| 23 | 23 | | SECTION 1. Section 31-44-1.7 of the General Laws in Chapter 31-44 entitled "Mobile and 1 |

| 24 | 24 | | Manufactured Homes" is hereby amended to read as follows: 2 |

| 25 | 25 | | 31-44-1.7. Mobile and manufactured home park operation — License. 3 |
|---|
| 26 | 26 | | (a) A person shall not operate a mobile and manufactured home park without a license. 4 |
|---|
| 27 | 27 | | (b) Upon completion, review, and approval of certifications, the department of business 5 |
|---|
| 28 | 28 | | regulation secretary of housing shall grant a license to operate a mobile and manufactured home 6 |
|---|
| 29 | 29 | | park. 7 |
|---|
| 30 | 30 | | (c) An annual license shall be granted and renewed by the department secretary of housing 8 |
|---|
| 31 | 31 | | based upon the filing of: 9 |
|---|
| 32 | 32 | | (1) Leases and regulations that are applicable to the park; 10 |
|---|
| 33 | 33 | | (2) Certification by the municipality in which the park is located that it is in compliance 11 |
|---|
| 34 | 34 | | with all applicable land use regulations of the municipality; 12 |
|---|
| 35 | 35 | | (3) Certification from the appropriate state agencies or municipal departments that the park 13 |
|---|
| 36 | 36 | | has an adequate and operational sewage disposal system and water supply and that all applicable 14 |
|---|
| 37 | 37 | | state and local taxes have been paid; 15 |
|---|
| 38 | 38 | | (4) Payment of an annual fee of fifteen dollars ($15.00) per occupied site in the park; and 16 |
|---|
| 39 | 39 | | (5) The applicant files a fee schedule with the department secretary of housing. 17 |
|---|
| 40 | 40 | | (d) Certifications for individual sewage disposal systems (ISDS) regulated by the 18 |

| 44 | 44 | | department of environmental management shall be provided by an ISDS designer, licensed 1 |

| 45 | 45 | | pursuant to § 5-56-1, who possesses the appropriate class of license for the type and size of system 2 |

| 46 | 46 | | to be certified and any costs for these certifications shall be the responsibility of the licensee. The 3 |
|---|
| 47 | 47 | | director of the department may by regulation provide for additional requirements and may place 4 |
|---|
| 48 | 48 | | reasonable conditions on the grant of any license. 5 |
|---|
| 49 | 49 | | (e) If a person submits a timely application for renewal of a license and pays the appropriate 6 |
|---|
| 50 | 50 | | fees, the person may continue to operate a mobile and manufactured home park unless notified that 7 |
|---|
| 51 | 51 | | the application for renewal is not approved. In the event anyone is denied a license he or she will 8 |
|---|
| 52 | 52 | | be afforded a hearing before the department secretary of housing. 9 |
