2222 It is enacted by the General Assembly as follows:
2323 SECTION 1. Title 6 of the General Laws entitled "COMMERCIAL LAW — GENERAL 1
2424 REGULATORY PROVISIONS" is hereby amended by adding thereto the following chapter: 2

2626 GENERATIVE ARTIFICIAL INTELLIGENCE MODELS 4
2727 6-59-1. Purpose. 5
2828 The purpose of this chapter is to regulate generative artificial intelligence models, such as 6
2929 ChatGPT, in order to protect the public’s safety, privacy, and intellectual property rights. 7
3030 6-59-2. Definition. 8
3131 For the purposes of this chapter, the following words shall have the following meanings, 9
3232 unless the context clearly requires otherwise: 10
3333 (1) “Large-scale generative artificial intelligence model” means a machine learning model 11
3434 with a capacity of at least one billion (1,000,000,000) parameters that generates text or other forms 12
3535 of output, such as ChatGPT. 13
3636 (2) “Parameter” means any variable or value used to control the operation or output of a 14
3737 generative artificial intelligence model. 15
3838 6-59-3. Operating standards. 16
3939 Any company operating a large-scale generative artificial intelligence model shall adhere 17
4040 to the following operating standards: 18

4444 (1) The model shall not be used to engage in discrimination or bias against any individual 1
4545 or group based on protected characteristics, as defined by state or federal law; 2
4646 (2) In order to prevent plagiarism, the model shall be programmed to generate all text with 3
4747 a distinctive watermark or offer an authentication process that allows a user to determine whether 4
4848 a particular output was generated by the model; 5
4949 (3) The company shall implement reasonable security measures to protect the data of 6
5050 individuals used to train the model; 7
5151 (4) The company shall obtain informed consent from individuals before collecting, using 8
5252 or disclosing their data; 9
5353 (5) The company shall delete or de-identify any data collected from individuals if it is no 10
5454 longer needed for the intended purpose of the model; and 11
5555 (6) The company shall conduct regular risk assessments to identify, assess and mitigate 12
5656 reasonably foreseeable risks and cognizable harms related to their products and services, including 13
5757 in the design, development and implementation of such products and services. 14
5858 6-59-4. Registration with the attorney general. 15
5959 (a) Any company operating a large-scale generative artificial intelligence model shall 16
6060 register with the attorney general within ninety (90) days of the effective date of this chapter. 17
6161 (b) The registration shall include the following information: 18
6262 (1) The name and contact information of the company; 19
6363 (2) A description of the large-scale generative artificial intelligence model, including its 20
6464 capacity, training data, intended use, design process and methodologies; and 21
6565 (3) Information on the company's data collection, storage and security practices. 22
6666 (c) The attorney general shall maintain a public registry of all companies registered under 23
6767 this chapter. 24
6868 6-59-5. Enforcement. 25
6969 (a) The attorney general shall promulgate and adopt rules and regulations for the purposes 26
7070 of implementing this chapter. 27
7171 (b) To remedy violations of this chapter and for other relief that may be appropriate, the 28
7272 attorney general may bring an action against a person. 29
7373 SECTION 2. This act shall take effect on September 1, 2023. 30

8787 This act would authorize the office of attorney general to promulgate, adopt and enforce 1
8888 rules and regulations concerning generative artificial intelligence models, such as ChatGPT, in 2
8989 order to protect the public’s safety, privacy, and intellectual property rights. 3
9090 This act would take effect on September 1, 2023. 4
