67	67	obligation to offer resid ents a meaningful choice

75	75	WHEREAS, the Legislature finds that the enactment into law by
76	76	the United States Congress of t he federal REAL ID Act of 2005,
77	77	Public Law Number 109 -13, is an action that individ ual Oklahomans do
78	78	have the right to refuse to comply with the enactment under the
79	79	principles of federalism protected by the Tenth Amendment to the
80	80	United States Constitution ; and
81	81	WHEREAS, a REAL ID-compliant driver license o r identification
82	82	card requires the collection and retention of personal and sensitive
83	83	biometric information from each applicant ; and
84	84	WHEREAS, the State of Oklahoma does provide an option for
85	85	Oklahomans to choose between a REAL ID -compliant or a REAL ID -
86	86	noncompliant driver license o r identification card; and

139	139	as the state, in fact, collects, stores , and shares all applicants ’
140	140	personal and sensitive biometric information in exactly the same
141	141	manner for both the REAL ID -compliant and the REAL ID -noncompliant

143	143	NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE 1ST SESSION
144	144	OF THE 60TH OKLAHOMA LEGISLATURE:
145	145	THAT the Oklahoma State Senate recogn izes that Oklahomans opting
146	146	out of REAL ID understand the limitations for federal p urposes of
147	147	the REAL ID-noncompliant driver license or identification card, and
148	148	they expect in return that their personal information will not be
149	149	shared with the federal gove rnment absent a court -approved warrant.
150	150	THAT the Oklahoma State Senate affirms the right of Oklahomans
151	151	to refuse participation in the federal REAL ID program and urges the
152	152	State of Oklahoma to continue offering both compliant and
153	153	noncompliant identificatio n options, and further believes that the
154	154	State of Oklahoma should protect the perso nal information of our
155	155	citizens who choose a REAL ID -noncompliant driver license or
156	156	identification card by prohibiting the sharing of their personal
157	157	identifiable information including biometric samples, biometric
158	158	data, or biometric templates, absent a court -approved warrant.
159	159	THAT the Oklahoma State Senate recognizes the importance of
160	160	protecting Oklahomans’ right to refuse participation in the
161	161	voluntary federal REAL ID system, supporting a genuine choice
