2323 It is enacted by the General Assembly as follows:
2424 SECTION 1. Section 37-25-1 of the General Laws in Chapter 37-25 entitled "Corrosion 1
2525 Prevention and Mitigation Work Requirements" is hereby amended to read as follows: 2
2626 37-25-1. Corrosion prevention and mitigation work requirements. 3
2727 (a) For purposes of this section: 4
2828 (1) “NACE 13/ACS 1 standard” means the Society for Protective Coatings/NACE 5
2929 International standard for an industrial coating and lining application specialist. 6
3030 (2) “Trained and certified personnel” means both of the following: 7
3131 (i) To the maximum extent feasible, workers performing surface preparation and 8
3232 application of protective coatings and linings to steel, who are classified as journey-level painters, 9
3333 shall be certified by an organization generally accepted in the industry as meeting the NACE 10
3434 13/ACS 1 standard, or a similar standard, that is generally accepted in the industry. Coatings 11
3535 applied during assembly are excluded. 12
3636 (ii) Workers performing surface preparation and application of protective coatings and 13
3737 linings to steel, who are classified as apprentices, shall be registered in an industrial apprenticeship 14
3838 program, approved by the department of labor and training, that provides training to meet the 15
3939 NACE 13/ACS 1 standard or a similar standard, that is generally accepted by the industry. 16
4040 (b) A public entity that awards a contract after January 1, 2024, that is paid for in whole or 17
4141 in part with state funds, shall require all contractors and subcontractors performing corrosion 18

4545 prevention and mitigation work to comply with the standards adopted pursuant to this section. 1
4646 (c) Contractors and subcontractors performing public works contracts for corrosion 2
4747 prevention and mitigation work must comply with the standards adopted pursuant to this section 3
4848 after January 1, 2024. 4
4949 (d) On or before January 1, 2023, the director of the department of labor and training in 5
5050 consultation with the department of environmental management, shall adopt regulations 6
5151 establishing standards for the performance of corrosion prevention and mitigation work on public 7
5252 projects that reflect industry best practices. Such industry best practices shall include, but are not 8
5353 limited to, the following: 9
5454 (1) Use of trained and certified personnel for surface preparation and application of 10
5555 protective coatings and linings to steel; 11
5656 (2) Use of inspectors to ensure best practices and standards are met; and 12
5757 (3) A plan to prevent environmental degradation, including, but not limited to, careful 13
5858 handling and containment of hazardous materials including, but not limited to, lead paint. 14
5959 (e)(1) The department of labor and training shall enforce the provisions of this chapter. If 15
6060 the director, or designee, determines that a violation of these provisions has occurred, the director, 16
6161 or designee, shall order a hearing at a time and place to be specified, and shall give notice thereof, 17
6262 together with a copy of the complaint or the purpose thereof, or a statement of the facts disclosed 18
6363 upon investigation, which notice shall be served personally or by mail on any person, business, 19
6464 corporation, or entity of any kind affected thereby. 20
6565 (2) The person, business, corporation, or entity shall have an opportunity to be heard in 21
6666 respect to the matters complained of at the time and place specified in the notice. The hearing shall 22
6767 be conducted by the director, or designee. 23
6868 (3) The hearing officer in the hearing shall be deemed to be acting in a judicial capacity, 24
6969 and shall have the right to issue subpoenas, administer oaths, and examine witnesses. The 25
7070 enforcement of a subpoena issued under this section shall be regulated by civil practice law and the 26
7171 rules of civil procedure. The hearing shall be expeditiously conducted and upon such hearing the 27
7272 hearing officer shall determine the issues raised and shall make a determination and enter an order 28
7373 within thirty (30) days of the close of the hearing, and forthwith serve a copy of the order, with a 29
7474 notice of the filing, upon the parties to the proceeding, personally or by mail. 30
7575 (4) The order shall dismiss the complaint or determine that a violation of the provisions of 31
7676 this chapter occurred. The order shall represent a final action by the department of labor and 32
7777 training. 33
7878 (f) Any contractor or subcontractor determined to have violated the provisions of this 34

8282 chapter shall be subject to a civil penalty of not less than one thousand five hundred dollars ($1,500) 1
8383 and not greater than three thousand dollars ($3,000), and shall be subject to the revocation of any 2
8484 relevant professional or occupational license, if the violation is deemed to have been intentional or 3
8585 egregious. 4
8686 (g) This section is applicable to all public works projects that fit the other criteria as 5
8787 provided in this section. 6
8888 SECTION 2. This act shall take effect upon passage. 7
