| 22 | 22 | | SECTION 1. Section 36-4-21 of the General Laws in Chapter 36-4 entitled "Merit System" 1 |

| 24 | 24 | | 36-4-21. Open continuous competitive tests. 3 |

| 25 | 25 | | (a) The personnel administrator may use open continuous competitive tests to establish 4 |

| 26 | 26 | | lists and fill vacancies in an agency or agencies where there is a continued shortage of available 5 |
|---|
| 27 | 27 | | qualified persons or where there is a manifest imbalance of minorities (as currently defined in 6 |
|---|
| 28 | 28 | | employment law as Blacks, Hispanics, American Indians including Alaska Natives, and Asians 7 |
|---|
| 29 | 29 | | including Pacific Islanders) in the job category. 8 |
|---|
| 30 | 30 | | (b) The personnel administrator, any time any state agency has fifty (50) position vacancies 9 |
|---|
| 31 | 31 | | or more, shall administer civil service exams to fill those positions at least three (3) times per year. 10 |
|---|
| 32 | 32 | | (c) Open continuous competitive tests shall be subject to the conditions established in this 11 |
|---|
| 33 | 33 | | chapter for the preparation of employment lists. 12 |
