2121 It is enacted by the General Assembly as follows:
2222 SECTION 1. Chapter 40-8 of the General Laws entitled "Medical Assistance" is hereby 1
2323 amended by adding thereto the following sections: 2
2424 40-8-33. Dental care - Coverage - Dental surgical centers. 3
2525 The department of human services shall provide for medical assistance under this chapter 4
2626 for payment of medical assistance for charges incurred, including any and all facility fees, 5
2727 medications and anesthetics provided in conjunction with dental care that is rendered to a pediatric 6
2828 or adult recipient: 7
2929 (1) In a hospital or ambulatory surgical center; or 8
3030 (2) In the office of an oral or maxillofacial surgeon or dentist who has obtained the 9
3131 necessary and appropriate permit; provided that, the recipient has a dental condition that requires 10
3232 hospitalization or general anesthesia as determined by the patient's treating provider. 11
3333 40-8-34. Operating room costs - Dental care. 12
3434 The department of human services shall provide medical assistance under this chapter for 13
3535 the recognition, adoption and payment of the new coding guidelines (G0330) and associated 14
3636 average payment rate approved by the Centers for Medicare and Medicaid effective January 21, 15
3737 2023, for hospital operating room and related costs, including facility fees, for dental procedures. 16
3838 Provided, further, that appropriate coding and fair payment for these services is crucial for the 17
3939 continued allocation of hospital operating room resources to treat those with the most complex 18
4040 cases in need of comprehensive dental care. 19

4444 SECTION 2. Chapter 27-20.1 of the General Laws entitled "Nonprofit Dental Service 1
4545 Corporations" is hereby amended by adding thereto the following sections: 2
4646 27-20.1-23. Dental care - Coverage. 3
4747 Any nonprofit dental service corporation shall provide for payment of medical assistance 4
4848 for charges incurred, including any and all facility fees, medications and anesthetics provided in 5
4949 conjunction with dental care that is rendered to a pediatric or adult recipient: 6
5050 (1) In a hospital or ambulatory surgical center; or 7
5151 (2) In the office of an oral or maxillofacial surgeon or a dentist who has obtained the 8
5252 necessary and appropriate permit; provided that, the recipient has a dental condition that requires 9
5353 hospitalization or general anesthesia as determined by the patient's treating provider. 10
