RELATING TO SPORTS, RACING, AND ATHLETICS -- DIVISION OF GAMING AND 
ATHLETICS LICENSING

It is enacted by the General Assembly as follows: 
SECTION 1. Section 41-1-1 of the General Laws in Chapter 41-1 entitled "Division of 1 
Gaming and Athletics Licensing" is hereby amended to read as follows: 2 
41-1-1. Division of gaming and athletics licensing — Duties. 3 
Within the department of business regulation there shall be a division of gaming and 4 
athletics licensing. The division shall supervise the enforcement of all laws relating to the regulation 5 
and control of racing and athletics, and may in the first instance make decisions and issue orders, 6 
subject to appeal to the racing and athletics hearing board. The division shall exercise all powers 7 
and duties prescribed by chapters 3, 3.1, 4, 5, 7, and 11 of this title, and all other acts relative to the 8 
regulation and supervision of horse racing, dog racing, and athletics, heretofore performed by the 9 
commission on horse racing and athletics. The division shall comply with § 42-14-14 in the conduct 10 
of any investigation related to any license application, permit and/or registration related to chapters 11 
3, 3.1, 4, 7, and 11 of this title. The division may comply with § 42-14-14 in the conduct of any 12 
investigation related to any license application, permit and/or registration related to chapters 5 and 13 
5.2 of this title. The investigation shall require the applicant to apply to the bureau of criminal 14 
identification of the Rhode Island state police or the Rhode Island department of the attorney 15 
general for a nationwide criminal records check with fingerprinting. The applicant shall be 16 
responsible for payment of the costs of the criminal records check. The Rhode Island state police 17 
or the Rhode Island department of the attorney general, as applicable, shall send the results of the 18

criminal records check shall be sent to the division. Once the results are sent to and received by the 1 
Rhode Island lottery, the Rhode Island state police and the Rhode Island department of attorney 2 
general shall promptly destroy the fingerprint record(s). On or before February 1, 2011, the agency 3 
shall adopt rules and regulations establishing criteria to be used in determining whether, based upon 4 
a criminal records check, an application will be approved. 5 
SECTION 2. This act shall take effect upon passage. 6

This act would remove the requirement that the Rhode Island state police or the department 1 
of attorney general complete the nationwide criminal records check for any license application, 2 
permit and/or registration and require the applicant to apply for a nationwide criminal records check 3 
with fingerprinting and submission to the division of gaming and athletics. 4 
This act would take effect upon passage. 5
