RELATING TO CRIMINALS -- CORRECTIONAL INSTITUTIONS -- INTERSTATE
DETAINERS

It is enacted by the General Assembly as follows:
SECTION 1. Chapter 13-13 of the General Laws entitled "Interstate Detainers" is hereby 1
amended by adding thereto the following section: 2
13-13-9. Immigration detainers. 3
All state law enforcement agencies including, but not limited to, the division of sheriffs 4
and the department of corrections shall honor all detainer requests and any other holds from the 5
Department of Homeland Security and Immigration and Custom Enforcement. Any person with a 6
detainer request or other hold, of which the state agency has been made aware, shall hold said 7
person in custody until Immigration and Customs Enforcement (ICE) can take custody of said 8
person. 9
SECTION 2. This act shall take effect upon passage. 10

This act would require state law enforcement agencies including the division of sheriffs 1
and the department of corrections, to honor all detainer requests from the Department of Homeland 2
Security and Immigration and Custom Enforcement until the federal agencies take custody of the 3
detained person. 4
