2121 It is enacted by the General Assembly as follows:
2222 SECTION 1. Section 34-7-4 of the General Laws in Chapter 34-7 entitled "By Possession 1
2323 and Prescription" is hereby repealed. 2

2525 No right of footway, except claimed in connection with a right to pass with carriages, shall 4
2626 be acquired by prescription or adverse use for any length of time. 5

4040 This act would repeal the provisions of ยง 34-7-4 which provides that no right of footway, 1
4141 except claimed in connection with a right to pass with carriages, could be acquired by prescription 2
4242 or adverse use for any length of time. This act would effectively eliminate the statutory prohibition 3
4343 against acquiring a right of footway by adverse possession. 4
