2121 It is enacted by the General Assembly as follows:
2222 SECTION 1. Chapter 5-34 of the General Laws entitled "Nurses" is hereby amended by 1
2323 adding thereto the following section: 2
2424 5-34-50. Performance of cosmetic/aesthetic dermatological procedures.. 3
2525 (a) The board of nursing shall promulgate rules and regulations for the performance of 4
2626 cosmetic/aesthetic dermatological procedures. As used in this section, "cosmetic/aesthetic 5
2727 dermatological procedures" means a broad range of procedures including, but not limited to, the 6
2828 following: 7
2929 (1) Chemical peels - Micro-dermabrasion; 8
3030 (2) Sclerotherapy - Laser for aesthetics, hair removal; 9
3131 (3) Micropigmentation; 10
3232 (4) Light treatments; 11
3333 (5) Platelet rich plasma; 12
3434 (6) Neuromodulator and dermal filler injections (e.g., Botox, Restalyne, Collagen, 13
3535 Kybella); and 14
3636 (7) Non-ablative, non-vaporizing laser or light-based devices used for hair removal, 15
3737 photorejuvenation, acne, spider veins, vascular and pigmented lesions, and tattoo removal. 16
3838 (b) Registered nurses shall be allowed to perform cosmetic/aesthetic dermatological 17
3939 procedures pursuant to the orders of a duly authorized prescriber in accordance with the rules and 18
4040 regulations promulgated by the board of nursing. 19

4444 (c) In promulgating rules and regulations, the board of nursing shall address, but not be 1
4545 limited to, the following: 2
4646 (1) The orders from a duly authorized prescriber to include the patient's name, valid order 3
4747 date, medication or substance name, dosage, route, anatomical site for administration, specific 4
4848 administration directions and prescriber signature; 5
4949 (2) The documented knowledge, skill and competency necessary to carry out the 6
5050 cosmetic/aesthetic dermatological procedure in a safe manner; 7
5151 (3) The employing agency's cosmetic/aesthetic dermatological and emergency policies and 8
5252 procedures available in the facility; 9
5353 (4) The required education to include a supervised practicum resulting in a competency 10
5454 evaluation commensurate with the procedure. Components of the education include, as appropriate 11
5555 to the specific procedure, but are not limited to: 12
5656 (i) Anatomy and physiology; 13
5757 (ii) Pathophysiology of the integumentary system and supporting structures; 14
5858 (iii) Cosmological and dermatologic conditions; 15
5959 (iv) Wound healing principles; 16
6060 (v) Safe use of product/device/equipment; 17
6161 (vi) Side effects and management; 18
6262 (vii) Management of emergencies; and 19
6363 (viii) Patient and environmental safety. 20
6464 (5) When the procedure includes the use of non-ablative, non-vaporizing laser or light-21
6565 based devices, the requirement that the nurse have evidence of successful completion of a laser 22
6666 physics and safety course that includes relative content from the Occupational Safety and Health 23
6767 Administration (OSHA) and American National Standards for the Safe Use and Handling of Lasers 24
6868 in Health Care Facilities (ANSI) that includes both a didactic portion and practicum; 25
6969 (6) Documentation criteria including the following: 26
7070 (i) Review and verification of informed consent that clearly informs the patient of the 27
7171 operator's qualifications, licensure, and expected outcomes of the procedure; 28
7272 (ii) Assessment data inclusive of past medical, surgical, allergy and medication histories; 29
7373 (ii) Skin typing/classification; 30
7474 (iv) Sun exposure history; 31
7575 (v) Current cosmetic/dermatologic product usage; 32
7676 (vi) Exclusion from treatment criteria; 33
7777 (vii) Identification of and evaluation of test site as indicated; 34

8181 (viii) Specifics of the procedure performed and patient response to the procedure; 1
8282 (ix) Directions for referral back to or consultation with the duly authorized prescriber of 2
8383 the procedure; and 3
8484 (x) Provision to the patient of written pre- and post-procedure education which includes, 4
8585 but is not limited to, self-care instructions and follow-up recommendations inclusive of continued 5
8686 and emergent care needs. 6
8787 SECTION 2. This act shall take effect upon passage. 7
