23 | 23 | | SECTION 1. Chapter 27-38.2 of the General Laws entitled "Insurance Coverage for Mental 1 |

24 | 24 | | Illness and Substance Abuse" is hereby amended by adding thereto the following section: 2 |

25 | 25 | | 27-38.2-7. Payments for long-acting injectable medications for mental health or 3 |
---|
26 | 26 | | substance use disorders. 4 |
---|
27 | 27 | | (a) Notwithstanding any other provisions to the contrary, a group health plan, an individual 5 |
---|
28 | 28 | | or group health insurance plan, as defined under chapters 18, 19, 20, and 41 of title 27, the Rhode 6 |
---|
29 | 29 | | Island medical assistance program, as defined under chapter 8 of title 40, and any contract between 7 |
---|
30 | 30 | | the Rhode Island medical assistance program and a managed care organization shall separately 8 |
---|
31 | 31 | | reimburse, at the prevailing fee schedule, for long-acting injectable medications administered for a 9 |
---|
32 | 32 | | mental health condition or extended-release medications administered for a substance use disorder 10 |
---|
33 | 33 | | in hospital emergency department and inpatient settings. 11 |

34 | 34 | | (b) The executive office of health and human services, in consultation with the Hospital 12 |
---|
35 | 35 | | Association of Rhode Island, shall implement a reimbursement policy for the use of long-acting 13 |
---|
36 | 36 | | injectable medications administered for a mental health condition or extended-release medications 14 |
---|
37 | 37 | | administered for a substance use disorder in hospital emergency department and inpatient settings. 15 |

38 | 38 | | (c) If it determines that authorization from a federal agency is necessary for the 16 |
---|
39 | 39 | | implementation of this section, the executive office of health and human services is authorized to 17 |
---|
40 | 40 | | seek a state plan amendment and may delay implementing the provisions until the authorization is 18 |
