22 | 22 | | SECTION 1. Section 42-57-1 and 42-57-3 of the General Laws in Chapter 42-57 entitled 1 |

23 | 23 | | "Fort Adams Foundation" are hereby amended to read as follows: 2 |

24 | 24 | | 42-57-1. Foundation created. 3 |

25 | 25 | | The Fort Adams foundation (“the foundation”) is created a body, corporate and politic, to 4 |
---|
26 | 26 | | promote interest in and to plan, develop, coordinate, encourage, facilitate, set standards, and 5 |
---|
27 | 27 | | programs and projects relating to the restoration, renovation, reconstruction, and use of the 6 |
---|
28 | 28 | | historical Fort Adams structure State Park. 7 |
---|
29 | 29 | | 42-57-3. Organization of foundation. 8 |
---|
30 | 30 | | (a) The foundation shall consist of the director of the department of environmental 9 |
---|
31 | 31 | | management, or his or her designee, a representative of the division of parks and recreation 10 |
---|
32 | 32 | | appointed by the director of the department of environmental management and four (4) three (3) 11 |
---|
33 | 33 | | public members, appointed by the governor with the advice and consent of the senate. In making 12 |
---|
34 | 34 | | appointments under this section, the governor shall solicit and give due consideration to the 13 |
---|
35 | 35 | | recommendations of the following persons, communities and organizations: 14 |
---|
36 | 36 | | (1) Rhode Island historical preservation commission; 15 |
---|
37 | 37 | | (2) City of Newport; and 16 |
---|
38 | 38 | | (3) Fort Adams Trust board of directors; and. 17 |
---|
39 | 39 | | (4) Chief of the department of environmental management division of parks and recreation. 18 |

48 | 48 | | In making appointments under this section, the governor shall also give due consideration 5 |

49 | 49 | | to the appointment of persons with expertise and experience in the fields of American history, 6 |
---|
50 | 50 | | military history, historic preservation, museums, education, historic architecture and/or 7 |
---|
51 | 51 | | engineering. 8 |
---|
52 | 52 | | (b) The director of the department of environmental management, or his or her designee 9 |
---|
53 | 53 | | shall act as chairperson. 10 |
---|
54 | 54 | | (c) The power of the foundation shall vest in and be exercised by or under the authority of 11 |
---|
55 | 55 | | its members, three (3) of whom shall constitute a quorum for the transaction of business. 12 |
---|
56 | 56 | | (d) Employees of the foundation shall be selected and appointed by the foundation, and 13 |
---|
57 | 57 | | shall be vested with those powers and duties that the foundation may determine. 14 |
---|
58 | 58 | | (e) All appointed members of the foundation as of the effective date of this act shall cease 15 |
---|
59 | 59 | | to be members of the foundation as of the effective date of this act. The governor shall thereupon 16 |
---|
60 | 60 | | nominate four (4) three (3) members: one of whom shall serve an initial term of one year; one of 17 |
---|
61 | 61 | | whom shall serve an initial term of two (2) years; and two (2) one of whom shall serve an initial 18 |
---|
62 | 62 | | terms term of three (3) years. Thereafter, all appointed members shall be appointed to serve three 19 |
---|
63 | 63 | | (3) year terms. In the event the senate is not in session on the effective date of this act, the governor 20 |
---|
64 | 64 | | may make temporary appointments which shall only be in effect until such time as the senate 21 |
---|
65 | 65 | | reconvenes at which time the governor shall appoint four (4) three (3) members. 22 |
---|
66 | 66 | | SECTION 2. This act shall take effect upon passage. 23 |
