for both the REAL ID -compliant and the REAL ID -noncompliant
142142 option.
143143 NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE 1ST SESSION
144144 OF THE 60TH OKLAHOMA LEGISLATURE:
145145 THAT the Oklahoma State Senate recogn izes that Oklahomans opting
146146 out of REAL ID understand the limitations for federal p urposes of
147147 the REAL ID-noncompliant driver license or identification card, and
148148 they expect in return that their personal information will not be
149149 shared with the federal gove rnment absent a court -approved warrant.
150150 THAT the Oklahoma State Senate affirms the right of Oklahomans
151151 to refuse participation in the federal REAL ID program and urges the
152152 State of Oklahoma to continue offering both compliant and
153153 noncompliant identificatio n options, and further believes that the
154154 State of Oklahoma should protect the perso nal information of our
155155 citizens who choose a REAL ID -noncompliant driver license or
156156 identification card by prohibiting the sharing of their personal
157157 identifiable information including biometric samples, biometric
158158 data, or biometric templates, absent a court -approved warrant.
159159 THAT the Oklahoma State Senate recognizes the importance of
160160 protecting Oklahomans’ right to refuse participation in the
161161 voluntary federal REAL ID system, supporting a genuine choice
