| 22 | 22 | | SECTION 1. Chapter 45-53 of the General Laws entitled "Low and Moderate Income 1 |

| 23 | 23 | | Housing" is hereby amended by adding thereto the following section: 2 |

| 24 | 24 | | 45-53-16. Public transportation requirement. 3 |

| 25 | 25 | | (a) Any municipality not provided with public transportation sufficient to extend to urban 4 |

| 26 | 26 | | service boundaries within the municipality shall be permitted to reduce the percentage of low- or 5 |
|---|
| 27 | 27 | | moderate-income housing required pursuant to this chapter from ten percent (10%) of the year 6 |
|---|
| 28 | 28 | | round housing units reported in the census to six percent (6%) of the year round housing units 7 |
|---|
| 29 | 29 | | reported in the census as defined in ยง 45-53-3(4). 8 |

| 30 | 30 | | (b) The decision to issue the percentage reduction provided in this section shall be 9 |
