Extends the maximum number of months for the reconsideration of denied applications by the parole board for parole for certain violent felony offenses from 24 months to 60 months.
Requires that any rules or regulations promulgated by the department of environmental conservation pursuant to the climate action fund are subject to a vote of the legislature and must be approved by a majority vote prior to implementation.
Enacts the "dismantling student antisemitism act", or "DSA act"; requires mandatory sensitivity training that includes the topic of antisemitism; includes reporting requirements regarding antisemitism complaints and disciplinary processes.
Includes aggravated threat of mass harm, making a threat of mass harm, aggravated harassment in the second degree, harassment in the first degree, menacing in the third degree, menacing in the second degree, menacing in the first degree, and aggravated harassment in the first degree in being eligible for bail; makes aggravated threat of mass harm and making a threat of mass harm eligible to be considered hate crimes; increases the penalties for aggravated threat of mass harm and making a threat of mass harm.
Enacts "the combating campus antisemitism act"; prohibits the granting of tuition assistance awards to any student who has knowingly engaged in promoting antisemitism in a manner that is directed to inciting or producing imminent lawless action and is likely to incite or produce such action, that constitutes "true threats"; makes related provisions.
Directs the division of homeland security and emergency services to conduct a study on the public safety implications of the electrification of buildings and transportation in the context of emergency response and to issue a report on the findings and recommendations as a result of such study; exempts emergency services vehicles and heavy equipment from the requirements of the climate leadership and community protection act of 2019; prohibits the use of battery packs which contain cobalt mined components for primary propulsion of emergency services vehicles.
Establishes a civil cause of action for employees who are subjected to an abusive work environment; provides employers shall be vicariously liable for such work environment.
Requires affordable housing funded by the state be used for veterans and people with disabilities, with each group receiving five percent of such affordable housing.
Provides for medicaid reimbursement for ambulance services when treatment in place is administered and/or when transportation is provided to alternative health care settings instead of a general hospital.
Requires law enforcement and courts to notify the United States Immigration and Customs Enforcement agency (ICE) when an arrested person or defendant is not a United States citizen; adjusts certain maximum sentences for class A misdemeanors and unclassified misdemeanors; requires notification to be made to the United States Immigration and Customs Enforcement agency prior to the release of certain noncitizens; repeals provisions of the "protect our courts act".
Relates to the establishment of a waiver for child care learning pods; provides that unlicensed and unregulated child care learning pods may operate if there are otherwise no violations of laws or codes, rules, and regulations of New York and such child care learning pod is compliant with the local laws, codes, rules, and regulations of such local municipality in which they are located and operated; provides for civil penalty for violations.
Authorizes the county of Cattaraugus assessor to accept an application for a real property tax exemption from Olean Community Theatre, Inc. for all of the 2021-2022 school taxes and all of the 2022 general taxes.
