21	21	It is enacted by the General Assembly as follows:
22	22	SECTION 1. Chapter 40-8 of the General Laws entitled "Medical Assistance" is hereby 1
23	23	amended by adding thereto the following sections: 2
24	24	40-8-33. Dental care - Coverage - Dental surgical centers. 3
25	25	The department of human services shall provide for medical assistance under this chapter 4
26	26	for payment of medical assistance for charges incurred, including any and all facility fees, 5
27	27	medications and anesthetics provided in conjunction with dental care that is rendered to a pediatric 6
28	28	or adult recipient: 7
29	29	(1) In a hospital or ambulatory surgical center; or 8
30	30	(2) In the office of an oral or maxillofacial surgeon or dentist who has obtained the 9
31	31	necessary and appropriate permit; provided that, the recipient has a dental condition that requires 10
32	32	hospitalization or general anesthesia as determined by the patient's treating provider. 11
33	33	40-8-34. Operating room costs - Dental care. 12
34	34	The department of human services shall provide medical assistance under this chapter for 13
35	35	the recognition, adoption and payment of the new coding guidelines (G0330) and associated 14
36	36	average payment rate approved by the Centers for Medicare and Medicaid effective January 21, 15
37	37	2023, for hospital operating room and related costs, including facility fees, for dental procedures. 16
38	38	Provided, further, that appropriate coding and fair payment for these services is crucial for the 17
39	39	continued allocation of hospital operating room resources to treat those with the most complex 18
40	40	cases in need of comprehensive dental care. 19

44	44	SECTION 2. Chapter 27-20.1 of the General Laws entitled "Nonprofit Dental Service 1
45	45	Corporations" is hereby amended by adding thereto the following sections: 2
46	46	27-20.1-23. Dental care - Coverage. 3
47	47	Any nonprofit dental service corporation shall provide for payment of medical assistance 4
48	48	for charges incurred, including any and all facility fees, medications and anesthetics provided in 5
49	49	conjunction with dental care that is rendered to a pediatric or adult recipient: 6
50	50	(1) In a hospital or ambulatory surgical center; or 7
51	51	(2) In the office of an oral or maxillofacial surgeon or a dentist who has obtained the 8
52	52	necessary and appropriate permit; provided that, the recipient has a dental condition that requires 9
53	53	hospitalization or general anesthesia as determined by the patient's treating provider. 10
