Provides that department actions related to the update and submission are not subject to the Administrative Procedures Act. A BILL FOR AN ACT Relating to a habitat conservation plan. Be It Enacted by the People of the State of Oregon: SECTION 1. (1) Notwithstanding any contrary provision of law, the State Forestry De- partment shall, as soon as practicable: (a) Update the draft Western Oregon State Forests Habitat Conservation Plan (February 2022) to adopt a proposed approach that is consistent with Alternative 5: Increased Timber Harvest in the Draft Environmental Impact Statement for the Western Oregon State Forests Habitat Conservation Plan (March 2022 at ES.5.5) prepared by the National Oceanic and At- mospheric Administration. (b) Submit the updated habitat conservation plan described in paragraph (a) of this sub- section to the United States Fish and Wildlife Service and the National Marine Fisheries Service. (2) Notwithstanding any contrary provision of law, department actions to implement the requirements of subsection (1) of this section are not subject to the provisions of ORS chapter183.
