RELATING TO STATE AFFAIRS AND GOVERNMENT -- FORT ADAMS FOUNDATIO N

It is enacted by the General Assembly as follows: 
SECTION 1. Section 42-57-1 and 42-57-3 of the General Laws in Chapter 42-57 entitled 1 
"Fort Adams Foundation" are hereby amended to read as follows: 2 
42-57-1. Foundation created. 3 
The Fort Adams foundation (“the foundation”) is created a body, corporate and politic, to 4 
promote interest in and to plan, develop, coordinate, encourage, facilitate, set standards, and 5 
programs and projects relating to the restoration, renovation, reconstruction, and use of the 6 
historical Fort Adams structure State Park. 7 
42-57-3. Organization of foundation. 8 
(a) The foundation shall consist of the director of the department of environmental 9 
management, or his or her designee, a representative of the division of parks and recreation 10 
appointed by the director of the department of environmental management and four (4) three (3) 11 
public members, appointed by the governor with the advice and consent of the senate. In making 12 
appointments under this section, the governor shall solicit and give due consideration to the 13 
recommendations of the following persons, communities and organizations: 14 
(1) Rhode Island historical preservation commission; 15 
(2) City of Newport; and 16 
(3) Fort Adams Trust board of directors; and. 17 
(4) Chief of the department of environmental management division of parks and recreation. 18

In making appointments under this section, the governor shall also give due consideration 5 
to the appointment of persons with expertise and experience in the fields of American history, 6 
military history, historic preservation, museums, education, historic architecture and/or 7 
engineering. 8 
(b) The director of the department of environmental management, or his or her designee 9 
shall act as chairperson. 10 
(c) The power of the foundation shall vest in and be exercised by or under the authority of 11 
its members, three (3) of whom shall constitute a quorum for the transaction of business. 12 
(d) Employees of the foundation shall be selected and appointed by the foundation, and 13 
shall be vested with those powers and duties that the foundation may determine. 14 
(e) All appointed members of the foundation as of the effective date of this act shall cease 15 
to be members of the foundation as of the effective date of this act. The governor shall thereupon 16 
nominate four (4) three (3) members: one of whom shall serve an initial term of one year; one of 17 
whom shall serve an initial term of two (2) years; and two (2) one of whom shall serve an initial 18 
terms term of three (3) years. Thereafter, all appointed members shall be appointed to serve three 19 
(3) year terms. In the event the senate is not in session on the effective date of this act, the governor 20 
may make temporary appointments which shall only be in effect until such time as the senate 21 
reconvenes at which time the governor shall appoint four (4) three (3) members. 22 
SECTION 2. This act shall take effect upon passage. 23

This act would amend the composition of the Fort Adams foundation to include a 1 
representative from the division of parks and recreation in place of a member of the public.  2 
This act would take effect upon passage. 3
