RELATING TO LABOR AND LABOR RELATIONS -- HOISTING ENGINEERS

It is enacted by the General Assembly as follows: 
SECTION 1. Section 28-26-7 of the General Laws in Chapter 28-26 entitled "Hoisting 1 
Engineers" is hereby amended to read as follows: 2 
28-26-7. Application for license — Examination. 3 
(a) Each person who desires to act as a steam, internal combustion engines, electric, or 4 
compressed air hoisting engineer shall make application to the division for a license upon a form 5 
furnished to him or her, submit a notarized list of work experience, have possessed for at least three 6 
(3) years prior to filing of the application, a certificate of registration in full force and effect from 7 
the department of labor and training specifying that person as a registered apprentice hoisting 8 
engineer and the application of that applicant is accompanied with an affidavit or affidavits of his 9 
or her employer or former employers or other reasonably satisfactory evidence showing that the 10 
applicant has actually been engaged in hoisting work as an apprentice hoisting engineer in the State 11 
of Rhode Island for six thousand (6,000) hours of on the job training during a three (3) year period, 12 
which shall include the successful completion of one hundred twenty (120) hours of related 13 
instruction at a training program recognized by the department of labor and training, and shall pass 14 
an examination on the construction and operation of steam, electric, internal combustion engines, 15 
and compressed air engines and machinery. Applications for examinations must be received fifteen 16 
(15) working days prior to the examination date. 17 
(b) Any person applying for a license who knowingly makes any misstatement as to his or 18 
her work experience or other qualifications shall be subject to the penalties provided for in § 28-19

(c) In addition to the requirements for submitting an application for examination, as 2 
required in subsection (a) of this section, any person applying for a full license, a hydraulic crane 3 
license, or a lattice crane license shall also be required to include a valid medical health card with 4 
their application. A separate notarized statement shall also be attached to the application, and shall 5 
contain all work-related experience, including all equipment trained on and/or operated. 6 
(d) In addition to the requirements for submitting an application for examination, as 7 
required in subsection (a) of this section, any person applying for a construction forklift license or 8 
a full license shall also be required to include a copy of their OSHA forklift certification with their 9 
application. 10 
SECTION 2. This act shall take effect upon passage. 11

This act would amend the examination requirements for a hoisting engineers license. The 1 
new requirements would include a department of labor and training certificate of registration for at 2 
least three (3) years prior, and an affidavit from former employers indicating the applicant worked 3 
as an apprentice hoisting engineer in Rhode Island for six thousand (6,000) hours over the three (3) 4 
years, which would include one hundred twenty (120) hours of instruction at a training program 5 
recognized by the department of labor and training.  6 
This act would take effect upon passage. 7
