2222 It is enacted by the General Assembly as follows:
2323 SECTION 1. Section 16-16-12 of the General Laws in Chapter 16-16 entitled "Teachers’ 1
2424 Retirement [See Title 16 Chapter 97 — The Rhode Island Board of Education Act]" is hereby 2
2525 amended to read as follows: 3
2626 16-16-12. Procedure for service retirement. 4
2727 Retirement of a member on a service retirement allowance shall be made by the retirement 5
2828 board as follows: 6
2929 (a)(i) Any member may retire upon his or her written application to the retirement board 7
3030 as of the first day of the calendar month in which the application was filed, provided the member 8
3131 was separated from service prior to filing the application, and further provided however, that if 9
3232 separation from service occurs during the month in which the application is filed, the effective date 10
3333 shall be the first day following the separation from service, and provided further that the member 11
3434 on retirement date has attained the age of sixty (60) years and has completed at least ten (10) years 12
3535 of contributory service on or before July 1, 2005, or regardless of age has completed twenty-eight 13
3636 (28) years of total service and has completed at least ten (10) years of contributory service on or 14
3737 before July 1, 2005, and who retire before October 1, 2009, or are eligible to retire as of September 15
3838 30, 2009. 16
3939 (ii) For teachers who become eligible to retire on or after October 1, 2009, and prior to July 17
4040 1, 2012, benefits are available to teachers who have attained the age of sixty-two (62) and 18
4141 completed at least ten (10) years of contributory service. For teachers in service as of October 1, 19

4545 2009, who were not eligible to retire as of September 30, 2009, but became eligible to retire prior 1
4646 to July 1, 2012, the minimum retirement age of sixty-two (62) will be adjusted downward in 2
4747 proportion to the amount of service the member has earned as of September 30, 2009. The 3
4848 proportional formula shall work as follows: 4
4949 (A) The formula shall determine the first age of retirement eligibility under the laws in 5
5050 effect on September 30, 2009, which shall then be subtracted from the minimum retirement age of 6
5151 sixty-two (62). 7
5252 (B) The formula shall then take the teacher’s total service credit as of September 30, 2009, 8
5353 as the numerator and the years of service credit determined under (A) as the denominator. 9
5454 (C) The fraction determined in (B) shall then be multiplied by the age difference in (1) to 10
5555 apply a reduction in years from age sixty-two (62). 11
5656 (b)(i) Any member, who has not completed at least ten (10) years of contributory service 12
5757 on or before July 1, 2005, may retire upon his or her written application to the retirement board as 13
5858 of the first day of the calendar month in which the application was filed; provided, the member was 14
5959 separated from service prior thereto; and further provided, however, that if separation from service 15
6060 occurs during the month in which application is filed, the effective date shall be the first day 16
6161 following that separation from service; provided, the member on his or her retirement date had 17
6262 attained the age of fifty-nine (59) and had completed at least twenty-nine (29) years of total service; 18
6363 or provided, that the member on his or her retirement date had attained the age of sixty-five (65) 19
6464 and had completed at least ten (10) years of contributory service; or provided, that the member on 20
6565 his or her retirement date had attained the age of fifty-five (55) and had completed twenty (20) 21
6666 years of total service and provided, that the retirement allowance, as determined according to the 22
6767 formula in § 16-16-13 is reduced actuarially for each month that the age of the member is less than 23
6868 sixty-five (65) years and who retire before October 1, 2009, or are eligible to retire as of September 24
6969 30, 2009. 25
7070 (ii) For teachers who become eligible to retire on or after October 1, 2009, and prior to July 26
7171 1, 2012, benefits are available to teachers who have attained the age of sixty-two (62) and have 27
7272 completed at least twenty-nine (29) years of total service or have attained the age of sixty-five (65) 28
7373 and completed at least ten (10) years of contributory service. For teachers in service as of October 29
7474 1, 2009, who were not eligible to retire as of September 30, 2009, but become eligible to retire prior 30
7575 to July 1, 2012, who have a minimum retirement age of sixty-two (62), the retirement age will be 31
7676 adjusted downward in proportion to the amount of service the member has earned as of September 32
7777 30, 2009. The proportional formula shall work as follows: 33

8282 effect on September 30, 2009, which shall then be subtracted from the minimum retirement age of 1
8383 sixty-two (62). 2
8484 (B) The formula shall then take the teacher’s total service credit as of September 30, 2009, 3
8585 as the numerator and the years of service credit determined under (A) as the denominator. 4
8686 (C) The fraction determined in (B) shall then be multiplied by the age difference 5
8787 determined in (A) to apply a reduction in years from age sixty-two (62). 6
8888 (c) Effective July 1, 2012, the following shall apply to all teachers not eligible to retire 7
8989 prior to July 1, 2012: 8
9090 (i) A teacher with contributory service on or after July 1, 2012, shall be eligible to retire 9
9191 upon the completion of at least five (5) years of contributory service and attainment of the teacher’s 10
9292 Social Security retirement age. 11
9393 (ii) For teachers with five (5) or more years of contributory service as of June 30, 2012, 12
9494 with contributory service on and after July 1, 2012, who have a retirement age of Social Security 13
9595 Retirement Age, the retirement age will be adjusted downward in proportion to the amount of 14
9696 service the teacher has earned as of June 30, 2012, but in no event shall a teacher’s retirement age 15
9797 under this subparagraph (ii) be prior to the attainment of age fifty-nine (59) or prior to the teacher’s 16
9898 retirement age determined under the laws in effect on June 30, 2012. The proportional formula shall 17
9999 work as follows: 18
100100 (1) The formula shall determine the first age of retirement eligibility under the laws in 19
101101 effect on June 30, 2012, which shall then be subtracted from Social Security retirement age; 20
102102 (2) The formula shall then take the teacher’s total service credit as of June 30, 2012, as the 21
103103 numerator and the projected service at retirement age in effect on June 30, 2012, as the 22
104104 denominator; 23
105105 (3) The fraction determined in (2) shall then be multiplied by the age difference determined 24
106106 in (1) to apply a reduction in years from Social Security retirement age. 25
107107 (iii) Effective July 1, 2015, a teacher who has completed twenty (20) or more years of total 26
108108 service and who has attained an age within five (5) years of the eligible retirement age under 27
109109 subdivisions (c)(i) or (c)(ii) above or subsection (d) below, may elect to retire provided that the 28
110110 retirement allowance shall be reduced actuarially for each month that the age of the teacher is less 29
111111 than the eligible retirement age under subdivisions (c)(i) or (c)(ii) above or subsection (d) below in 30
112112 accordance with the following table: 31

123123 (iv) Notwithstanding any other provisions of section § 16-16-12(c), a teacher who has 5
124124 completed ten (10) or more years of contributory service as of June 30, 2012, may elect to retire at 6
125125 his or her eligible retirement date as determined under subsections (a) and (b) above provided that 7
126126 a teacher making an election under this paragraph shall receive the teacher’s retirement benefit 8
127127 determined and calculated based on the teacher’s service and average compensation as of June 30, 9
128128 2012. This provision shall be interpreted and administered in a manner to protect a teacher’s 10
129129 accrued benefit on June 30, 2012. 11
130130 (d)(i) Notwithstanding any other provisions of subsection (c) above, effective July 1, 2015, 12
131131 teachers in active service shall be eligible to retire upon the earlier of: 13
132132 (A) The attainment of at least age sixty-five (65) and the completion of at least thirty (30) 14
133133 years of total service, or the attainment of at least age sixty-four (64) and the completion of at least 15
134134 thirty-one (31) years of total service, or the attainment of at least age sixty-three (63) and the 16
135135 completion of at least thirty-two (32) years of total service, or the attainment of at least age sixty-17
136136 two (62) and the completion of at least thirty-three (33) years of total service; or 18
137137 (B) The teacher’s retirement eligibility date under subsections (c)(i) or (c)(ii) above. 19
138138 (ii) Notwithstanding any other provisions of subsection (c) or subsection (d)(i) of this 20
139139 section, commencing July 1, 2025, teachers in active service shall be eligible to retire upon the 21
140140 earlier of: 22
141141 (A) The attainment of at least age sixty (60) and the completion of at least thirty (30) years 23
142142 of total service; or 24
143143 (B) The teacher's retirement eligibility date under subsections (c)(i) or (c)(ii) of this section. 25
144144 (e) Except as specifically provided in §§ 36-10-9.1, 36-10-12 through 36-10-15, and 45-26
145145 21-19 through 45-21-22, no member shall be eligible for pension benefits under this chapter unless 27
146146 (i) The member shall have been a contributing member of the employees’ retirement 28
147147 system for at least ten (10) years; or 29
148148 (ii) For teachers in active contributory service on or after July 1, 2012, the teacher shall 30
149149 have been a contributing member of the employees’ retirement system for at least five (5) years. 31
150150 (2) Provided, however, a person who has ten (10) years service credit shall be vested; 32
151151 provided that for teachers in active contributory service on or after July 1, 2012, a teacher who has 33
152152 five (5) years of contributory service shall be vested. 34

156156 (3) Furthermore, any past service credits purchased in accordance with § 36-9-38 shall be 1
157157 counted towards vesting. 2
158158 (4) Any person who becomes a member of the employees’ retirement system pursuant to 3
159159 § 45-21-8 shall be considered a contributing member for the purpose of chapter 21 of title 45 and 4
160160 this chapter. 5
161161 (5) Notwithstanding any other provision of law, no more than five (5) years of service 6
162162 credit may be purchased by a member of the system. The five (5) year limit shall not apply to any 7
163163 purchases made prior to January 1, 1995. A member who has purchased more than five (5) years 8
164164 of service credit before January 1, 1995, shall be permitted to apply the purchases towards the 9
165165 member’s service retirement. However, no further purchase will be permitted. 10
166166 (6) Notwithstanding any other provision of law, effective July 1, 2012, except for purchases 11
167167 under §§ 16-16-7.1, 36-5-3, 36-9-31, 36-10-10.4, and 45-21-53: 12
168168 (i) For service purchases for time periods prior to a teacher’s initial date of hire, the 13
169169 purchase must be made within three (3) years of the teacher’s initial date of hire; and 14
170170 (ii) For service purchases for time periods for official periods of leave as authorized by 15
171171 law, the purchase must be made within three (3) years of the time the official leave was concluded 16
172172 by the teacher. Notwithstanding paragraphs (i) and (ii) above, service purchases from time periods 17
173173 prior to June 30, 2012, may be made on or prior to June 30, 2015. 18
174174 (f) No member of the teachers’ retirement system shall be permitted to purchase service 19
175175 credits for casual or seasonal employment, for employment as a temporary or emergency employee, 20
176176 a page in the general assembly, or for employment at any state college or university while the 21
177177 employee is a student or graduate of the college or university. 22
178178 (g) Except as specifically provided in §§ 16-16-6.2 and 16-16-6.4, a member shall not 23
179179 receive service credit in this retirement system for any year or portion of a year which counts as 24
180180 service credit in any other retirement system in which the member is vested or from which the 25
181181 member is receiving a pension and/or any annual payment for life. This subsection shall not apply 26
182182 to any payments received pursuant to the federal Social Security Act, 42 U.S.C. § 301 et seq. 27
183183 (h) A member who seeks to purchase or receive service credit in this retirement system 28
184184 shall have the affirmative duty to disclose to the retirement board whether or not he or she is a 29
185185 vested member in any other retirement system and/or is receiving a pension, retirement allowance, 30
186186 or any annual payment for life. The retirement board shall have the right to investigate as to whether 31
187187 or not the member has utilized the same time of service for credit in any other retirement system. 32
188188 The member has an affirmative duty to cooperate with the retirement board including, by way of 33
189189 illustration and not by way of limitation, the duty to furnish or have furnished to the retirement 34

193193 board any relevant information that is protected by any privacy act. 1
194194 (i) A member who fails to cooperate with the retirement board shall not have the time of 2
195195 service credit counted toward total service credit until the time the member cooperates with the 3
196196 retirement board and until the time the retirement board determines the validity of the service credit. 4
197197 (j) A member who knowingly makes a false statement to the retirement board regarding 5
198198 service time or credit shall not be entitled to a retirement allowance and is entitled only to the return 6
199199 of his or her contributions without interest. 7
200200 SECTION 2. Section 36-10-9 of the General Laws in Chapter 36-10 entitled "Retirement 8
201201 System — Contributions and Benefits" is hereby amended to read as follows: 9
202202 36-10-9. Retirement on service allowance — In general. 10
203203 Retirement of a member on a service retirement allowance shall be made by the retirement 11
204204 board as follows: 12
205205 (1)(a)(i) Any member may retire upon his or her written application to the retirement board 13
206206 as of the first day of the calendar month in which the application was filed; provided, the member 14
207207 was separated from service prior thereto; and further provided, however, that if separation from 15
208208 service occurs during the month in which application is filed, the effective date shall be the first 16
209209 day following that separation from service; and provided further that the member on his or her 17
210210 retirement date attained the age of sixty (60) and completed at least ten (10) years of contributory 18
211211 service on or before July 1, 2005, or who, regardless of age, has completed twenty-eight (28) years 19
212212 of total service and has completed at least ten (10) years of contributory service on or before July 20
213213 1, 2005, and who retire before October 1, 2009, or are eligible to retire as of September 30, 2009. 21
214214 (ii) For members who become eligible to retire on or after October 1, 2009, and prior to 22
215215 July 1, 2012, benefits are available to members who have attained the age of sixty-two (62) and 23
216216 completed at least ten (10) years of contributory service. For members in service as of October 1, 24
217217 2009, who were not eligible to retire as of September 30, 2009, but become eligible to retire prior 25
218218 to July 1, 2012, the minimum retirement age of sixty-two (62) will be adjusted downward in 26
219219 proportion to the amount of service the member has earned as of September 30, 2009. The 27
220220 proportional formula shall work as follows: 28
221221 (1) The formula shall determine the first age of retirement eligibility under the laws in 29
222222 effect on September 30, 2009, which shall then be subtracted from the minimum retirement age of 30
223223 sixty-two (62). 31
224224 (2) The formula shall then take the member’s total service credit as of September 30, 2009, 32

231231 (b)(i) Any member, who has not completed at least ten (10) years of contributory service 2

234234 separated from service prior thereto; and further provided, however, that if separation from service 5
235235 occurs during the month in which application is filed, the effective date shall be the first day 6
236236 following that separation from service; provided, the member or his or her retirement date had 7
237237 attained the age of fifty-nine (59) and had completed at least twenty-nine (29) years of total service 8
238238 or provided that the member on his or her retirement date had attained the age of sixty-five (65) 9
239239 and had completed at least ten (10) years of contributory service; or provided, that the member on 10
240240 his or her retirement date had attained the age of fifty-five (55) and had completed twenty (20) 11
241241 years of total service provided, that the retirement allowance, as determined according to the 12
242242 formula in § 36-10-10 is reduced actuarially for each month that the age of the member is less than 13
243243 sixty-five (65) years, and who retire before October 1, 2009, or are eligible to retire as of September 14
244244 30, 2009. 15
245245 (ii) For members who become eligible to retire on or after October 1, 2009 and prior to 16
246246 July 1, 2012, benefits are available to members who have attained the age of sixty-two (62) and 17
247247 completed at least twenty-nine (29) years of total service or have attained the age of sixty-five (65) 18
248248 and completed at least ten (10) years of contributory service. For members in service as of October 19
249249 1, 2009, who were not eligible to retire as of September 30, 2009, but become eligible to retire prior 20
250250 to July 1, 2012, who have a minimum retirement age of sixty-two (62), the retirement age will be 21
251251 adjusted downward in proportion to the amount of service the member has earned as of September 22
252252 30, 2009. The proportional formula shall work as follows: 23
253253 (1) The formula shall determine the first age of retirement eligibility under the laws in 24
254254 effect on September 30, 2009, which shall then be subtracted from the minimum retirement age of 25
255255 sixty-two (62). 26
256256 (2) The formula shall then take the member’s total service credit as of September 30, 2009, 27
257257 as the numerator and the years of service credit determined under (1) as the denominator. 28
258258 (3) The fraction determined in (2) above shall then be multiplied by the age difference 29
259259 determined in (1) to apply a reduction in years from age sixty-two (62). 30
260260 (c) Effective July 1, 2012, the following shall apply to all members not eligible to retire 31
261261 prior to July 1, 2012: 32
262262 (i) A member with contributory service on or after July 1, 2012, shall be eligible to retire 33
263263 upon the completion of at least five (5) years of contributory service and attainment of the member’s 34

268268 (ii) For members with five (5) or more years of contributory service as of June 30, 2012, 2
269269 with contributory service on and after July 1, 2012, who have a retirement age of Social Security 3
270270 Retirement Age, the retirement age will be adjusted downward in proportion to the amount of 4
271271 service the member has earned as of June 30, 2012, but in no event shall a member’s retirement 5
272272 age under this subparagraph (ii) be prior to the attainment of age fifty-nine (59) or prior to the 6
273273 member’s retirement age determined under the laws in effect on June 30, 2012. The proportional 7
274274 formula shall work as follows: 8
275275 (1) The formula shall determine the first age of retirement eligibility under the laws in 9

278278 the numerator and the projected service at retirement age in effect on June 30, 2012, as the 12

280280 (3) The fraction determined in (2) shall then be multiplied by the age difference determined 14
281281 in (1) to apply a reduction in years from Social Security retirement age. 15
282282 (iii) Effective July 1, 2015, a member who has completed twenty (20) or more years of 16
283283 total service and who has attained an age within five (5) years of the eligible retirement age under 17
284284 subparagraphs (c)(i) or (c)(ii) above or subsection (d) below, may elect to retire provided that the 18
285285 retirement allowance shall be reduced actuarially for each month that the age of the member is less 19
286286 than the eligible retirement age under subparagraphs (c)(i) or (c)(ii) above or subsection (d) below 20
287287 in accordance with the following table: 21

295295 (iv) Notwithstanding any other provisions of section 36-10-9(c), a member who has 29
296296 completed ten (10) or more years of contributory service as of June 30, 2012, may elect to retire at 30
297297 his or her eligible retirement date as determined under paragraphs (1)(a) and (1)(b) above provided 31
298298 that a member making an election under this paragraph shall receive the member’s retirement 32
299299 benefit determined and calculated based on the member’s service and average compensation as of 33
300300 June 30, 2012. This provision shall be interpreted and administered in a manner to protect a 34

304304 member’s accrued benefit on June 30, 2012. 1
305305 (d)(i) Notwithstanding any other provisions of subsection (c) above, effective July 1, 2015, 2
306306 members in active service shall be eligible to retire upon the earlier of: (A) The attainment of at 3
307307 least age sixty-five (65) and the completion of at least thirty (30) years of total service, or the 4
308308 attainment of at least age sixty-four (64) and the completion of at least thirty-one (31) years of total 5
309309 service, or the attainment of at least age sixty-three (63) and the completion of at least thirty-two 6
310310 (32) years of total service, or the attainment of at least age sixty-two (62) and the completion of at 7
311311 least thirty-three (33) years of total service; or (B) The member’s retirement eligibility date under 8
312312 subsections (c)(i) or (c)(ii) above. 9
313313 (ii) Notwithstanding any other provisions of subsection (c) or subsection (d)(i) of this 10
314314 section, commencing July 1, 2025, teachers in active service shall be eligible to retire upon the 11
315315 earlier of: 12
316316 (A) The attainment of at least age sixty (60) and the completion of at least thirty (30) years 13
317317 of total service; or 14
318318 (B) The teacher's retirement eligibility date under subsections (c)(i) or (c)(ii) of this section. 15
319319 (2) Any faculty employee at a public institution of higher education under the jurisdiction 16
320320 of the council on postsecondary education shall not be involuntarily retired upon attaining the age 17
321321 of seventy (70) years. 18
322322 (3)(i) Except as specifically provided in § 36-10-9.1, §§ 36-10-12 — 36-10-15, and §§ 45-19
323323 21-19 — 45-21-22, (I) On or prior to June 30, 2012 no member shall be eligible for pension benefits 20
324324 under this chapter unless the member shall have been a contributing member of the employee’s 21
325325 retirement system for at least ten (10) years, or (II) For members in active contributory service on 22
326326 or after July 1, 2012, the member shall have been a contributing member of the retirement system 23
327327 for at least five (5) years. 24
328328 (ii) Provided, however, a person who has ten (10) years service credit on or before June 16, 25
329329 1991, shall be vested. 26
330330 (iii) Furthermore, any past service credits purchased in accordance with § 36-9-38 shall be 27
331331 counted towards vesting. 28
332332 (iv) Any person who becomes a member of the employees’ retirement system pursuant to 29
333333 § 45-21-4 shall be considered a contributing member for the purpose of chapter 21 of title 45 and 30
334334 this chapter. 31
335335 (v) Notwithstanding any other provision of law, no more than five (5) years of service 32
336336 credit may be purchased by a member of the system. The five (5) year limit shall not apply to any 33
337337 purchases made prior to January 1, 1995. A member who has purchased more than five (5) years 34

341341 of service credits before January 1, 1995, shall be permitted to apply those purchases towards the 1
342342 member’s service retirement. However, no further purchase will be permitted. Repayment in 2
343343 accordance with applicable law and regulation of any contribution previously withdrawn from the 3
344344 system shall not be deemed a purchase of service credit. 4
345345 (vi) Notwithstanding any other provision of law, effective July 1, 2012, except for 5
346346 purchases under §§ 16-16-7.1, 36-5-3, 36-9-31, 36-10-10.4, and 45-21-53, (A) For service 6
347347 purchases for time periods prior to a member’s initial date of hire, the purchase must be made 7
348348 within three (3) years of the member’s initial date of hire, (B) For service purchases for time periods 8
349349 for official periods of leave as authorized by law, the purchase must be made within three (3) years 9
350350 of the time the official leave was concluded by the member. Notwithstanding the preceding 10
351351 sentence, service purchases from time periods prior to June 30, 2012, may be made on or prior to 11
352352 June 30, 2015. 12
353353 (4) No member of the employees’ retirement system shall be permitted to purchase service 13
354354 credits for casual, seasonal, or temporary employment, or emergency appointment, for employment 14
355355 as a page in the general assembly, or for employment at any state college or university while the 15
356356 employee is a student or graduate assistant of the college or university. 16
357357 (5) Except as specifically provided in §§ 16-16-6.2 and 16-16-6.4, a member shall not 17
358358 receive service credit in this retirement system for any year or portion of it, which counts as service 18
359359 credit in any other retirement system in which the member is vested or from which the member is 19
360360 receiving a pension and/or any annual payment for life. This subsection shall not apply to any 20
361361 payments received pursuant to the federal Social Security Act or to payments from a military 21
362362 pension earned prior to participation in state or municipal employment, or to military service credits 22
363363 earned prior to participation in state or municipal employment. 23
364364 (6) A member who seeks to purchase or receive service credit in this retirement system 24
365365 shall have the affirmative duty to disclose to the retirement board whether or not he or she is a 25
366366 vested member in any other retirement system and/or is receiving a pension, retirement allowance, 26
367367 or any annual payment for life. The retirement board shall have the right to investigate as to whether 27
368368 or not the member has utilized the same time of service for credit in any other retirement system. 28
369369 The member has an affirmative duty to cooperate with the retirement board including, by way of 29
370370 illustration and not by way of limitations the duty to furnish or have furnished to the retirement 30
371371 board any relevant information which is protected by any privacy act. 31
372372 (7) A member who fails to cooperate with the retirement board shall not have the time of 32
373373 service counted toward total service credit until such time as the member cooperates with the 33
374374 retirement board and until such time as the retirement board determines the validity of the service 34

379379 (8) A member who knowingly makes a false statement to the retirement board regarding 2
380380 service time or credit shall not be entitled to a retirement allowance and is entitled only to the return 3
381381 of his or her contributions without interest. 4
382382 SECTION 3. Section 45-21-16 of the General Laws in Chapter 45-21 entitled "Retirement 5
383383 of Municipal Employees" is hereby amended to read as follows: 6
384384 45-21-16. Retirement on service allowance. 7
385385 Retirement of a member on a service retirement allowance shall be made by the retirement 8
386386 board as follows: 9
387387 (1)(i) Any member who is eligible to retire on or before June 30, 2012, may retire upon the 10
388388 member’s written application to the retirement board as of the first day of the calendar month in 11
389389 which the application was filed, provided the member was separated from service prior to the 12
390390 application, and provided, further, that if separation from service occurs during the month in which 13
391391 application is filed, the effective date is the first day following the separation from service, provided 14
392392 that the member at the time so specified for the member’s retirement has attained the applicable 15
393393 minimum retirement age and has completed at least ten (10) years of total service or who, regardless 16
394394 of age, completed thirty (30) years of total service, and notwithstanding that during the period of 17
395395 notification the member has separated from service. The minimum ages for service retirement 18
396396 (except for employees completing thirty (30) years of service) is fifty-eight (58) years. 19
397397 (ii) Effective July 1, 2012, the following shall apply to all members not eligible to retire 20
398398 prior to July 1, 2012: 21
399399 (A) A member with contributory service on or after July 1, 2012, shall be eligible to retire 22
400400 upon the completion of at least five (5) years of contributory service and attainment of the member’s 23
401401 Social Security retirement age. 24
402402 (B) For members with five (5) or more years of contributory service as of June 30, 2012, 25
403403 with contributory service on and after July 1, 2012, who have a retirement age of Social Security 26
404404 retirement age, the retirement age will be adjusted downward in proportion to the amount of service 27
405405 the member has earned as of June 30, 2012, but in no event shall a member’s retirement age under 28
406406 this subparagraph (B) be prior to the attainment of age fifty-nine (59) or prior to the member’s 29
407407 retirement age determined under the laws in effect on June 30, 2012. The proportional formula shall 30
408408 work as follows: 31
409409 (1) The formula shall determine the first age of retirement eligibility under the laws in 32
410410 effect on June 30, 2012, which shall then be subtracted from Social Security retirement age; 33
411411 (2) The formula shall then take the member’s total service credit as of June 30, 2012, as 34

415415 the numerator and the projected service at retirement age in effect on June 30, 2012, as the 1
416416 denominator; 2
417417 (3) The fraction determined in (2) shall then be multiplied by the age difference determined 3
418418 in (1) to apply a reduction in years from Social Security retirement age. 4
419419 (C) Effective July 1, 2015, a member who has completed twenty (20) or more years of total 5
420420 service and who has attained an age within five (5) years of the eligible retirement age under 6
421421 subparagraphs (ii)(A) or (ii)(B) above or subsection (iii) below, may elect to retire provided that 7
422422 the retirement allowance shall be reduced actuarially for each month that the age of the member is 8
423423 less than the eligible retirement age under subparagraphs (ii)(A) or (ii)(B) above or subsection (iii) 9
424424 below in accordance with the following table: 10

432432 (D)(1) Notwithstanding any other provisions of § 42-21-16(1)(ii), a member who has 18
433433 completed ten (10) or more years of contributory service as of June 30, 2012, may elect to retire at 19
434434 his or her eligible retirement date as determined under paragraph (i) above provided that a member 20
435435 making an election under this paragraph shall receive the member’s retirement benefit determined 21
436436 and calculated based on the member’s service and average compensation as of June 30, 2012. This 22
437437 provision shall be interpreted and administered in a manner to protect a member’s accrued benefit 23
438438 on June 30, 2012. 24
439439 (iii)(A) Notwithstanding any other provisions of subsection (ii) above, effective July 1, 25
440440 2015, members in active service shall be eligible to retire upon the earlier of: (I) The attainment of 26
441441 at least age sixty-five (65) and the completion of at least thirty (30) years of total service, or the 27
442442 attainment of at least age sixty-four (64) and the completion of at least thirty-one (31) years of total 28
443443 service, or the attainment of at least age sixty-three (63) and the completion of at least thirty-two 29
444444 (32) years of total service, or the attainment of at least age sixty-two (62) and the completion of at 30
445445 least thirty-three (33) years of total service; or (II) The member’s retirement eligibility date under 31
446446 subsections (ii)(A) or (ii)(B) above. 32
447447 (B) Notwithstanding any other provisions of subsection (ii) or subsection (iii)(A) of this 33
448448 section, commencing July 1, 2025, members in active service shall be eligible to retire upon the 34

453453 (I) The attainment of least age sixty (60) and the completion of at least thirty (30) years of 2
454454 total service; or 3
455455 (II) The member's retirement eligibility date under subsections (ii)(A) or (ii)(B) of this 4
456456 section. 5
457457 (2) Except as specifically provided in §§ 45-21-19 — 45-21-22, no member is eligible for 6
458458 pension benefits under this chapter unless: 7
459459 (I) On or prior to June 30, 2012, the member has been a contributing member of the 8
460460 employees’ retirement system for at least ten (10) years; or 9
461461 (II) For members in active contributory service on or after July 1, 2012, the member shall 10
462462 have been a contributing member of the employees’ retirement system for at least five (5) years. 11
463463 (i) Provided, however, a person who has ten (10) years service credit on or before June 16, 12
464464 1991, is vested. 13
465465 (ii) Furthermore, any past service credits purchased in accordance with § 45-21-62 are 14
466466 counted towards vesting. 15
467467 (iii) Any person who becomes a member of the employees’ retirement system pursuant to 16
468468 § 45-21-4 shall be considered a contributing member for the purpose of this chapter. 17
469469 (iv) Notwithstanding any other provision of law, no more than five (5) years of service 18
470470 credit may be purchased by a member of the System. The five (5)-year limit does not apply to any 19
471471 purchases made prior to the effective date of this provision. A member who has purchased more 20
472472 than five (5) years of service credit maximum, before January 1, 1995, shall be permitted to apply 21
473473 the purchases towards the member’s service retirement. However, no further purchase will be 22
474474 permitted. Repayment, in accordance with applicable law and regulation, of any contribution 23
475475 previously withdrawn from the System is not deemed a purchase of service credit. 24
476476 (v) Notwithstanding any other provision of law, effective July 1, 2012, except for purchases 25
477477 under §§ 16-16-7.1, 36-5-3, 36-9-31, 36-10-10.4, and 45-21-53: 26
478478 (I) For service purchases for time periods prior to a member’s initial date of hire; the 27
479479 purchase must be made within three (3) years of the member’s initial date of hire; and 28
480480 (II) For service purchases for time periods for official periods of leave as authorized by 29
481481 law, the purchase must be made within three (3) years of the time the official leave was concluded 30
482482 by the member. 31
483483 Notwithstanding (I) and (II) above, service purchases from time periods prior to June 30, 32
484484 2012, may be made on or prior to June 30, 2015. 33
485485 (3) No member of the municipal employees’ retirement system is permitted to purchase 34

489489 service credits for casual, temporary, emergency or seasonal employment, for employment as a 1
490490 page in the general assembly, or for employment at any state college or university while the 2
491491 employee is a student or graduate assistant of the college or university. 3
492492 (4) A member does not receive service credit in this retirement system for any year or 4
493493 portion of a year, which counts as service credit in any other retirement system in which the member 5
494494 is vested or from which the member is receiving a pension and/or any annual payment for life. This 6
495495 subsection does not apply to any payments received pursuant to the federal Social Security Act or 7
496496 to payments from a military pension earned prior to participation in state or municipal employment, 8
497497 or to military service credits earned prior to participation in state or municipal employment. 9
498498 (5) A member who seeks to purchase or receive service credit in this retirement system has 10
499499 the affirmative duty to disclose to the retirement board whether or not he or she is a vested member 11
500500 in any other retirement system and/or is receiving a pension retirement allowance or any annual 12
501501 payment for life. The retirement board has the right to investigate whether or not the member has 13
502502 utilized the same time of service for credit in any other retirement system. The member has an 14
503503 affirmative duty to cooperate with the retirement board including, by way of illustration and not by 15
504504 way of limitation, the duty to furnish or have furnished to the retirement board any relevant 16
505505 information which is protected by any privacy act. 17
