2222 It is enacted by the General Assembly as follows:
2323 SECTION 1. Section 25-3-2 of the General Laws in Chapter 25-3 entitled "Work on 1
2424 Holidays and Sundays" is hereby amended to read as follows: 2
2525 25-3-2. Increased pay required for work on Sundays and holidays. 3
2626 (a) Any person, association, or corporation receiving a permit from the division of racing 4
2727 and athletics of the department of business regulation to operate any horse racing, dog racing, or 5
2828 jai alai event under the parimutuel system and any person, association, or corporation doing 6
2929 business under a contractual agreement to provide any services to any horse racing, dog racing, or 7
3030 jai alai event under the parimutuel system shall compensate the necessary persons to conduct the 8
3131 event on Sundays and/or holidays for at least one and one-half (1½) times the normal rate of pay 9
3232 for the work performed, and it shall not be grounds for discharge or other penalty upon an employee 10
3333 for refusing to work at the horse racing, dog racing, or jai alai event upon any of the Sundays and 11
3434 holidays enumerated in this chapter, and nothing contained in this chapter shall prohibit any person 12
3535 from engaging in or being employed in connection with the holding or operation of the licensed 13
3636 event. 14
3737 (b) Notwithstanding any terms of a lawful collective bargaining agreement entered into 15
3838 prior to the effective date of this act, laborers, mechanics, and workers engaged in duties requiring 16
3939 principally physical exertion, who are required to work on Sundays and/or holidays shall be paid 17
4040 by their employers at least one and one-half (1½) times the normal rate of pay for the work 18
