2323 It is enacted by the General Assembly as follows:
2424 SECTION 1. Chapter 42-11 of the General Laws entitled "Department of Administration" 1
2525 is hereby amended by adding thereto the following section: 2
2626 42-11-22. State construction projects metrics. 3
2727 (a) The state division of planning, in conjunction with the division of capital asset 4
2828 management and maintenance and the office of energy resources, shall, prepare an environmental 5
2929 and energy checklist for all state construction projects under the purview of the department of 6
3030 administration which exceed ten million dollars ($10,000,000) in cost. 7
3131 (b) The environmental and energy checklist shall consider the following issues: 8
3232 (1) Coastal flooding during storm surges in one hundred (100) and five hundred (500) year 9
3333 flood events on the site for the project; 10
3434 (2) Other flooding during one hundred (100) and five hundred (500) year flood events on 11
3535 the site for the project; 12
3636 (3) Resilience of facilities at the site to coastal and other flooding during one hundred (100) 13
3737 and five hundred (500) year flood events for the project; 14
3838 (4) Impact of the project on flooding and stormwater management for neighboring 15
3939 properties, particularly vulnerable state facilities; 16
4040 (5) Alternative stormwater management strategies; 17
4141 (6) Energy efficiency of the facility and any intentions to pursue leadership in energy and 18

4545 environmental design (LEED) or other similar standards for the project; 1
4646 (7) Any present value costs/savings/comparisons/evaluations used for heating, ventilation, 2
4747 and air conditioning (HVAC) systems; 3
4848 (8) Intentions and plans to use efficient, renewable or any alternative energy sources on the 4
4949 project; 5
5050 (9) Access to public transit, pedestrians and bicycles; and 6
5151 (10) Any other environmental and energy issues that the department of administration 7
5252 deems necessary, critical, and relevant to the long-term success of the project. 8
5353 (c) Once created, the planning division shall make the checklist available to those persons 9
5454 within the department of administration who are responsible for the management of the state 10
5555 construction projects meeting the criteria set forth in subsection (b) of this section. The person 11
5656 responsible for the management of the construction project shall complete the checklist and shall 12
5757 sign it and certify that it will be maintained and placed with all other publicly accessible 13
5858 construction project materials in accordance with applicable retention records policies. 14
5959 (d) Nothing in this section shall require the checklist to be completed to the satisfaction of 15
6060 the division of planning as the intent of this section is to consider the substance contained in the 16
6161 checklist during the design and construction phases of a building construction project. 17
6262 (e) Where possible, other branches, departments, agencies, and institutions of the state shall 18
6363 create and consider a similar checklist where applicable. 19
6464 SECTION 2. This act shall take effect upon passage. 20
