2121 It is enacted by the General Assembly as follows:
2222 SECTION 1. Chapter 27-18 of the General Laws entitled "Accident and Sickness Insurance 1
2323 Policies" is hereby amended by adding thereto the following section: 2
2424 27-18-95. Licensed certified lactation counselor. 3
2525 (a) As used in this section, “licensed certified lactation counselor” means a trained 4
2626 professional who holds a licensure and certification by the department of health in accordance with 5
2727 chapter 13.8 of title 23. Licensed certified lactation counselors provide services in assessment, 6
2828 evaluation, problem identification, treatment, education, and consultation to provide lactation care 7
2929 and services to childbearing families, and infant children from birth to twelve (12) months old 8
3030 within the scope of practice pursuant to the provisions of § 23-13.8-9. 9
3131 (b) Every individual or group health insurance contract, or every individual or group 10
3232 hospital or medical expense insurance policy, plan, or group policy delivered, issued for delivery, 11
3333 or renewed in this state on or after January 1, 2026, shall provide coverage for the services of 12
3434 lactation counselors in accordance with each health insurers' respective principles and mechanisms 13
3535 of reimbursement, credentialing, and contracting, if the services are within the lactation counselors' 14
3636 area of professional competence pursuant to the provisions of chapter 13.8 of title 23 ("lactation 15
3737 counselor practice act of 2024"), and are currently reimbursed when rendered by any other health 16
3838 care provider. No insurer or hospital or medical service corporation may require supervision, 17
3939 signature, or referral by any other health care provider as a condition of reimbursement, except 18
4040 when those requirements are also applicable to other categories of health care providers. No insurer 19

4444 or hospital or medical service corporation or patient may be required to pay for duplicate services 1
4545 actually rendered by both a licensed certified lactation counselor and any other health care provider. 2
4646 (c) Every individual or group health insurance contract, or every individual or group 3
4747 hospital or medical expense insurance policy, plan, or group policy delivered, issued for delivery, 4
4848 or renewed in this state that is required to cover licensed certified lactation counselor services 5
4949 defined in subsection (a) of this section, shall report utilization and cost information related to 6
5050 licensed certified lactation counselor services to the office of the health insurance commissioner on 7
5151 or before July 1, 2026 and each July 1 thereafter. The office of the health insurance commissioner 8
5252 shall define the utilization and cost information required to be reported. 9
5353 (d) This section shall not apply to insurance coverage providing benefits for: 10
5454 (1) Hospital confinement indemnity; 11
5555 (2) Disability income; 12
5656 (3) Accident only; 13
5757 (4) Long-term care; 14
5858 (5) Medicare supplement; 15
5959 (6) Limited benefit health; 16
6060 (7) Specified disease indemnity; 17
6161 (8) Sickness or bodily injury or death by accident or both; and 18
6262 (9) Other limited benefit policies. 19
6363 SECTION 2. Chapter 27-19 of the General Laws entitled "Nonprofit Hospital Service 20
6464 Corporations" is hereby amended by adding thereto the following section: 21
6565 27-19-87. Licensed certified lactation counselor. 22
6666 (a) As used in this section, “licensed certified lactation counselor” means a trained 23
6767 professional who holds a licensure and certification by the department of health in accordance with 24
6868 chapter 13.8 of title 23. Licensed certified lactation counselors provide services in assessment, 25
6969 evaluation, problem identification, treatment, education, and consultation to provide lactation care 26
7070 and services to childbearing families, and infant children from birth to twelve (12) months old 27
7171 within the scope of practice pursuant to the provisions of § 23-13.8-9. 28

7373 hospital or medical expense insurance policy, plan, or group policy delivered, issued for delivery, 30

149149 professional who holds a licensure and certification by the department of health in accordance with 32
