A BILL FOR AN ACT Relating to urban reserves; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. Section 2 of this 2025 Act is added to and made a part of ORS 197A.230 to 197A.250. SECTION 2. On or before July 1, 2026, the Land Conservation and Development Com- mission shall amend its rules related to the prioritization of lands being added to an urban reserve in order to: (1) Raise the priority for adding lands that are zoned for exclusive farm use and have poor quality soils, limited water rights or minimal or no current or recent active farm use; and (2) Allow local governments to lower the priority of lands that are used as rural resi- dential subdivisions or partitions or other rural planned developments if the local govern- ment conducts an analysis showing that: (a) Expanding urban services, as defined in ORS 195.065, would be cost prohibitive on those lands; or (b) Other factors make it unlikely to increase housing capacity on those lands. SECTION 3. This 2025 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2025 Act takes effect on its passage.
