2222 It is enacted by the General Assembly as follows:
2323 SECTION 1. Chapter 27-38.2 of the General Laws entitled "Insurance Coverage for Mental 1
2424 Illness and Substance Abuse" is hereby amended by adding thereto the following section: 2
2525 27-38.2-7. Payments for long-acting injectable medications for mental health or 3
2626 substance use disorders. 4
2727 (a) Notwithstanding any other provisions to the contrary, a group health plan, an individual 5
2828 or group health insurance plan, as defined under chapters 18, 19, 20, and 41 of title 27, the Rhode 6
2929 Island medical assistance program, as defined under chapter 8 of title 40, and any contract between 7
3030 the Rhode Island medical assistance program and a managed care organization shall separately 8
3131 reimburse, at the prevailing fee schedule, for long-acting injectable medications administered for a 9
3232 mental health condition or extended-release medications administered for a substance use disorder 10
3333 in hospital emergency department and inpatient settings. 11
3434 (b) The executive office of health and human services, in consultation with the Hospital 12
3535 Association of Rhode Island, shall implement a reimbursement policy for the use of long-acting 13
3636 injectable medications administered for a mental health condition or extended-release medications 14
3737 administered for a substance use disorder in hospital emergency department and inpatient settings. 15
3838 (c) If it determines that authorization from a federal agency is necessary for the 16
3939 implementation of this section, the executive office of health and human services is authorized to 17
4040 seek a state plan amendment and may delay implementing the provisions until the authorization is 18

4545 (d) The Rhode Island medical assistance program, as defined under chapter 8 of title 40, 2
4646 shall require through amending current and future medical assistance managed care contracts that 3
4747 the managed care organizations meet the provisions of this section. 4
4848 SECTION 2. This act shall take effect upon passage and applies to all policies, contracts, 5
4949 and certificates executed, delivered, issued for delivery, continued or renewed in this state on or 6
5050 after January 1, 2024. 7
