23 | 23 | | SECTION 1. Legislative findings and purpose. 1 |
---|
24 | 24 | | (a) The general assembly finds that: 2 |
---|
25 | 25 | | (1) School psychologists are part of a comprehensive program to meet student needs, 3 |
---|
26 | 26 | | consistent with 20 U.S.C. Sec. 1400 [the "Individuals with Disabilities Education Act"] and 20 4 |
---|
27 | 27 | | U.S.C. Sec. 6301 [the "Every Student Succeeds Act"]. 5 |
---|
28 | 28 | | (2) School psychologists are an integral part of the school team and support student 6 |
---|
29 | 29 | | learning, mental health and behavior to help students achieve academically, socially, behaviorally, 7 |
---|
30 | 30 | | and emotionally. 8 |
---|
31 | 31 | | (3) The National Association of School Psychologists recommends a maximum ratio of 9 |
---|
32 | 32 | | five hundred (500) students per school psychologists in order to provide a comprehensive range of 10 |
---|
33 | 33 | | school psychological services. 11 |
---|
34 | 34 | | (4) There is a shortage of school psychologists in Rhode Island, with an estimated ratio of 12 |
---|
35 | 35 | | 763:1. Ratios in the urban districts average 1:1000. 13 |
---|
36 | 36 | | (5) A shortage of school psychologists across the State of Rhode Island jeopardizes the 14 |
---|
37 | 37 | | state's ability to provide essential services and supports to students, schools, and communities. 15 |
---|
38 | 38 | | (6) Data indicate that shortages of school psychologists will persist into the future. 16 |
---|
39 | 39 | | (7) There is an insufficient number of credentialed school psychology graduates produced 17 |
---|
40 | 40 | | by the state's higher education institutions to fill existing gaps. 18 |
---|
41 | 41 | | (8) Initiatives designed to promote and support the education and preparation of school 19 |

---|
49 | 49 | | (b) The purpose of this legislation is: 5 |
---|
50 | 50 | | (1) To address the shortage of school psychologists in the State of Rhode Island. 6 |
---|
51 | 51 | | (2) To address the shortage of school psychologists in the higher education pipeline. 7 |
---|
52 | 52 | | (3) To create a pipeline for licensure through the department of health that would allow for 8 |
---|
53 | 53 | | independent contracting, educational evaluations, consultation, and other services related to the 9 |
---|
54 | 54 | | academic learning process. 10 |
---|
55 | 55 | | (4) To improve the academic, behavioral, and social–emotional well-being of children and 11 |
---|
56 | 56 | | youth by increasing access to high quality school-employed mental and behavioral health 12 |
---|
57 | 57 | | professionals. 13 |
---|
58 | 58 | | (5) To improve the academic, behavioral, and social-emotional well-being of children and 14 |
---|
59 | 59 | | youth by increasing community access to high quality mental and behavioral health professionals 15 |
---|
60 | 60 | | who specialize in school psychology, and psychoeducational evaluations. 16 |
---|
61 | 61 | | (6) To ensure the state fulfills its obligations to state and federal laws that address students 17 |
---|
62 | 62 | | with disabilities, school safety, school climate and social and emotional learning. 18 |
---|
63 | 63 | | SECTION 2. Sections 5-44-1, 5-44-12, 5-44-13 and 5-44-15 of the General Laws in 19 |
---|
64 | 64 | | Chapter 5-44 entitled "Psychologists" are hereby amended to read as follows: 20 |
---|
65 | 65 | | 5-44-1. Definitions. 21 |
---|
66 | 66 | | As used in this chapter: 22 |
---|
67 | 67 | | (1) “Academic psychologist” means a person employed by or associated with a recognized 23 |
---|
68 | 68 | | college or university or other recognized institution who is engaged in teaching, studying, or 24 |
---|
69 | 69 | | conducting research in the science of psychology. 25 |
---|
70 | 70 | | (2) “Board” means the board of psychology established by § 5-44-3. 26 |
---|
71 | 71 | | (3) “Department” means the Rhode Island department of health. 27 |
---|
72 | 72 | | (4) “Director” means the director of the Rhode Island department of health. 28 |
---|
73 | 73 | | (5) “Education” means the academic program pursued by a person in obtaining a doctoral 29 |
---|
74 | 74 | | degree, that program to include formal course work, seminars, and practica. 30 |
---|
75 | 75 | | (6) "Graduate program" means a program accredited by the state that is dedicated to 31 |
---|
76 | 76 | | providing an organized program of graduate preparation in school psychology and provides no less 32 |
---|
77 | 77 | | than sixty (60) graduate semester hours (or the equivalent) and includes coursework and experience 33 |
---|
78 | 78 | | relevant to both education and psychology. Coursework shall advance knowledge in: 34 |
---|

85 | 85 | | (iv) Multi-tiered systems of support to address students' academic, social--emotional, and 4 |
---|
86 | 86 | | mental and behavioral health needs including: 5 |

87 | 87 | | (A) Universal screening and early identification; 6 |
---|
88 | 88 | | (B) Prevention and intervention services; 7 |
---|
89 | 89 | | (C) Progress monitoring; 8 |

90 | 90 | | (D) Providing a range of increasingly intensive services based on student need; 9 |
---|
91 | 91 | | (v) School-wide practices to promote student learning, resilience and risk factors, and crisis 10 |
---|
92 | 92 | | preparedness, response, and recovery; 11 |
---|
93 | 93 | | (vi) Mental health interventions; 12 |
---|
94 | 94 | | (vii) Consultation and collaboration; 13 |
---|
95 | 95 | | (viii) Family--school--community collaboration; 14 |
---|
96 | 96 | | (ix) Diversity in development and learning; 15 |
---|
97 | 97 | | (x) Program evaluation and research; 16 |
---|
98 | 98 | | (xi) Professional ethics; 17 |
---|
99 | 99 | | (xii) Systems; and 18 |
---|
100 | 100 | | (xiii) All relevant local, state and federal laws, including the Individuals with Disabilities 19 |
---|
101 | 101 | | Education Act and the requirements specific to the role of the school psychologist. 20 |
---|
102 | 102 | | (6)(7) “Licensed psychologist” means a person who has been licensed for the practice of 21 |
---|
103 | 103 | | psychology under this chapter. “Psychologist” as used in this chapter means a licensed psychologist 22 |
---|
104 | 104 | | as defined in this section. 23 |
---|
105 | 105 | | (8) "Licensed school psychologist" means a school psychologist who meets the 24 |
---|
106 | 106 | | qualifications set forth in § 5-44-9.1. 25 |
---|
107 | 107 | | (9) "Living wage" means the amount of money needed to provide for annual basic needs 26 |
---|
108 | 108 | | for an individual to live above the poverty level and is determined by the state. 27 |
---|
109 | 109 | | (7)(10) “Practice of psychology” means the rendering of professional psychological 28 |
---|
110 | 110 | | services to individuals, groups, families, or any public or private organization for remuneration. 29 |
---|
111 | 111 | | Professional psychological services means applying established psychological principles, methods, 30 |
---|
112 | 112 | | or procedures for the purpose of preventing or eliminating symptomatic, maladaptive, or undesired 31 |
---|
113 | 113 | | behavior and of enhancing interpersonal relationships, work and life adjustment, personal 32 |
---|
114 | 114 | | effectiveness, and mental health. The practice of psychology includes, but is not limited to: 33 |
---|
115 | 115 | | (i) Diagnoses and treatment of emotional, mental, or behavioral dysfunction, disorder, or 34 |
---|
116 | 116 | | |

119 | 119 | | disability, alcoholism and substance-abuse disorders of habit or conduct, as well as of the 1 |
---|
120 | 120 | | psychological aspects of physical illness, accident, injury, or disability; 2 |
---|
121 | 121 | | (ii) Psychological testing and evaluation of intelligence, personality, abilities, interests, 3 |
---|
122 | 122 | | aptitudes, and neuropsychological functioning; 4 |
---|
123 | 123 | | (iii) Psychoeducation evaluation, therapy, remediation, and consultation; and 5 |
---|
124 | 124 | | (iv) Counseling, psychotherapy, psychoanalysis, hypnotherapy, biofeedback, and behavior 6 |
---|
125 | 125 | | analysis and therapy. 7 |
---|
126 | 126 | | (8)(11) “Psychology student,” “psychology trainee,” “psychology intern,” or “psychology 8 |
---|
127 | 127 | | resident” means a student, intern, or other person studying or preparing for the profession of 9 |
---|
128 | 128 | | psychologist under the supervision of recognized educational or training institutions or facilities. 10 |
---|
129 | 129 | | (12) "School psychology internship" means a culminating and immersive field-supervised 11 |
---|
130 | 130 | | experience in which the primary focus is on providing high-quality experiences, attainment of 12 |
---|
131 | 131 | | comprehensive school psychology competencies, and integration and application of the full range 13 |
---|
132 | 132 | | of domains of school psychology. Minimum requirements for an internship shall include: 14 |
---|
133 | 133 | | (i) At least one thousand two hundred (1,200) hours in duration over the course of an 15 |
---|
134 | 134 | | academic year; 16 |
---|
135 | 135 | | (ii) At least six hundred (600) hours of the internship shall occur in a school-based setting 17 |
---|
136 | 136 | | as defined by the National Association of School Psychologists (NASP) standards; 18 |
---|
137 | 137 | | (iii) Opportunities and supervision in a broad range of direct and indirect school 19 |
---|
138 | 138 | | psychological services; and 20 |
---|
139 | 139 | | (iv) Supervision shall be conducted by a credentialed school psychologist or a professional 21 |
---|
140 | 140 | | appropriately credentialed for the internship setting. 22 |
---|
141 | 141 | | (9)(13) “Training” means the pre-professional or professional-supervised experience 23 |
---|
142 | 142 | | received by the person at the pre- or post-doctoral level, that experience to have been obtained in 24 |
---|
143 | 143 | | an internship, clinic, or other similar professional setting. 25 |
---|
144 | 144 | | 5-44-12. Application fee. 26 |
---|
145 | 145 | | The applicant applying for licensure as a psychologist or a licensed school psychologist 27 |
---|
146 | 146 | | shall pay a fee as set forth in § 23-1-54 to the department. 28 |
---|
147 | 147 | | 5-44-13. Temporary license. 29 |
---|
148 | 148 | | (a) Pursuant to §§ 5-44-6 and 5-44-23(f) and rules and regulations promulgated hereunder, 30 |
---|
149 | 149 | | a temporary permit to practice psychology under supervision may be granted to a candidate for 31 |
---|
150 | 150 | | licensure who has paid the required fee as set forth in § 23-1-54 and has satisfied the following 32 |
---|
151 | 151 | | requirements: 33 |
---|
152 | 152 | | (1) Filed an application for licensure with all required supporting materials; 34 |
---|

156 | 156 | | (2) Has received a doctoral degree in accordance with § 5-44-9, and successfully completed 1 |

---|
159 | 159 | | (3) Shall only practice under the appropriate supervision of a licensed psychologist as 4 |
---|
160 | 160 | | delineated in the rules and regulations promulgated hereunder; 5 |
---|
161 | 161 | | (4) Shall refrain from using the title “psychologist” or "licensed school psychologist" 6 |
---|
162 | 162 | | representing himself or herself as a psychologist other than by using the title “psychology student,” 7 |
---|
163 | 163 | | “psychology trainee,” “psychology intern,” "licensed school psychologist trainee," or “psychology 8 |
---|
164 | 164 | | resident”; and 9 |
---|
165 | 165 | | (5) The temporary permit shall be valid for a period of two (2) years from the date of 10 |
---|
166 | 166 | | issuance. 11 |
---|
167 | 167 | | (b) Temporary permit holders may request from the board a one-year extension. Such an 12 |
---|
168 | 168 | | extension may be granted at the discretion of the board upon review of the applicant’s 13 |
---|
169 | 169 | | circumstances. This extension shall only be granted once. 14 |
---|
170 | 170 | | 5-44-15. Expiration and renewal of licenses — Continuing education — Lapsed 15 |
---|
171 | 171 | | license. 16 |
---|
172 | 172 | | (a) The license of every person licensed under the provisions of this chapter shall expire 17 |
---|
173 | 173 | | on the first day of July of the next even-numbered year following the issuance of his or her license. 18 |
---|
174 | 174 | | (b) On or before the first day of May of each even-numbered year, the department shall 19 |
---|
175 | 175 | | mail an application for renewal of license to every person to whom a license has been issued or 20 |
---|
176 | 176 | | renewed during the cycle. 21 |
---|
177 | 177 | | (c) Every licensed person who desires to renew his or her license shall file with the 22 |
---|
178 | 178 | | department a renewal application, executed, together with a renewal fee as set forth in § 23-1-54, 23 |
---|
179 | 179 | | on or before the first day of June in each even-numbered year. Upon receipt of a renewal application 24 |
---|
180 | 180 | | and payment of the renewal fee, the accuracy of the application shall be verified and the department 25 |
---|
181 | 181 | | may grant a renewal license effective July 1st and expiring the June 30th in each even-numbered 26 |
---|
182 | 182 | | year. 27 |
---|
183 | 183 | | (d) Every licensed psychologist or licensed school psychologist who desires to continue 28 |
---|
184 | 184 | | licensure as a licensed psychologist or licensed school psychologist shall present satisfactory 29 |
---|
185 | 185 | | evidence to the board and approved by rule or regulation of the board that the licensed psychologist 30 |
---|
186 | 186 | | or licensed school psychologist has completed a prescribed course of continuing licensed 31 |
---|
187 | 187 | | psychological education. 32 |

188 | 188 | | (e) Any person who allows his or her license to lapse, by failing to renew it on or before 33 |
