2222 It is enacted by the General Assembly as follows:
2323 SECTION 1. Chapter 42-28.2 of the General Laws entitled "Police Officers - Commission 1
2424 on Standards and Training" is hereby amended by adding thereto the following section: 2
2525 42-28.2-8.6. Educational requirements -- Development disability recognition training. 3
2626 The commission on standards and training shall prepare and publish mandatory training 4
2727 standards to provide instruction for police officers in identifying, responding to, handling, 5
2828 investigating and reporting all incidents involving any person with a "developmental disability" as 6
2929 defined in § 40.1-1-8.1. The commission shall include this training in all curricula for recruits and 7
3030 in-service trainees, and in all police academies operated or certified by the commission. 8
3131 SECTION 2. Section 40.1-1-8.1 of the General Laws in Chapter 40.1-1 entitled 9
3232 "Department of Behavioral Healthcare, Developmental Disabilities and Hospitals" is hereby 10
3333 amended to read as follows: 11
3434 40.1-1-8.1. “Developmental disability” defined. 12
3535 The term “developmental disability” means a severe, chronic disability of a person that: 13
3636 (1) Is attributable to a mental or physical impairment or combination of mental and physical 14
3737 impairments; 15
3838 (2) Is manifested before the person attains age twenty-two (22) at any age; 16
3939 (3) Is likely to continue indefinitely; 17
4040 (4) Results in substantial functional limitations in three (3) or more of the following areas 18

4545 (i) Self-care; 2
4646 (ii) Receptive and expressive language; 3
4747 (iii) Learning; 4
4848 (iv) Mobility; 5
4949 (v) Self-direction; 6
5050 (vi) Capacity for independent living; and 7
5151 (vii) Economic self-sufficiency; and 8
5252 (5) Reflects the person’s need for a combination and sequence of special, interdisciplinary, 9
5353 or generic care, treatment, or other services that are of lifelong or extended duration and are 10
5454 individually planned and coordinated. 11
5555 SECTION 3. This act shall take effect upon passage. 12
