2222 It is enacted by the General Assembly as follows:
2323 SECTION 1. Section 31-44-1.7 of the General Laws in Chapter 31-44 entitled "Mobile and 1
2424 Manufactured Homes" is hereby amended to read as follows: 2
2525 31-44-1.7. Mobile and manufactured home park operation — License. 3
2626 (a) A person shall not operate a mobile and manufactured home park without a license. 4
2727 (b) Upon completion, review, and approval of certifications, the department of business 5
2828 regulation secretary of housing shall grant a license to operate a mobile and manufactured home 6
2929 park. 7
3030 (c) An annual license shall be granted and renewed by the department secretary of housing 8
3131 based upon the filing of: 9
3232 (1) Leases and regulations that are applicable to the park; 10
3333 (2) Certification by the municipality in which the park is located that it is in compliance 11
3434 with all applicable land use regulations of the municipality; 12
3535 (3) Certification from the appropriate state agencies or municipal departments that the park 13
3636 has an adequate and operational sewage disposal system and water supply and that all applicable 14
3737 state and local taxes have been paid; 15
3838 (4) Payment of an annual fee of fifteen dollars ($15.00) per occupied site in the park; and 16
3939 (5) The applicant files a fee schedule with the department secretary of housing. 17
4040 (d) Certifications for individual sewage disposal systems (ISDS) regulated by the 18

4444 department of environmental management shall be provided by an ISDS designer, licensed 1
4545 pursuant to § 5-56-1, who possesses the appropriate class of license for the type and size of system 2
4646 to be certified and any costs for these certifications shall be the responsibility of the licensee. The 3
4747 director of the department may by regulation provide for additional requirements and may place 4
4848 reasonable conditions on the grant of any license. 5
4949 (e) If a person submits a timely application for renewal of a license and pays the appropriate 6
5050 fees, the person may continue to operate a mobile and manufactured home park unless notified that 7
5151 the application for renewal is not approved. In the event anyone is denied a license he or she will 8
5252 be afforded a hearing before the department secretary of housing. 9
5353 SECTION 2. This act shall take effect on January 1, 2025. 10
