2323 WHEREAS, The General Assembly enacted Chapter 12.4 of Title 42 entitled “The 1
2424 Rhode Island Medicaid Reform Act of 2008”; and 2
2525 WHEREAS, A legislative enactment is required pursuant to Rhode Island General Laws 3
2626 § 42-12.4-1, et seq.; and 4
2727 WHEREAS, Rhode Island General Laws § 42-7.2-5(3)(i) provides that the Secretary of 5
2828 the Executive Office of Health and Human Services is responsible for the review and 6
2929 coordination of any Medicaid section 1115 demonstration waiver requests and renewals as well 7
3030 as any initiatives and proposals requiring amendments to the Medicaid state plan or category II or 8
3131 III changes as described in the demonstration, “with potential to affect the scope, amount, or 9
3232 duration of publicly-funded health care services, provider payments or reimbursements, or access 10
3333 to or the availability of benefits and services provided by Rhode Island general and public laws”; 11
3434 now therefore be it 12
3535 RESOLVED, That, in pursuit of a more cost-effective consumer choice system of care 13
3636 that is fiscally sound and sustainable and that reduces the number of days behaviorally complex 14
3737 patients spend in acute care facilities, the legislature approves the following pilot proposal to 15
3838 amend the demonstration: 16
3939 (1) Implement a behavioral health per diem add-on rate of one hundred seventy-five 17
4040 dollars ($175) for up to one hundred (100) complex patients with behavioral conditions who 18
4141 reside in a nursing facility, have a history of frequent utilization of acute care facilities, and are 19

4545 Medicaid recipients with medically-based mental health or behavioral disorders demonstrating 1
4646 significant behaviors as shown in a minimum of thirty (30) days of clinical behavioral 2
4747 documentation of behavioral health conditions, and the nursing facility is Medicaid certified to 3
4848 provide or facilitate enhanced levels of behavioral healthcare; and be it further 4
4949 RESOLVED, That the Secretary of State be and hereby is authorized and directed to 5
5050 transmit duly certified copies of this resolution to the Governor of the State of Rhode Island, the 6
5151 Rhode Island Department of Health, and to the Rhode Island Executive Office of Health and 7
5252 Human Services. 8
