2121 It is enacted by the General Assembly as follows:
2222 SECTION 1. Section 42-57-1 and 42-57-3 of the General Laws in Chapter 42-57 entitled 1
2323 "Fort Adams Foundation" are hereby amended to read as follows: 2
2424 42-57-1. Foundation created. 3
2525 The Fort Adams foundation (“the foundation”) is created a body, corporate and politic, to 4
2626 promote interest in and to plan, develop, coordinate, encourage, facilitate, set standards, and 5
2727 programs and projects relating to the restoration, renovation, reconstruction, and use of the 6
2828 historical Fort Adams structure State Park. 7
2929 42-57-3. Organization of foundation. 8
3030 (a) The foundation shall consist of the director of the department of environmental 9
3131 management, or his or her designee, a representative of the division of parks and recreation 10
3232 appointed by the director of the department of environmental management and four (4) three (3) 11
3333 public members, appointed by the governor with the advice and consent of the senate. In making 12
3434 appointments under this section, the governor shall solicit and give due consideration to the 13
3535 recommendations of the following persons, communities and organizations: 14
3636 (1) Rhode Island historical preservation commission; 15
3737 (2) City of Newport; and 16
3838 (3) Fort Adams Trust board of directors; and. 17
3939 (4) Chief of the department of environmental management division of parks and recreation. 18

4848 In making appointments under this section, the governor shall also give due consideration 5
4949 to the appointment of persons with expertise and experience in the fields of American history, 6
5050 military history, historic preservation, museums, education, historic architecture and/or 7
5151 engineering. 8
5252 (b) The director of the department of environmental management, or his or her designee 9
5353 shall act as chairperson. 10
5454 (c) The power of the foundation shall vest in and be exercised by or under the authority of 11
5555 its members, three (3) of whom shall constitute a quorum for the transaction of business. 12
5656 (d) Employees of the foundation shall be selected and appointed by the foundation, and 13
5757 shall be vested with those powers and duties that the foundation may determine. 14
5858 (e) All appointed members of the foundation as of the effective date of this act shall cease 15
5959 to be members of the foundation as of the effective date of this act. The governor shall thereupon 16
6060 nominate four (4) three (3) members: one of whom shall serve an initial term of one year; one of 17
6161 whom shall serve an initial term of two (2) years; and two (2) one of whom shall serve an initial 18
6262 terms term of three (3) years. Thereafter, all appointed members shall be appointed to serve three 19
6363 (3) year terms. In the event the senate is not in session on the effective date of this act, the governor 20
6464 may make temporary appointments which shall only be in effect until such time as the senate 21
6565 reconvenes at which time the governor shall appoint four (4) three (3) members. 22
6666 SECTION 2. This act shall take effect upon passage. 23
