A BILL FOR AN ACT Relating to foster parent compensation; and prescribing an effective date. Be It Enacted by the People of the State of Oregon: SECTION 1. (1) As used in this section: (a) “Child in care” has the meaning given that term in ORS 418.257. (b) “Foster home” has the meaning given that term in ORS 418.625. (2) The Department of Human Services shall adopt by rule a compensation rate structure for an individual who maintains a foster home for a child in care, that is necessary to ensure that the individual is appropriately compensated to meet the needs of the child in care. The compensation rate structure adopted under this section must include: (a) A minimum base rate for each child in care that is at least 90 percent of the United States Department of Agriculture’s most recent estimated cost to raise a child of the child in care’s age; (b) Mileage reimbursement for the child in care’s transportation that is required as a part of the child in care’s case, including to and from visits, assessments and court ap- pointments; (c) Reimbursement for actual costs incurred by the individual for child care for the child in care, up to the monthly maximum allowable child care costs adopted by the Division of Child Support of the Department of Justice; (d) Reimbursement for actual costs incurred for up to 16 hours per month of respite care;and (e) Appropriate rate enhancements for a child in care who is an infant or has exceptional needs. SECTION 2. (1) Section 1 of this 2025 Act becomes operative on January 1, 2026. (2) The Department of Human Services may take any action before the operative date specified in subsection (1) of this section that is necessary to enable the department to carry out section 1 of this 2025 Act and to exercise, on and after the operative date specified in subsection (1) of this section, all of the duties, functions and powers conferred on the de- NOTE:Matter in boldfaced type in an amended section is new; matter [italic and bracketed] is existing law to be omitted.
