SECTION 3.In addition to and not in lieu of any other appropriation, there is appropri- ated to the Oregon Business Development Department, for the biennium beginning July 1, 2025, out of the General Fund, the amount of $1,685,000, for infrastructure, for grants ap- proved in section 497, chapter 114, Oregon Laws 2024. Notwithstanding any other law limiting expenditures, the amount of $214,967,183 is established for the biennium beginning July 1, 2025, as the maximum limit for payment of expenses by the Oregon Business Development Department, from American Rescue Plan Act Coronavirus State Fiscal Recovery Fund moneys received by the Oregon Department of Administrative Services and transferred to the Oregon Business Development Department, for infrastructure, for grants approved in section 196, chapter 669, Oregon Laws 2021. For the biennium beginning July 1, 2025, expenditures by the Oregon Busi- ness Development Department are not limited for: (1) Loans from the following funds: (a) Oregon Business Development Fund (ORS 285B.092), Oregon Entrepreneurial Devel- opment Loan Fund (ORS 285B.758), Credit Enhancement Fund (ORS 285B.215) and Small Business Expansion Loan Fund (ORS 285B.133). (b) Special Public Works Fund (ORS 285B.455), Water Fund (ORS 285B.563), Marine Nav- igation Improvement Fund (ORS 777.267), Oregon Port Revolving Fund (ORS 285A.708), Safe Drinking Water Revolving Loan Fund (ORS 285A.213), Brownfields Redevelopment Fund (ORS 285A.188) and Oregon Brownfield Properties Revitalization Fund (ORS 285A.198). (2) Debt service, excluding debt service on lottery revenue bonds and general obligation bonds. SECTION 17. This 2025 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2025 Act takes effect July 1, 2025. [4]
